Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, February 15, 2018 in the Board Room of the Lombard Village Hall was called to order by Village President Keith Giagnorio at 7:00 p.m. Director of Public Works Carl Goldsmith led the Pledge of Allegiance. Village President Giagnorio asked the students in the audience who had participated in the Youth Leadership Program to come to the front. Village Clerk Sharon Kuderna read the following: Before we begin tonight, we would like to mention that we have several students here from Lombard High Schools who have been participating in the Village’s Youth Leadership Program. Over the past couple of weeks, these students have met with staff and toured department facilities. They have learned about local government and Village Departments. We hope that they have enjoyed their experience and are able to walk away with more knowledge about their Village. An interesting note about this year’s group is that every high school in Lombard is represented here. We are happy to say we had students from CPSA, Glenbard East, Glenbard South, Islamic Foundation School, Montini and Willowbrook participate. We hope that you learned something new and we thank you for joining us the past few weeks and tonight. II. Approval of Minutes A motion was made by Trustee Mike Fugiel, seconded by Trustee Reid Foltyniewicz, that the minutes of the February 1, 2018 regular meeting of the President and Board of Trustees of the Village of Lombard be approved. The motion carried by the following vote: Ayes: 4 - Mike Fugiel, Reid Foltyniewicz, Bill Ware and Keith Giagnorio Nays: none VI. Committee Reports Community Promotion & Tourism - Trustee Mike Fugiel, Chairperson Trustee Mike Fugiel, Chairperson of the Community Promotion & Tourism Committee, reported the committee met and reviewed two grant requests. Community Relations Committee - Trustee Robyn Pike, Chairperson Trustee Bill Ware, Alternate Chairperson of the Community Relations Committee, reported the committee met and reviewed the Youth Leadership Program. A budget presentation was made to the committee by staff with recommendations being forwarded to the Finance and Administration Committee for further consideration. Economic/Community Development Committee - Trustee Bill Johnston, Chairperson No report Finance & Administration Committee, Trustee Reid Foltyniewicz, Chairperson No report Public Safety & Transportation Committee - Trustee Dan Whittington, Chairperson Mike Fugiel, Alternate Chairperson for the Public Safety & Transportation Committee, reported the committee met and reviewed the request for a reduced speed limit on Fairfield Avenue; a reduced speed limit on Grace Street; request for no parking on Broadview south of North Avenue and no parking in the cul-de-sac on Technology Drive. The next meeting is March 7th. Village of Lombard Page 2 Village Board of Trustees Minutes February 15, 2018 Public Works & Environmental Concerns Committee - Trustee Bill Ware, Chairperson Trustee Bill Ware, Chairperson of the Public Works & Environmental Concerns Committee, reported the committee met and reviewed proposed text amendments to Chapters 150 and 151 of the Village Code. The committee was provided an overview of the FY 2019 budget and has recommended changes in various service levels totaling about $100,000 which will be further reviewed by the Finance & Administration Committee. The committee will also be reviewing Pavement Management Procedures and Policies. Trustee Ware then thanked the staff of the Public Works Department for all of their efforts last week with snow operations. He noted the following: the snow event occurred from February 8th through February 12th; the department worked around the clock with 12-hour shifts for personnel to support the Village's objectives as outlined in the Snow Plan; the Village communicated updates to staff and residents via social media and Facebook posts reached over 30,00 people; very positive feedback was received from residents and motorists; the Village received 18.3 inches of snow during the event; Village crews worked 1,472 hours, drove 10,210 miles and used 2,656 gallons of fuel; estimated costs for snow removal for the event are $114,223.00. He again thanked the staff for their efforts and diligence with snow removal efforts. Village Manager/Village Board Comments No report Village of Lombard Page 3 Village Board of Trustees Minutes February 15, 2018 VIII Consent Agenda . The Village Attorney indicated that as a waiver of bids requires no less than four (4) Trustees to vote in favor of the waiver, and as there are only three (3) Trustees present at the meeting, no action can be taken on the Consent Agenda items that include a waiver of bids. As such, these items will need to be continued to the March 1st Village Board meeting. A motion was made by Trustee Bill Ware, seconded by Trustee Mike Fugiel, that Consent Agenda item E (180073 - Purchase of Skid-steer loader with trailer and attachments and approval of an ordinance declaring Village equipment as surplus property); Consent Agenda item F (180087 - Purchase of self-contained breathing apparatuses (SCABA) and approval of an ordinance declaring Village equipment as surplus property); and Consent Agenda item O (180083 - Catch basin cleaning project); be removed from the agenda and continued to the March 1, 2018 Village Board agenda. This Payroll/Accounts Payable was approved on the Consent Agenda B. 180084 Approval of Village Payroll For the period ending February 3, 2018 in the amount of $881,199.72. This Payroll/Accounts Payable was approved on the Consent Agenda C. 180085 Approval of Accounts Payable For the period ending February 9, 2018 in the amount of $1,234,861.47. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. 160211 Property Transfer between the Village of Lombard and the Forest Preserve District of DuPage County - Amended Ordinance Declaring the necessity for the Village of Lombard to use and occupy certain real estate owned by the Forest Preserve District of DuPage County for the wastewater treatment facilities of the Glenbard Village of Lombard Page 4 Village Board of Trustees Minutes February 15, 2018 Wastewater Authority, pursuant to the Local Government Property Transfer Act. This ordinance was previously approved at the May 19, 2016 meeting, and an amended ordinance was approved at the June 16 and November 17, 2016 meetings. Upon approval, it was determined that the Village and DuPage County Forest Preserve District needed further discussion regarding the terms of the related Easement Agreement. Staff requests a waiver of first reading. (DISTRICT #1) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7219, 7227, 7299, 7470 E. 180073 Purchase of a Skid-Steer Loader with Trailer & Attachment and Approval of an Ordinance Declaring Village Equipment as Surplus Property (this matter was continued from February 15, 2018) Request for a waiver of bids and award of contracts to Atlas Bobcat in the amount of $40,680.00 and West Side Tractor in the amount of $7,300.00; and approval of an ordinance declaring Village units SM481 and SM914 as surplus property and authorizing their trade-in. Enactment No: Ordinance 7476 F. 180087 Purchase of Self-Contained Breathing Apparatuses (SCBA) and Approval of an Ordinance Declaring Village Equipment as Surplus Property (this matter was continued from February 15, 2018) Request for a waiver of bids; award of a contract through FEMA for the purchase of forty-four self-contained breathing apparatus (SCBA) in the amount of $349,875 with the Village's portion in the amount of $31,806; approval of an ordinance declaring Village-owned SCBA units as surplus and authorizing their trade-in. Enactment No: Ordinance 7477 Other Ordinances on First Reading G. 180082 Title 11, Chapter 113, Section 113.04 - Burglar Alarms Amending Title 11, Chapter 113, Section 113.04 of the Lombard Village Code, to clarify that those individuals who install alarm systems must comply with State law when doing so, including, but not limited to, being licensed by the State if operating as a "private alarm contractor", as such term is defined in 225 ILCS 447/5-10. This Ordinance was passed on first reading on the Consent Agenda Enactment No: Ordinance 7480 Village of Lombard Page 5 Village Board of Trustees Minutes February 15, 2018 Ordinances on Second Reading H. 180027 PC 18-01: Text Amendment to Zoning Ordinance, Parking Requirements for Hotels Recommendation from the Plan Commission to approve a text amendment to Section 155.602 Table 6.3 of the Lombard Zoning Ordinance (and any other relevant sections for clarity) to amend the parking for hotels, motels and similar uses. (DISTRICTS - ALL) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 7471 I. 180029 PC 18-02: 2100 St. Regis Drive, Holiday Inn Express The petitioner requests that the Village take the following actions on the subject property located within the B3PD Planned Development (St. Regis Planned Development): 1. Approve a conditional use pursuant to Section 155.415(C)(11) of the Lombard Zoning Ordinance for a hotel; 2. Pursuant to Section 155.504 (A) (major changes in a planned development) of the Lombard Zoning Ordinance, amend the St. Regis Planned Development, as established by Ordinance No. 2249 and amended by Ordinance Nos. 4409, 4470 and 4596, as follows: a. Approve a deviation from Section 155.415(F)(3) and 155.508(C)(6) to reduce minimum required interior side yard setback from 10 feet (10’) to zero feet (0’) along the southeast property line; b. Pursuant to Section 154.203(D) (Minor and major plats of Village of Lombard Page 6 Village Board of Trustees Minutes February 15, 2018 resubdivision) of the Lombard Subdivision Ordinance, approve a major plat of resubdivision. The petition is referred to as PC 18-02. The property is located at 2100 St. Regis Drive (northeast corner of the intersection of St. Regis Drive and North Lake Drive),Lombard, Illinois. (DISTRICT #3) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 7472 J. 180035 PC 18-05: Text Amendment to Zoning Ordinance, Stacking requirements for Drive-in and Drive-through facilities Recommendation from the Plan Commission to approve text amendments to Section 155.602 of the Lombard Zoning Ordinance (and any other relevant sections for clarity) to amend the stacking requirements for drive-in and drive-through facilities. (DISTRICTS - ALL) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 7473 K. 180036 PC 18-06: 209 and 211 South Main Street The petitioner, Two Eleven Main Street LLC, requests that the Village take the following actions on the subject property located within the B5A Downtown Perimeter District: 1. Grant a conditional use, pursuant to Section 155.419(C) of the Zoning Ordinance, to allow for a drive-through facility; 2. Approve a variation from Section 155.602(A)(5) of the Zoning Ordinance to reduce the length of parking stalls from eighteen feet (18’) to sixteen and a half feet (16.5’) along the north property line; 3. Approve a variation from Section 153.508(B)(19) of the Sign Ordinance to allow a total area of 67 square feet of wall signage where a maximum area of 50 square feet is permitted. Bid in compliance with Public Act 85-1295. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda N. 180076 Specialty Landscaping and Annual Planting Bed Maintenance Award of a contract to Beary Landscape Management, the lowest responsible bidder of four (4) bids received, in the amount of $70,000.00. Bid in compliance with Public Act 85-1295. As such, both items should be continued to the March 1st Village Board meeting. A. 180086 First Amendment to an Intergovernmental Agreement Between the Village and the Lombard Park District, and the Authorization to Convey Real Property to the Lombard Park District in Relation Thereto (Two Resolutions Attached, with a Separate Vote to be Taken in Regard to Each Resolution, as the Resolution Authorizing the Conveyance (2 Below) Requires a 2/3rds Vote of the Corporate Authorities (This matter was Continued from February 15, 2018) 1. Resolution Approving First Amendment to an Intergovernmental Agreement with the Lombard Park District Regarding Modifications to Terrace View Pond. This document amends the legal description of the West Crystal Property and no other changes are proposed. 2. Resolution Authorizing the Conveyance of the Property Commonly Known As 115 W.
