Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, May 17, 2018 in the Board Room of the Lombard Village Hall was called to order at 7:00 pm by Village President Keith Giagnorio. The Lombard Police Department Honor Guard Posted the Colors and led the Pledge of Allegiance. II. Public Participation 180179 Proclamation - Lombard Citizen Police Academy Alumni Association 20 Year Anniversary This proclamation was read at the recognition prior to the Village Board meeting. President Giagnorio present the proclamation to the President of the CPA Alumni Association. 180229 Proclamation - National Police Week Village Clerk Sharon Kuderna read the proclamation for National Police Week. Village President Giagnorio presented the proclamation to Chief Roy Village of Lombard Page 1 Village Board of Trustees Minutes May 17, 2018 Newton. Chief Newton thanked the Village for support of all of our Police Officers including fallen officers who had given the ultimate sacrifice. He noted the Citizen Police Academy Association was an extension of the Police Department. He thanked the Lombard Police Honor Guard. He stated our officers are proud to serve the Village and that they truly care about the community. 180230 Proclamation - Public Works Week Village Clerk Sharon Kuderna read the proclamation for Public Works Week. Village President Keith Giagnorio presented the proclamation to Director of Public Works Carl Goldsmith. Director Goldsmith thanked the Village for the recognition and support. Director Goldsmith then noted the first Citizen Public Works Academy had been held. A ceremony was held prior to the Village Board meeting thanking the members of the CPWA for their participation. V. Approval of Minutes A motion was made by Trustee Dan Whittington, seconded by Trustee Robyn Pike, that the minutes of the Special meeting of April 19, 2018 and the minutes of the Regular Meeting of May 3, 2018 be approved. Village Manager/Village Board Comments Trustee Bill Ware, stated that he has been a resident of Lombard for 28 years. He has never been so proud of being a Lombardian as he is now. He noted that the town and residents have all come together with red ribbons on so many trees in recognition of the Glenbard East students who were burned several weeks ago. He is humbled by all that came out to attend the car wash at the high school that raised over $35,000 and the Moose fundraising event that raised over $15,000. He thanked everyone for their participation and support. Village President Keith Giagnorio wished Trustee Ware a happy early birthday. Village Clerk Sharon Kuderna read the following announcements: Lilac Time Photo contest - Lombard is hosting its 5th Annual Lilac Time Photo Contest, seeking photos from Lilac Time events in Lombard. Categories include best photo of Lilacia Park; photo that best shows the spirit of community in Lombard; and the best lilac Time Parade photo. The goal of the contest is to collect and display beautiful images from the community during Lombard’s popular time of year. Submissions must be received by Friday, May 25 at 4:30 pm and required a signed release form available at www.villageoflombard.org/photocontest. Lilac Parade - Sunday, May 20th caps the end of Lilac Time festivities with our annual Lilac Parade! The Parade will step off at 1:30 p.m. from Main and Wilson and progress north to Maple Street. Memorial Day Ceremony - The Village of Lombard is inviting residents, Veterans of the Armed Services, and local scouts to attend this year’s annual Memorial Day program on Monday, May 28 at 12 noon, at the Sunken Garden at Common Park, located just east of the intersection Grace St. and Maple St. in Lombard. This year’s ceremony will pay tribute to the 100th Anniversary of the end of WWI. Learn more at villageoflombard.org/Memorial Day. Village Offices will be closed on Monday, May 28 in observance of the Memorial Day holiday. We wish each of every one of you a safe holiday and ask that you take a moment to remember our Veterans and those serving our country today. Remember to drive safely - heightened enforcement will take place over the holiday weekend including DUI, seatbelt and distracted driving. Village Board Meetings - The first meetings of the Village Board scheduled for June, July and August are cancelled. Our next Village Board meeting will be held on Thursday, June 21st at 7:00 pm. Butterfield Road effective June 1, 2018. (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7518 F. 180205 ZBA 18-03 - 239 W. Crystal Avenue Requests the Village take the following action on the subject property located within the R2 Single-Family Residence District: Grant approval of a variation from Section 155.407(E) of the Zoning Ordinance to allow a lot width of 45 feet for an existing lot of record, where a minimum lot width of 60 feet is required. The relief is requested in order to allow for the reconstruction of a single-family home on the property. (DISTRICT #1) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7519 G. 180222 Ordinance Amending the Lombard Traffic Code - 800 Parkview Boulevard - School Speed Zone Recommendation from the Public Safety & Transportation Committee approving the request of Soaring Eagle Academy for the posting of a school speed zone. (DISTRICT #2) This Request was approved on the Consent Agenda Enactment No: Ordinance 7520 H. 180223 Text Amendments to Section 150.030 of the Building Code - Construction Type IIB and IIIB Limitations The Board of Building Appeals (BOBA) recommends approval of the code amendments to Section 150.030 of the Building Code in that Construction Type IIB and IIIB limitations be tied to the provisions set forth within the Use and Occupancy Classifications of the IBC in lieu of the Lombard Zoning Ordinance. Northern Illinois Municipal Electric Cooperative (NIMEC) To Obtain Bids From Electricity Providers (Moved to Consent U-2) L. 180246 Revised Salary Ordinance Ordinance amending the Village's Salary Ordinance effective May 17, 2018 due to restructuring of positions, including IT staffing structure to improve efficiencies, strategic planning and succession planning at no additional costs to the Village. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7524 Other Ordinances on First Reading M. 180227 Text Amendment to Section 32.079(G) of the Village Code: Historic Plaques The Historic Preservation Commission (HPC) is recommending that the Village Board adopt an amendment to the Village Code that would obligate the property owner to return a Landmark Site Plaque to the Village in the event the property is no longer designated a landmark site. St. Charles Road - Second Time Extension Request Requesting approval of an Ordinance extending the time period to start construction of the proposed project for an additional six month period until December 17, 2018. (DISTRICT #4) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7342, 7484 Ordinances on Second Reading N. 180172 Downtown Lombard Area Improvement & Renovation Grant Program - Text Amendments to Section 36.30 of the Village Code and Companion Policy Ordinance approving code amendments to Section 36.30 of the Village Code and amendments to the Downtown Area Renovation and Improvement Grant Program. The amendments provide for additional funding opportunities for exterior accessibility enhancement and clarifies program requirements. (DISTRICTS #1, #4 & #5) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 7525 O. 180204 Disconnection of DuPage County Forest Preserve District Property - 889 W. St. Charles Road The Department of Community Development transmits for your consideration an ordinance disconnecting the property located at 889 W. St. Charles Road from the Village of Lombard municipal boundaries. The proposed disconnection is consistent with the previously approved Intergovernmental Agreements between the Villages of Lombard and Glen Ellyn. (DISTRICT #1) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 7526 Resolutions P. Pavement Management Policy (Moved to Consent AA-2) Q. 180224 IL Route 53 Storm Water Pump Station, Final Balancing Change Order No. 5 Reflecting an increase to the contract with Rausch Infrastructure LLC in the amount of $59,656.99 reflecting final contract quantities and a reconciliation of an incorrect quantity previously submitted in Change Order #4. (DISTRICT #1) Village of Lombard Page 7 Village Board of Trustees Minutes May 17, 2018 This Resolution was adopted on the Consent Agenda Enactment No: R 34-18 R. 180228 Water Meter Replacement Program, Change Order No. 1 Reflecting an increase to the contract with Water Resources, Inc. in the amount of $56,518.75. (DISTRICTS - ALL) This Resolution was adopted on the Consent Agenda Enactment No: R 35-18 S. 180235 Central Reservoir Improvements, Amendment No. 1 Approving Amendment No. 1 to the contract with Christopher B. Burke Engineering LTD reflecting an increase of $61,017.86 for design engineering services. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 36-18 T. 180240 Cruise Nights Temporary Parking Restrictions Resolution providing for temporary parking restrictions along St. Charles Road between Main Street and Lincoln Avenue and along Park Avenue between Orchard Terrace and Michael McGuire Drive for Cruise Nights. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 37-18 U. 180241 Cruise Nights License Agreements Resolution authorizing License Agreements for use of parking lots at 118, 126 and 211 W. St. Charles Road during Cruise Nights beginning June 9 and running through August 25 (excluding July 7). (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 38-18 U-2. 180238 Northern Illinois Municipal Electric Cooperative (NIMEC) To Obtain Bids From Electricity Providers Authorizing NIMEC to serve as the broker for the Village in regard to obtaining bids from electricity providers and authorizing the Village Manager or Director of Finance to approve a contract with the lowest cost electricity provider. This Resolution was adopted on the Consent Agenda Enactment No: R 39-18 U-3. 180243 Downtown Improvement & Renovation Grant; 105 W. St. Charles Village of Lombard Page 8 Village Board of Trustees Minutes May 17, 2018 Road, Unit 101, Charred (Exterior Improvements) The ECDC recommends approval of a grant application for the Downtown Improvement and Renovation Grant Program (Façade Grant Program) for Charred located at 105 W. St. Charles Road. The applicant/business is seeking to install exterior improvements, including accessibility improvements. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 40-18 Other Matters V. 180217 Manhole Rehabilitation Program 2018 Award of a contract to RMS Utility Services, the lowest responsible bidder of five (5) bids, in the amount of $61, 309.00 (the base bid and additives 1 and 3). Bid in compliance with Public Act 85-1295. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda W. 180232 Surveillance and Access Control System Request for a waiver of bids and award of a contract to Imperial Surveillance in an amount not to exceed $301,125.12. Public Act 85-1295 does not apply. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda X. 180233 Underground Utilities Office Project Request for a waiver of bids and award of a contract to Season Comfort in an amount not to exceed $28,500.00. This Request was approved on the Consent Agenda AA-1. 180251 Preliminary Review and Approval for Placement of a Monument on Village Property (American Legion Post 391) Request of the American Legion Post 391 to allow for placement of a granite monument to be placed at the Lombard Municipal Complex subject to development of a monument policy. (DISTRICTS - ALL) This Request was approved on the Consent Agenda BB. 180248 Appointments and Re-appointment - Plan Commission, Zoning Board of Appeals and Fire Pension Board of Trustees Request for concurrence in the appointment of Leigh Giuliano to the Plan Commission with a term to May 2020; appointment of Michelle Johnson to the Zoning Board of Appeals with a term to May 2021 and the re-appointment of Ed Seagraves to the Fire Pension Board of Trustees with a term to April 2021. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) A. 180175 ZBA 18-01 - 342 S. Stewart Street Request that the Village grant a variation from Section 155.210 (A)(3)(b) of the Lombard Zoning Ordinance to increase the permitted height of an accessory structure (garage) from seventeen feet (17’) to nineteen feet, Village of Lombard Page 10 Village Board of Trustees Minutes May 17, 2018 seven inches (19’7”) in the R2 Single-Family Residence District. (DISTRICT #5) A motion was made by Trustee Bill Ware, seconded by Trustee Robyn Pike, that the Ordinance relative to ZBA 18-01, request for a variation from the Village Code for the property located at 342 S. Stewart, be waived of first reading and passed on second reading with suspension of the rules. The motion carried by the following vote: Aye: 5- Dan Whittington, Mike Fugiel, Reid Foltyniewicz, Robyn Pike, and Bill Ware Absent: 1- Bill Johnston Enactment No: Ordinance 7527 B. 180176 ZBA 18-02 - 303 Collen Drive Request that the Village take the following actions: 1. Grant approval of a variation from Section 155.205(A)(1)(c)(ii) of the Lombard Zoning Ordinance to allow for a six foot (6’) high solid fence in a corner side yard; and 2. Grant approval of a variation from Section 155.205(A)(1)(c)(iii) of the Lombard Zoning Ordinance to allow for a six foot (6’) high solid fence in a rear yard that abuts the front yard of an adjacent lot. (DISTRICT #3) Trustee Foltyniewicz indicated the resident currently has a six-foot fence and is looking to replace the fence. He noted that Code does not allow for a six-foot solid fence in the corner side yard and the resident is requesting a variance to allow for replacement of the same size fence. He stated the Board has to look at each situation that requires a variance. No neighbors are against the fence and three neighbors supported the request. A motion was made by Trustee Reid Foltyniewicz, seconded by Trustee Mike Fugiel, that the Ordinance relative to a fence variation request for 303 Collen Drive (ZBA 18-02) be waived of first reading and passed on second reading with suspension of the rules.
