Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, May 16, 2019 in the Board Room of the Lombard Village Hall was called to order at 7:00 p.m. by Village President Keith Giagnorio. The Lombard Police Honor Guard posted the Colors and led the Pledge of Allegiance. II. Public Participation 190203 Recognition - Glenn Westlake Band Nick Martin, Glenn Westlake Band Director, spoke about the Glenn Westlake Middle School band being chosen to perform at a ceremony in Springfield. He spoke of the tradition of music excellence at the school. 190204 Proclamation - Lilac Queen and Her Court This proclamation was presented to the Queen and Her Court at the Lilac Ball. 190212 Proclamation - National Police Week Village Clerk Sharon Kuderna read the proclamation for National Police Village of Lombard Page 1 Village Board of Trustees Minutes May 16, 2019 Week. Chief of Police Roy Newton thanked the Village Board and Village Manager for their support. He spoke of a total of 43 officers across the country who had been killed in the line of duty over the last year. In Illinois we have lost four Chicago Police Officers, three State Troopers and one Kane County Sheriff's Deputy. 190213 Proclamation - Emergency Medical Services Week Village Clerk Sharon Kuderna read the proclamation for EMS Week. Deputy Fire Chief Ray Kickert thanked the Village Board for their support. 190214 Proclamation - National Public Works Week V. Approval of Minutes A motion was made by Trustee Dan Whittington, seconded by Trustee Bill Ware, that the minutes of the regular meeting of May 2, 2019 be approved. Village Manager/Village Board/Village Clerk Comments Village Clerk Sharon Kuderna read the following announcements: We are celebrating Lilac Time in Lombard from May 1 - 19! There is still time to enjoy activities in Lombard. To learn more about all of these great events and more happening in the Lilac Village over the next few days, visit the Lilac Time website at LombardLilacTime.com The Lilac Parade steps off from Main and Wilson this Sunday, May 19th at 1:30 pm and will be heading north on Main Street and then east on Maple. Village staff is currently monitoring the forecast for Sunday. If severe weather creates impacts on the parade or the parade schedule, this information will be posted on the websites and social media of the Parade Committee and Village of Lombard. Friday, May 17 from 5:00 am until noon the Lombard Police Department will participate in Cop-on-Top, a fundraiser and means of bringing awareness to the athletes who participate in Special Olympics. Stop at any of the three Dunkin Donut stores (Main Street, North Avenue, and Yorktown) and show support for our Police Officers and our Special Olympics athletes. The Village’s Memorial Day Ceremony is scheduled for Monday, May 27th at 10 AM at the Lombard Common Park Sunken Garden. Please note the new start time for the ceremony at 10 a.m. Join us as we remember those who serve our country and keep our country safe. More information can be found at villageoflombard.org/memorial day Village Offices will be closed on Monday, May 27th in recognition of Memorial Day. As per direction taken by the Village Board at the regular meeting of November 28th, the first regular Village Board meetings in June, July and August have been cancelled. A special commemorative Village Board meeting in recognition of the Village’s 150th birthday will be scheduled on August 1st (time to be determined) and held at the Maple Street Chapel. This will be followed by an ice cream social at the gazebo Village of Lombard Page 3 Village Board of Trustees Minutes May 16, 2019 located on the Historical Museum property, 23 W. Maple. The next Village Board meeting will be June 20th. VIII Consent Agenda . Village Manager Scott Niehaus indicated he had two Trustees inquire about two items on the Consent Agenda and he wanted to provide the following clarification: Consent item D (PC 17-01: Oakview Estates Phase II): Village Manager Niehaus noted that this matter was approved in 2017, and the ordinance requires that work commence within twelve months or the developer needs to request a time extension. In this case, work has not begun and one of the owners is in the process of buying out the other owner's portion, so an extension of time is requested to allow for that process to be completed before moving forward with the development. Trustee Foltyniewicz asked if permits had been issued. Village Manager Niehaus indicated that permits had not been issued. If permits had been issued, the developer would need to pay an additional fee, but with no permits issued, this is merely a time extension request. Consent item L-2 (Written Design Standards for Small Wireless Facilities): Village Manager Niehaus noted this Resolution approves standards by which wireless antennas can be affixed to certain Village property such as traffic signals, street lights, etc. The Village cannot deny the request for these antennas, but can regulate standards. He also wanted to clarify that these are not red light cameras. Payroll/Accounts Payable A. 190191 Approval of Village Payroll For the period ending April 27, 2019 in the amount of $948,181.44 This Payroll/Accounts Payable was approved on the Consent Agenda B. 190192 Approval of Accounts Payable For the period ending May 3, 2019 in the amount of $1,249,307.35. This Payroll/Accounts Payable was approved on the Consent Agenda C. 190211 Approval of Accounts Payable For the period ending May 10, 2019 in teh amount of $1,471,990.26. St. Charles Road - Fourth Time Extension Request Requesting approval of an Ordinance extending the time period to start construction of the proposed project for an additional twelve month period until June 17, 2020. (DISTRICT #4) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7653, 7609, 7529, 7484, 7342 E. 190143 Village Equipment To Be Declared Surplus Ordinance approving the Village departments' request to sell and/or dispose of surplus equipment as more specifically detailed in Exhibit "A" attached to the Ordinance, to be sold at auction, sold for scrap, or recycled as these items have extended beyond their useful life or are obsolete to include two (2) four drawer file cabinets, seven (7) bicycles, one (1) Eaton UPS (Uninterruptable Power System; battery back-up) one (1) Nikon 35 mm camera, with case and two telephoto lenses, two (2) electronic scales and one (1) Panasonic cassette tape dictation kit in case. Roosevelt Road - Noon Whistle Brewing Special Event An ordinance amending Title XI, Chapter 112, Section 112.18(B) of the Lombard Village Code with regard to alcoholic beverages, providing for the sale and consumption of beer in connection with a temporary event (Summerfest) on June 15, 2019 located at 800 E. Roosevelt Road. (DISTRICT #6) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7655 G. 190194 Ordinance Amending Title XI, Chapter 112, Section 112.18(B) of the Lombard Village Code (Alcoholic Beverages) An Ordinance amending Title XI, Chapter 112, Section 112.18(B) of the Lombard Village Code relative to the sale and consumption of alcoholic beverages associated with the Craft Beer Event (Ale Fest) scheduled for June 8, 2019 to be held on Parkside Avenue. Butterfield Road, on June 1, 2019. (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7657 I. 190196 Ordinance Amending Title I, Chapter 13 of the Lombard Village Code - Licenses and Permits An Ordinance amending Title I, Chapter 13, of the Lombard Village Code to add a new Section 13.08, which describes the various formats in which a license or permit application may be submitted to the Village. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 7658 I-2. 190217 Ordinance Amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code (Alcoholic Beverages) An ordinance amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code in regard to the Class "A/B-III" liquor license category, due to a more than fifty percent (50%) change in the ownership of Claim Jumper Restaurant, so that a new Class "A/B-III" liquor license can be issued to Claim Jumper Acquisition Company LLC d/b/a Claim Jumper Restaurant located at 92 Yorktown Center. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 30-19 K. 190201 2019 Cruise Nights Temporary Parking Restrictions Temporarily limiting parking along St. Charles Road between Main Street and Lincoln Avenue and along Park Avenue between Orchard Terrace and Michael McGuire Drive for Cruise Nights between June 8 and August 24, 2019. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 31-19 L. 190210 Resolution Authorizing a Master License Agreement with New Cingular Wireless (AT&T) for Small Wireless Facilities Located Within the Municipal Rights-of-Way Resolution authorizing a Master License Agreement with new Cingular Wireless which regulates the attachment of wireless communication equipment within Village-owned rights-of-way. This Resolution was adopted on the Consent Agenda Enactment No: R 32-19 L-1. 190216 Northern Illinois Municipal Electric Cooperative (NIMEC) Resolution authorizing the Northern Illinois Municipal Electric Cooperative (NIMEC) to serve as the broker for the Village in regard to obtaining bids from electrical providers and authorizing the Village Manager or Director of Finance to approve a contract with the lowest cost electricity provider. This Resolution was adopted on the Consent Agenda Enactment No: R 33-19 L-2. 190218 Resolution Adopting Written Design Standards for Small Wireless Facilities Within the Village of Lombard A Resolution approving the design standards to regulate the design, aesthetic and concealment of small wireless facilities within the Village of Lombard. This Resolution was adopted on the Consent Agenda Enactment No: R 34-19 Other Matters M. 190169 FY2019 Sewer Lateral Lining Project Award of a contract to Performance Pipelining, the lowest responsible Village of Lombard Page 7 Village Board of Trustees Minutes May 16, 2019 bid of two (2) bidders, in the amount of $48,550.00. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda N. 190198 FY2019 Asphalt Paving and Patching Program Request for a waiver of bids and award of a contract to Schroeder Asphalt Services, Inc. in the amount of $1,415,003.61. Although this item was bid by the Village of Lombard as lead agency, it is considered a waiver of bids due to advertising in the Daily Herald as per Municipal Partnering Initiative guidelines, as opposed to the Lombardian as per the Village of Lombard Purchasing Policy. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda O. 190199 Manhole Rehabilitation Program 2019 Award of a contract to KIM Construction Company, Inc., the lowest responsible bid of three (3) bidders, in the amount of $56,015.00. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda P. 190206 Window Replacement at Village Hall and Fire Station 45 Request for a waiver of bids and award of a contract to Slaten Construction in an amount not to exceed $543,200.00. This item was competitively bid through U.S. Communities Government Purchasing Alliance. (DISTRICTS #4 & #6) This Bid was approved on the Consent Agenda Q. 190207 2019-2020 Bulk Salt Purchase for Road Salt Request for a waiver of bids and award of a contract to Compass Materials in the amount of $290,360.00. This item was competitively bid through DuPage County Department of Transportation. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda R. 190209 Agreement to Waive PSEBA Benefits in Exchange for the Village's Withdrawal of its Intervention in a Police Pension Board Disability Pension Hearing Request approval of an Agreement between the Village of Lombard and Frank Vivo relative to the waiver of Public Safety Employee Benefits Act (PSEBA) benefits by Frank Vivo, Vanessa Renello and Bianca Rinchiuso, in exchange for the Village of Lombard's withdrawal from Frank Vivo's Police Pension Board disability pension hearing.
