V. Approval of Minutes A motion was made by Trustee Dan Militello, seconded by Trustee Dan Whittington, that the minutes of the Special Meeting of August 20, 2020 be approved. Village Manager/Village Board/Village Clerk Comments Trustee Reid Foltyniewicz commented that he misses seeing Executive Coordinator Carol Bauer at the Village Board meetings. Village Clerk Sharon Kuderna read the following announcements: Mark your calendars for the We Remember Blood Drive scheduled on Wednesday, September 9th from 8:00 am until 1:00 pm at the lower level of Yorktown outside of Von Maur and at the First Church of Lombard Fellowship Hall, 220 S. Main Street, from 1:30 pm until 7:00 pm. Please remember it takes only an hour to be a hero and save a life- donating blood is safe, simple and does save lives. Be a hero - donate blood. New to the Blood Drive Program - all blood donations will be tested for COVID-19 antibodies. The Village is seeking nominations for the 15th Annual Senior of the Year Awards which recognizes outstanding residents who go above and beyond to positively benefit the community. Each year the Community Relations Committee selects a senior man and senior woman from the nominees to receive the awards. Nominees must have an incorporated Lombard home mailing address and be 65 years of age or older. Nominations must include a brief statement of 50 words or less on why the nominee should be considered for the award, as well as a short biography of the nominee. All nominations must be received by 4:30 pm on Friday, September 11th. The Lombard Police Department is joining law enforcement agencies throughout the state for the “Drive Sober or Get Pulled Over” Labor Day enforcement campaign. Extra enforcements will be on the road August 20th - September 8th, cracking down on impaired drivers. During this period, motorists in Lombard can expect to see stepped-up impaired driving patrols and seat-belt enforcement, particularly at night when seat-belt usage rates are at their lowest. Speeders and distracted drivers should also be aware. If you’re celebrating this Labor Day, remember to designate a sober driver and do not let friends or family members drive under the influence of alcohol or cannabis. In an effort to help keep our first responders safe during the COVID-19 pandemic, the Lombard Fire Department will not be hosting a public 2020 September 11th event. The Village honors those who lost their lives on 9/11 and appreciates your understanding. Residents wishing to pay tribute may participate in a moment of silence from their homes on 9/11, at 8:46 a.m., the time the first plane, American Airlines Flight 11, struck the North Tower of the World Trade Center on September 11, 2001. B. 200263 Approval of Accounts Payable For the period ending August 21, 2020 in the amount of $1,740,537.39. This Payroll/Accounts Payable was approved on the Consent Agenda C. 200270 Approval of Accounts Payable For the period ending August 28, 2020 in the amount of $723,549.32. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. 200253 PC 20-19: Text Amendment, Temporary Use of Daycare and Schools The Plan Commission transmits its recommendation to approve a text amendment to the Lombard Zoning Ordinance to establish a new Section 155.226 within the Lombard Village Code, and amend other relevant sections if necessary for clarity. The proposed amendment will establish temporary permitted land uses for day care centers and public and parochial elementary, middle and high schools within the Zoning Ordinance during periods that a Gubernatorial Disaster Proclamation is in effect, relative to a viral pandemic. (DISTRICTS - ALL) This Resolution was adopted on the Consent Agenda Enactment No: R 27-20 Other Matters K. 200258 Motion to Accept and File with the Village Clerk the 2019 Comprehensive Annual Financial Report (CAFR), Management Letter, Current Recommendation and Audit Finding with Corrective Action Plan The Finance and Administration Committee voted unanimously to recommend that the Village Board accept and place on file with the Village Clerk the FYE 2019 Comprehensive Annual Financial Report and Management Letter. This Request was approved on the Consent Agenda L. 200264 Special Event Permit - Lombard Veterinary Hospital Temporary Location Lombard Veterinary Hospital (LVH) is seeking a Special Event Permit to allow the business to move into a temporary location at 241 W. St. Charles Road, for a period of up to 90 days. LVH is in the process of securing the commercial tenant space at 241 W. St. Charles Road for a temporary clinic location due to tornado damage at their current location. (DISTRICT #1) This Request was approved on the Consent Agenda M. 200267 Institute Day for Village Administrative Offices Request Village Board concurrence in the closing of the Village Hall, Public Works and Fire Administrative Offices on September 18, 2020 to allow for employee training and presentations and an opportunity for workstation and file clean-up. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) A. 200271 An Ordinance Authorizing a First Amendment to the Redevelopment Agreement for the Hotel and Conference Center, Comprising a Part of the Butterfield-Yorktown TIF District of the Village of Lombard, Illinois (Staff is requesting a waiver of first reading) The Ordinance approves a First Amendment to the TIF Redevelopment Agreement, between the Village and the Lombard Public Facilities Corporation (LPFC), which provides for an up-front reimbursement of the LPFC, relative to the TIF eligible redevelopment project costs incurred by the LPFC, in the amount of $2,700,264.88, plus the ability of the LPFC to obtain further reimbursement for TIF eligible redevelopment project costs incurred by the LPFC in the event the TIF District generates more than $8,000,000.00 in TIF incremental revenues prior to September 30, 2025, in lieu of the issuance of a TIF Note, in the amount of $3,700,000.00, plus interest at 5.5%, and the issuance of a Debt Certificate in relation thereto, relative to the TIF eligible redevelopment project costs incurred by the LPFC. Village Manager Scott Niehaus gave a brief of the Redevelopment Agreement for the hotel and conference center; Village to pay off a lump sum amount now to avoid additional costs/interest and it allows the hotel/conference center to do additional renovation now instead of later; 250 of the 500 rooms have been updated; these funds do not come out of the General Fund, but come from the TIF Fund. Trustee Andrew Honig inquired about the goal of the $8,000,000. Village Manager Scott Niehaus will probably never get to that amount. A motion was made by Trustee Bill Ware, seconded by Trustee Andrew Honig, that the Ordinance authorizing a First amendment to the Redevelopment Agreement for the Hotel and Conference Center, comprising a part of the Butterfield-Yorktown TIF District of the Village of Lombard, Illinois be waived of first reading and passed on second reading with suspension of the rules. A motion was made by Trustee Andrew Honig, seconded by Trustee Dan Whittington, that the Ordinance relative to the commuter parking lot and fee changes be passed on second reading. NOTICE OF MEETING MODIFICATION DUE TO COVID-19 In light of the Disaster Declaration issued by the Governor of the State of Illinois relative to the COVID-19 pandemic, the Village President has determined that an in-person meeting of the Village Board, or a meeting conducted under the Open Meetings Act requirements, relative to a quorum of the members of the Village Board having to be physically present at a meeting when some members of the Village Board are participating remotely, is not practical or prudent because of the disaster. Pursuant to Governor Pritzker's Executive Order No. 2020-07, as extended and modified by Executive Orders 2020-18, 2020-33, 2020-039, 2020-44 and 2020-52 which suspend the requirement of the Illinois Open Meetings Act requiring in-person attendance by members of a public body during the duration of the Gubernatorial Disaster Proclamation, members of the Village Board may be participating in the meeting through a virtual meeting platform. Physical attendance at this public meeting will be capped to a maximum capacity of 50 persons in total, inclusive of Village officials, staff and consultants (whose physical attendance will be given precedence), with strict social distancing requirements in place. While the public is welcome to attend the meeting, and provide comments, in person, given capacity limitations and the COVID-19 pandemic, residents are invited to view and participate remotely through the means offered below.
