Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, February 15, 2024 in the Board Room of the Lombard Village Hall was called to order at 6:00 p.m. by Village President Keith Giagnorio. The committee also received a staff update on each of the open projects that received an economic incentive or grant approval. Staff provided a presentation regarding implementation updates to the Strategic Plan and Community Development’s 2024 economic development activities to be undertaken. Payroll/Accounts Payable A. 240060 Approval of Village Payroll For the period ending January 27, 2024 in the amount of $1,145,495.80. This Payroll/Accounts Payable was approved on the Consent Agenda B. 240061 Approval of Accounts Payable For the period ending February 2, 2024 in the amount of $627,156.95. This Payroll/Accounts Payable was approved on the Consent Agenda C. 240071 Approval of Accounts Payable For the period ending February 9, 2024 in the amount of $1,465,304.69. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. An Ordinance Approving a License Agreement Between the Village of Lombard and the Lombard tower Condominium Association Relative to the Hammerschmidt Parking Lot (This item has been moved to Separate Action R-2) E. 240066 Adoption of Village of Lombard Zoning Map - 2024 An ordinance approving a Village of Lombard Zoning Map pursuant to State Statutes. This map does not change the zoning of any properties within the Village's Corporate limits, and is only a graphic depiction of past Zoning actions by the Village Board. (DISTRICTS - ALL) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8237 Other Ordinances on First Reading F. 240030 ZBA 24-01: 224 W. Crystal Avenue The Zoning Board of Appeals submits its recommendation to approve the following variations on the subject property located within the R2 Single-Family Residence District: 1. A variation from Section 155.407(F)(1) to allow a front yard setback of twenty-nine (29) feet, where a front yard of thirty (30) feet is required; 2. (DISTRICT #1) This Ordinance was passed on first reading on the Consent Agenda Ordinances on Second Reading G. 230424 PC 23-26: 60 Yorktown, Tesla Supercharger Station in Target Parking Lot The Plan Commission submits its recommendation to approve a conditional use pursuant to Section 155.415(C)(8) of the Lombard Village Code to allow for gasoline/fuel sales on the subject property located within the B3PD Community Shopping District Planned Development (Yorktown Shopping Center Planned Development). (DISTRICT #3) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 8238 H. 240026 PC 24-01: Text amendment - Storage Centers in the Office District The Plan Commission submits its recommendation to approve a text amendment to Section 155.412(C) of the Lombard Village Code to allow for “storage center” to be listed as a defined conditional use in the O Office District. (DISTRICTS - ALL) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 8239 Resolutions I. 210352 22nd Street Shared-Use Path Improvements, Amendment to Resolution for Expenditure Authorization Approving a Resolution to allocate funds for the Village's matching portion of the contracted work in the amount of $283,800.00. This project is a Federally funded Capital Improvement Program that includes installation of a shared-use path along 22nd Street. An amendment to the Illinois Department of Transportation required Resolution to allocate funds. Incorporating a construction cost increase and increased Federal funding. (DISTRICT #3) This Resolution was adopted on the Consent Agenda Enactment No: R10-24 J. 240070 Motor Fuel Tax Roadway Improvement Resolution for Fiscal Year 2022 Village of Lombard Page 4 Village Board of Trustees Minutes February 15, 2024 Approving a Resolution to appropriate the use of one million dollars and no cents ($1,000,000.00) of Motor Fuel Tax Funds from the Village's MFT account. This Resolution upon approval by the President and Board of Trustees authorizes the use of MFT funds for the 2022 Asphalt Patching & Paving Contract. This will assist the Illinois Department of Transportation (IDOT) with the closure of their ongoing audit for 2022. (DISTRICTS - ALL) This Resolution was adopted on the Consent Agenda Enactment No: R 11-24 K. 240075 Resolution Amending Procedures for Electronic Attendance at Village Board Meetings Resolution amending Electronic Attendance at Village Board meetings previously adopted pursuant to Resolution 53-12 reducing the notice requirement from one (1) week to six (6) hours and adding a provision permitting remote participation when elected officials cannot attend due to unexpected childcare obligations. This Resolution was adopted on the Consent Agenda Enactment No: R 12-24 Other Matters L. 240040 Acoustic Sanitary Sewer Pipe Inspection and Assessment Request for a waiver of bids and award of a contract to InfoSense, Inc. of Charlotte, North Carolina, in an amount not to exceed $85,498.24. The project is divided into three areas and will be in three phases over budget years 2023, 2024 and 2025. The data that is collected in this program has guided other sewer maintenance activities such as focused sewer cleaning and televising along with spot repairs and sewer lining. This data has made sanitary sewer maintenance activities more efficient and cost effective. This is year two of three possible extensions. (DISTRICTS #2, #3, #5 & #6) This Bid was approved on the Consent Agenda M. 240042 Civic Center Reservoir Perpetual Warranty & Maintenance Agreement Request for a waiver of bids and award of a contract to Utility Service Company in an amount not to exceed $60,208.00. This is the fourth (4th) of twenty (20) possible one-year extensions of contract. (DISTRICT #6) This Bid was approved on the Consent Agenda N. 240043 North Avenue Standpipe Rehabilitation Project Request for a waiver of bids and award of a contract to Utility Service Village of Lombard Page 5 Village Board of Trustees Minutes February 15, 2024 Company, Inc. in an amount not to exceed $265,003.00. This is the fourth (4) year of eighteen (18) possible one-year extensions of contract. (DISTRICT #1) This Bid was approved on the Consent Agenda O. 240044 Highland Elevated Tank Perpetual Warranty & Maintenance Agreement Request for a waiver of bids and award of a contract to Utility Service Company, Inc. in an amount not to exceed $37,504.00. This is the fifth (5th) of fifteen (15) possible one-year extensions of contract. (DISTRICT #3) This Bid was approved on the Consent Agenda P. 240056 Waiver of Bids - Purchase of Dell Computers and Monitors Request for a waiver of bids and award of a contract to Dell Technologies in the amount of $41,916.10 for the purchase of fifteen (15) desktop computers, fifteen (15) laptops and fifty (50) monitors. This Bid was approved on the Consent Agenda Q. 240068 FY2024 Sewer Lining Program Request for a waiver of bids and award of a contract to Performance Pipe Lining, the lowest responsible proposal of five (5) proposals received, in the amount of $87,676.00. The sewer lateral lining process is used when a sewer lateral needs repair due to extensive root growth, cracks or other defects that can be remedied without replacing the pipe, thus reducing restoration costs and inconvenience to residents. (DISTRICTS #1, #2 & #6) This Bid was approved on the Consent Agenda R. 240072 Sidewalk and Curb Improvement Program FY2024 Request for a waiver of bids and award of a contract to Globe Construction, Inc. in the amount of $343,637.79. Globe Construction has provided an additional increase of 12% pricing for the 2024 Program, despite this proposed increase, they will still be lower than the next lowest 2023 bid. Staff has been happy with Globe Construction's good performance. The purpose of the Sidewalk and Curb Improvement Program is to address deteriorated and damaged sections of sidewalk, curb and parkway damaged by utility digs. Main. He spoke of the owners receiving hate messages and how Lombard is a diverse community and welcomes everyone. IX. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) R-2. 230198 An Ordinance Approving a License Agreement between the Village of Lombard and the Lombard Tower Condominium Association, relative to the Hammerschmidt Commuter Parking Lot Approving an Ordinance for a License Agreement between the Village of Lombard and Lombard Tower Condominium Association. The License Agreement will allow the exclusive use of designated parking spaces in the Hammerschmidt Commuter Parking Lot for the residents in the Lombard Condominiums during the reconstruction of their parking structure. Staff is requesting a Waiver of First Reading. (DISTRICT #4) Village Manager Scott Niehaus indicated this item had been moved to Separate Action to allow time for staff to speak with officials at Metra regarding the proposed parking lot agreement. He noted staff will prepare a communication relative to the agreement to ensure that all commuters and patrons using the Metra lots are aware of the agreement. He stated that funds received from the lease of the parking spaces will be deposited into the Commuter Parking Fund. He also noted that the lot is typically about 55% full Tuesday through Thursday; Monday about 20% and Friday about 12% so the lease of spaces to the Condo Association should not impact commuter use of the lot. The lease will allow the residents of the condo building at 33 N. Main to park at the Metra lot for the twelve to fourteen weeks it will take the contractor to do a major renovation of the condo parking lot. Allowing the residents to park in the lot is a safer alternative then allowing them to park on neighboring streets which would cause a safety issue for fire and police vehicles. A motion was made by Trustee Anthony Puccio, seconded by Trustee Dan Militello, that the Ordinance Approving a License Agreement between the Village of Lombard and the Lombard Tower Condominium Association regarding the Hammerschmidt Commuter Parking Lot be waived of first reading and passed on second reading with suspension of the rules. (DISTRCT #6) A motion was made by Trustee Bob Bachner, seconded by Trustee Bernie Dudek, that the Ordinance regarding PC 24-03 for Hollywood Hounds, 613 S. Main Street, be passed on second reading.
