Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, May 16, 2024 in the Board Room of the Lombard Village Hall was called to order at 6:00 pm by Village President Keith Giagnorio. Director of Public Works Carl Goldsmith led the Pledge of Allegiance. II. He also thanked Carl Goldsmith and the Public Works Department for hosting the Citizen Public Works Academy. V. Approval of Minutes It was moved by Trustee Bob Bachner and Seconded by Trustee Dan Militello that the minutes of the regular meeting of May 2, 2024 be approved. The members reviewed three change orders. The first one was the Park Avenue pedestrian project change order. The other two were for sanitary sewer lining and sanitary storm sewer cleaning. All three change orders were approved by the committee, and are on the agenda before you this evening. The last item was a memo presented to the committee proposing a responsible bidder ordinance. We did have one speaker for public participation, supporting the idea of the proposed ordinance. After reading the material presented by the staff and discussion by the committee it was deemed that the Village already has in place standards that meet or exceed the proposed, responsible bidder ordinance. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. 230075 PC 23-02: 230 Yorktown Center: Reapproving a Preliminary Plat of Resubdivision Originally Approved by Ordinance 8158 The Board of Trustees adopted Ordinance 8157 (PC 23-02) on May 18, 2023, which granted approval of Preliminary Plat of Resubdivision for the property at 230 Yorktown Center and a Portion of 175 Yorktown Center (formerly known as the Carson’s anchor store building) and now known as the Yorktown Reserve project . Per Village Code and State Statues, Final Plats of Subdivision must be approved within one year of the Preliminary Plat approval date. This action would reapprove the Preliminary Plat of Subdivision. (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8259 E. 240104 An Ordinance Amending Article XIII of the Lombard Traffic Code to Add Parking Prohibitions on Central Avenue A Recommendation from the Public Safety & Transportation Committee to amend the Ordinance amending Article XIII of the Lombard Traffic Code to prohibit on the north side of Central Avenue from Stewart Avenue to Grace Street. (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8264 J. 240171 Purchase of One (1) Bomag BW 138 AD-5 Vibratory Roller and an Ordinance Declaring 2012 Bomag BW 135 AD Asphalt Vibratory Roller as Surplus, and Authorizing the Sale Thereof Request for a waiver of bids and award of a contract to McCann Industries of Addison, Illinois, in the amount of $69,464.00 for the purchase of a Bomag BW 138 AD-5 Vibratory Roller. The Roller is available for purchase through Sourcewell Contract (#060122-BAI). Approval of an Ordinance declaring Unit ST371, a 2012 Bomag BW 135 AD Asphalt Vibratory Roller, as surplus and authorizing the sale and/or disposal. Staff requests a waiver of first reading. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8265 K-2. 240177 Amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code (Alcoholic Beverages) Ordinance amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code decreasing the number of entries in the Class “XX-VG liquor license category by one due to the licensee 3DH Hospitality, LLC d/b/a Humo Smokehouse, located at 1000 N. Rohlwing Road, Suite 13, cessation of business and surrendering its Class “XX-VG” license. (DISTRICT #1) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8267 K. 240176 An Ordinance Amending Title 11, Chapter 112, Section 112.18(B) - Alcoholic Beverages Ordinance amending Title 11, Chapter 112, Section 112.18(B) of the Village Code, providing for the sale and consumption of alcohol in connection with temporary events within the Park Avenue public right-of-way from St. Charles Road to Michael McGuire Drive on June 15, 22, and 29, 2024, July 13, 20, and 27, 2024 and August 3, 10, and 17, 2024 relative to Cruise Nights and the Summer Concerts Weekly Series. (DISTRICT #1) Village of Lombard Page 5 Village Board of Trustees Minutes May 16, 2024 This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8266 Other Ordinances on First Reading Ordinances on Second Reading Resolutions L. 240127 South Park Avenue Pedestrianization Project Change Order No. 2 Reflecting an increase of $56,192.70 to the contract with R.W. Dunteman Company. This increase reflects additional work improving the sanitary sewer system and the increase of material associated with the concrete roadway, temporary traffic signal and temporary lighting. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 26-24 M. 240128 Cruise Nights Parking Agreements Resolution approving a license agreement between the Village and the owners of the parking lots at 118 and 211 W. St. Charles Road for use of the parking lots by the Village for parking of certain vehicles designated by the Village for the 2024 Cruise Nights events and the 2024 Summer Concert Series. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 27-24 N. 240145 Sanitary Sewer Lining Program Change Order No. 1 Reflecting an increase of $17,872.00 to the contract with Performance Pipeline, Inc. The revised contract amount reflects additional work for the Cured-In-Place lining of a sanitary sewer located on South Lewis Avenue just south of South Broadway Avenue. (DISTRICT #5) This Resolution was adopted on the Consent Agenda Enactment No: R 28-24 O. 240146 Sanitary and Storm Sewer Closed Circuit Television (CCTV) Inspection and Cleaning Program Change Order No. 1 Reflecting an increase of $31,370.46 to the contract with Sewertech LLC. The revised contract amount reflects additional traffic control, cleaning and televising of the storm sewer on North Grace Street and additional sanitary sewer on South Lewis Avenue between South Broadway Avenue Village of Lombard Page 6 Village Board of Trustees Minutes May 16, 2024 and East Washington Boulevard. (DISTRICTS #4 & #5) This Resolution was adopted on the Consent Agenda Enactment No: R 29-24 P. 240166 St. Charles Road Resurfacing Project, Resolution for Expenditure Authorization Approving a Resolution to appropriate the use of one million, three hundred fifty seven thousand, five hundred dollars ($1,357,500.00) or as much is required by the Illinois Department of Transportation (IDOT). This Resolution is part of a Federal Funding IDOT project agreement. Within this Resolution, the Director of Public Works is given authorization to sign the federal funding agreement documents. (DISTRICTS #1 & #4) This Resolution was adopted on the Consent Agenda Enactment No: R 30-24 Q. 240174 2024 Cruise Nights Temporary Parking Restrictions Resolution providing for temporary parking restrictions along St. Charles Road between Main Street and N. Lincoln Avenue and along Park Avenue between Orchard Terrace and Michael McGuire Drive for Cruise Nights and the Summer Concert Series. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 31-24 Other Matters R. 240119 Village Hall Board Room Seating Request for a waiver of bids and award of a contract to KI Furniture in the amount of $52,603.00 for the purchase of seating in the Village Hall Board Room. The Sourcewell Purchasing Alliance is a program that affords member communities an opportunity to participate in a program whereby a service or commodity is publicly bid by a Lead Agency and the results of that competitive solicitation is available to all 90,000 public agencies (Sourcewell #121919-KII). (DISTRICT #6) This Bid was approved on the Consent Agenda S. 240120 Victorian Cottage Exterior Rehabilitation Request for a waiver of bids and award of a contract to LA Exteriors, in the amount of $98,682.00 for replacement and repair of the fence, front and rear porch, siding, soffit and fascia, window casings and windows. Staff has reached out to receive quotes from multiple contractors who will succeed in accommodating the rehabilitation in accordance to the original "style" of the Victorian Cottage. (DISTRICT #4) Village of Lombard Page 7 Village Board of Trustees Minutes May 16, 2024 This Bid was approved on the Consent Agenda T. 240164 Pavement Marking Replacement Program Request for a waiver of bids and award of a contract to Superior Road Striping, Inc. of Melrose Park, Illinois in the amount of $34,182.50. The purpose of the Pavement Marking Program is to replace deteriorated and damaged pavement markings. DuPage County opened bids for a county-wide project on March 12, 2024 and awarded the 2024 Pavement Marking Maintenance Program to Superior Road Striping, Inc. Superior included a joint purchase form with their bid package to extend their bid prices to other taxing bodies in DuPage County. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda U-2. 240162 Large Diameter Combined Sewer Rehabilitation Award of a contract to Vortex Lining Systems, LLC of Houston, Texas, the lowest responsible bidder of seven (7) bids received, in the amount of $14,698,922.04. (DISTRICTS #1 & #5) This Bid was approved on the Consent Agenda U-3. 240178 Asphalt Resurfacing Program Award of a contract to Brothers Asphalt Paving, Inc., the lowest responsible bidder of five (5) bids received, in the amount of $1,248,563.27. The purpose of this work includes asphalt pavement and full-depth saw cutting, concrete sidewalk and Americans with Disabilities Act detectable warning panels at intersections, concrete curb and gutter spot repairs, driveway apron replacement, hot mix asphalt removal for larger areas, hot mix asphalt surface using a paving machine to resurface local roads or for larger patches. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda U-4. 240053 Local Tourism Grant Application 2024 - Spooktacular Recommendation from the Community Promotion & Tourism Committee to approve a grant request from the Downtown Lombard Business Alliance in the amount of $10,000 inclusive of Village Services from Hotel/Motel funds to cover Waste Management costs, the cost of Village Services (Public Works, Police, Fire), and any activities that are not covered by sponsorships. The event will take place on October 20, 2024. (DISTRICT #1) This Request was approved on the Consent Agenda U. 240167 641 North Main Street Demolition Contract Award of a contract to Armor D2, the lowest responsible bidder of nine (9) bids received, in the amount of $69,250.00. This is the first of two contracts associated with the demolition and construction of a new storm Village of Lombard Page 8 Village Board of Trustees Minutes May 16, 2024 water detention facility located at 641 North Main Street. This contract is for the demolition of the building. (DISTRICT #4) This Bid was approved on the Consent Agenda V. 240170 Yorktown Temporary Event - Circus Vazquez Request for a Temporary Special Event permit for Circus Vazquez to operate in the Yorktown Center parking lot from June 28, 2024 to July 8, 2024. (DISTRICT #3) This Request was approved on the Consent Agenda W. 240175 Granicus Annual GovQA Portal Fees Request to approve the annual fee and funding to Granicus, in 2024 not to exceed $55,000.00; due to aggregated costs above threshold as a result of newly added 2023 three-year agreement to cover cost for the Freedom of Information Portal, GovQA provided by Granicus. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) A. 240169 800 E. Roosevelt Road - Noon Whistle Brewing Special Event - Summerfest Ordinance amending Title XI, Chapter 112, Section 112.18(B) of the Lombard Village Code with regard to alcoholic beverages, providing for the sale and consumption of beer in connection with a temporary event (Summerfest) on June 14 and June 15, 2024, located at 800 E. Roosevelt Road. (DISTRICT #6) Trustee Brian LaVaque noted that he will be abstaining from voting on this matter due to a relationship with the business owner. Village Manager Scott Niehaus noted that due to two Trustees being absent and one Trustee abstaining from voting on this matter, President Giagnorio would need to vote. A motion was made by Trustee Dan Militello, seconded by Trustee Andrew Honig, that the Ordinance regarding 800 E. (DISTRICT #4) T. 240164 Pavement Marking Replacement Program Request for a waiver of bids and award of a contract to Superior Road Striping, Inc. of Melrose Park, Illinois in the amount of $34,182.50. The purpose of the Pavement Marking Program is to replace deteriorated and damaged pavement markings. DuPage County opened bids for a county-wide project on March 12, 2024 and awarded the 2024 Pavement Marking Maintenance Program to Superior Road Striping, Inc.
