AUTHORIZE the Department of General Services to execute a new lease

Fiscal Impact Statement: The Municipal Facilities Committee reports that
there is no General Fund impact as the leasing expenses will be paid
directly by the LAHD using monies available within the Rent Stabilization
Trust Fund (Fund No. 440) and Systematic Code Enforcement Fee Fund
(Fund No. 41M), which are budgeted for this purpose.

to negotiating and executing a lease agreement with the California
Children’s Academy for a licensed childcare center located at 233 Breed
Street.
Recommendation for Council action:
AUTHORIZE the Department of General Services to execute a new Lease
Agreement between the City and California Children’s Academy for a
licensed childcare center located at 233 Breed Street. The term of the
lease agreement is for five years with no renewal option.
Fiscal Impact Statement: The Municipal Facilities Committee reports that
there is no General Fund impact as there is no revenue generated from
this lease. California Children’s Academy is responsible for all
improvements, maintenance and repairs to the subject facility.

MOTION 13A (RAMAN BLUMENFIELD MCOSKER), AMENDING

FIRST CONSIDERATION relative to adding Section 165.09 to Article 5,
Chapter XVI of the Los Angeles Municipal Code (LAMC) to require
payment of specified relocation assistance to certain tenants when the
tenant elects to relinquish their rental unit due to the inability to pay rent
increases as specified.
A. HOUSING AND HOMELESSNESS COMMITTEE REPORT and
ORDINANCE FIRST CONSIDERATION
SUBMITS WITHOUT RECOMMENDATION the following
recommendations of the City Attorney, SUBJECT TO THE APPROVAL
OF THE MAYOR:
1. FIND that the adoption of the Ordinance attached to the City Attorney
report (R230017) dated January 23, 2023, attached to Council file No.
210042S5, is exempt from the CEQA through Section 15061(b)(3) of the
State CEQA Guidelines and Article II, Section 1 of the City CEQA
Guidelines.
2. PRESENT and ADOPT the accompanying ORDINANCE, dated
January 23, 2023, adding Section 165.09 to Article 5, Chapter XVI of the
LAMC to require payment of specified relocation assistance to certain
tenants when the tenant elects to relinquish their rental unit due to the
inability to pay rent increases as specified.

Recommendation for Council action:
AMEND Section 165.09 A. of the draft ordinance to strike and replace the
following language:
"A landlord of residential real property subject to this article shall provide

increase that would trigger the displacement provisions should be based
on the contracted monthly rent for the unit, excluding any promotional rents
or rent discounts.
c. STRIKE Section 165.09 E. of the draft Ordinance.
d. INSTRUCT the Los Angeles Housing Department to report within 90
days on renter protection policies in other cities within Los Angeles
County, as well as to report on how the City's new renter protections may
impact housing production.

RESOLUTION relative to the Declaration of Local Emergency by the
Mayor, dated December 12, 2022, concerning homelessness in the City of
Los Angeles, pursuant to the provisions of the Los Angeles Administrative
Code (LAAC) Section 8.27.
Recommendation for Council action:
ADOPT the accompanying RESOLUTION to:
a. Resolve that a local emergency continues to persist within the City of
Los Angeles, within the meaning of LAAC Section 8.21, et seq., and
the continuance of the Mayor's December 12, 2022, Declaration of
Local Emergency through 30 days from the adoption of this
Resolution is therefore necessary; and, that the state of local
emergency, pursuant to its terms, shall terminate on June 12, 2023,
unless the City Council directs otherwise.
b. Direct, in accordance with the LAAC, Section 8.21 et seq., all
appropriate City departments, agencies and personnel shall
continue to perform all duties and responsibilities to represent the
City of Los Angeles in this matter for the purpose of preventing and
abating the emergency and for the receipt, processing and
coordination of all inquiries and requirements necessary to obtain
whatever County, State, and Federal assistance that may become
available to the City of Los Angeles and/or to the citizens of the City
of Los Angeles who may be affected by the emergency.
c. Instruct the General Manager, Emergency Management Department,
to advise the Mayor and City Council on the need for extension of
this Declaration of Local Emergency as may be required.
d. Instruct the City Clerk to forward copies of this Resolution to the
Governor of the State of California, the Director of the California
Office of Emergency Services, the Los Angeles County Office of
Emergency Management, and the Los Angeles County Board of
Supervisors.

measures to promote social distancing, the City Council has
reconsidered the circumstances of the state of emergency and finds

2. FIND in accordance with AB 361 Section 3(e)(3) that, while the state

Telephone communication is one of the most important forms of communication in society today. Due to advancements in
technology, telephone devices have evolved with new services and capabilities. Individuals who are deaf and hard of hearing,
and individuals with a speech disability are following these trends and are rapidly migrating to more advanced
telecommunications methods, both for peertopeer and thirdparty telecommunications relay service (TRS)
communications. Telecommunications Relay Service is a telephone service that allows persons with hearing or speech
disabilities to place and receive telephone calls. TRS is available in all 50 states, the District of Columbia, Puerto Rico and
the U.S. territories for local and/or long distance calls. TRS providers generally telephone companies are compensated
for the costs of providing TRS from either a state or a federal fund. There is no cost to the TRS user.
What forms of TRS are available? There are several forms of TRS, depending on the particular needs of the user and the

have been acted on by the Council. An item may also be called "special" if a member of the public has requested to speak

Item Comment period. Members of the public who wish to speak on items shall be allowed to speak for up to one minute

A. HOUSING AND HOMELESSNESS COMMITTEE REPORT and
ORDINANCE FIRST CONSIDERATION
SUBMITS WITHOUT RECOMMENDATION the following
recommendations of the City Attorney, SUBJECT TO THE APPROVAL
OF THE MAYOR:
1. FIND that the adoption of the Ordinance attached to the City Attorney
report (R230017) dated January 23, 2023, attached to Council file No.
210042S5, is exempt from the CEQA through Section 15061(b)(3) of the
State CEQA Guidelines and Article II, Section 1 of the City CEQA
Guidelines.
2. PRESENT and ADOPT the accompanying ORDINANCE, dated
January 23, 2023, adding Section 165.09 to Article 5, Chapter XVI of the
LAMC to require payment of specified relocation assistance to certain
tenants when the tenant elects to relinquish their rental unit due to the
inability to pay rent increases as specified.

Recommendation for Council action:
AMEND Section 165.09 A. of the draft ordinance to strike and replace the
following language:
"A landlord of residential real property subject to this article shall provide
the relocation assistance specified in this section to a tenant who elects to
relinquish their tenancydue to their inability to pay following a proposed
rental increase that exceeds the lesser of ( 1) the Consumer Price Index
All Urban Consumers, plus five percent, or (2) ten percent."

AMEND to ADD the following:
a. AMEND the draft Ordinance to include a severability clause.
b. AMEND Section 165.09 A. of the draft Ordinance to clarify that a rent

on the contracted monthly rent for the unit, excluding any promotional rents
or rent discounts.
