Recommendations for Council action, SUBJECT TO THE APPROVAL
OF THE MAYOR:
1. HOLD a Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA)
Hearing at the City Council meeting on Friday, October 20, 2023, at
10:00 a.m. in City Hall, 200 North Spring Street, Room 340, Los
Angeles, California 90012.
2. ADOPT the accompanying TEFRA RESOLUTION, attached to the
Council file, to allow the California Municipal Finance Authority to
issue bonds in an amount not to exceed $75,000,000 for the

b. The feasibility of allowing volunteers to work shifts that are
before or after hours and holidays to accommodate those who
work during shelter hours.

Officer, to report to the Council on the current protocol for protecting
shelter animals from extreme heat.
6. INSTRUCT the DAS to investigate and report to the Council on other
major cities' procedures related to animal care and adoption
preparation, volunteer recruitment and onboarding, spay/neutering
promotion, and protecting shelter animals from extreme heat.

1. DE TERMINE that the proposed amendments are exempt from
CEQA pursuant to Article 5, Section 15061(b)(3) [The activity is
covered by the common sense exemption that CEQA applies only to
projects which have the potential for causing a significant effect on
the environment, and where it can be seen with certainty that there is
no possibility that the activity in question may have a significant
effect on the environment, the activity is not subject to CEQA] of
CEQA Guidelines.
2. AUTHORIZE the Department of Recreation and Parks (RAP) to:

FINDINGS, PLANNING AND LAND USE MANAGEMENT (PLUM) COMMITTEE REPORT and
ORDINANCE FIRST CONSIDERATION relative to a Vesting Zone Change for the property located at
8426 Kester Avenue.
Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:
1. FIND, based on the independent judgement of the decision-maker, after consideration of the whole
administrative record, the Project was assessed in Mitigated Negative Declaration, No. ENV-2022-
5103-MND adopted on May 26, 2023; and pursuant to CEQA Guidelines 15162 and 15164, no
subsequent EIR, negative declaration, or addendum is required for approval of the Project.
2. ADOPT the FINDINGS of the North Valley Area Planning Commission (NVAPC) as the Findings of
Council.
3. PRESENT and ADOPT the accompanying ORDINANCE, dated July 20, 2023, to effectuate a Vesting
Zone Change from RA1 to (T)(Q)RD31; for the subdivision of one lot into nine smaller lots and a
Vesting Zone Change for nine of the new lots from RA1 to (T)(Q)RD31 to allow for the development
of nine single-family dwelling units including one Very Low Income unit, the existing lot is currently
improved with a single-family residence, a detached accessory garage, a detached recreation room,
and various associated structures, with a total existing floor area of approximately 1,236 square feet,
the project involves the demolition of all existing structures, for the property located at 8426 Kester
Avenue, subject to Conditions of Approval.
4. ADVISE the applicant, pursuant to Los Angeles Municipal Code Section 12.32 G:
....property shall not remain in a Q Qualified classification for more than six years unless during that
time: (1) there is substantial physical development of the property to allow for one or more of the uses
for which the Q Qualified classification was adopted; or (2) if no physical development is necessary,
then the property is used for one or more of the purposes for which the Q Qualified classification was
adopted... When these time limitations expire, the Q Qualified classification and the authority contained
therein shall become null and void, the rezoning proceedings shall be terminated, and the property
thereafter may only be utilized for those purposes permitted prior to the commencement of such
rezoning proceedings.
5. ADVISE the applicant that, pursuant to California State Public Resources Code Section 21081.6, the
City shall monitor or require evidence that mitigation conditions are implemented and maintained
throughout the life of the project and the City may require any necessary fees to cover the cost of such
monitoring.
6. ADVISE the applicant that, pursuant to State Fish and Game Code Section 711.4, a Fish and Game
Fee and/or Certificate of Fee Exemption is now required to be submitted to the County Clerk prior to
or concurrent with the Environmental Notice of Determination filing.

matter is now submitted to the Council for consideration.

Sustainable Communities (AHSC) Program Round 8 Draft Guidelines and seek amendments
consistent with the comments submitted by the Los Angeles Housing Department (LAHD).
2. AUTHORIZE the General Manager, LAHD, or designee, to submit comments, Attachment B of
the CLA report dated October 16, 2023, attached to the Council file, to the California Strategic
Growth Council (SGC) by the October 24, 2023 public comment deadline.
3. DIRECT the LAHD to monitor any new proposed changes to the AHSC Program Round 8 Draft
Guidelines and report, as necessary, on additional comments for Council approval.

SUMMARY:
On October 18, 2023, your Housing and Homelessness Committee considered a Motion (Raman –
Blumenfield) and CLA report dated October 16, 2023 relative to a Resolution and comments on the
proposed changes to the AHSC Program Round 8 Draft Guidelines, and report, if necessary, with any
City comments on these guidelines, prior to the public comment deadline. The report and Motion
attached to the Council file include some background on the matter.
After providing an opportunity for public comment, the Committee moved to approve the
recommendations reflected above. This matter is now forwarded to the Council for its consideration.
