Year 2024-25, $4.6 million in General Fund reimbursements are
anticipated for program administration ($0.50 million) and maintenance
($4.13 million) as identified in the report findings, section 3. RAP reports
an annual fiscal impact of $6.47 million once active Proposition K
projects, currently in various stages of development, become operational
over future years. This includes $2.60 million for maintenance and $3.87
million for operations (Attachments 5 and 6). The fiscal impact for
completed projects will be partially offset by Proposition K maintenance
funding. However, this annual offset will no longer be available once the
Proposition K Program ends in 2026-27. In 2023-24, RAP will receive an
award of $4.01 million for current year maintenance awards.
Financial Policies Statement: The L.A. for Kids Steering Committee
reports that the actions recommended in this report comply with the City's
Financial Policies.

I MOVE that the matter of the Personnel, Audits, and Hiring Committee Report relative to
the legality of retired City employees receiving multiple pensions, Item No. 21 on today’s Council
Agenda (CF 24-0357), BE AMENDED to adopt the following recommendations in lieu of the
recommendations in the Report:
1. I THEREFORE MOVE, that the City Attorney be requested to report to Council on the
legality of retired City employees receiving a retirement while continuing to work for a
City Department, including what defines a “retirement benefit” for a public pension
system, and what are the requirements to approve a change to retirement benefits or plan
administration from LACERS.
2. I FURTHER MOVE, that the LACERS and Water and Power Employees’ Retirement Plan
be requested to report to Council on the number of retired City employees receiving a
retirement while continuing to work for a City Department without a separation from
service, provide cost studies for each of the pension plans, and detail the process that was
followed in agendizing and authorizing through Board action for this change in benefits or
plan administration.

HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to the acquisition analysis and
execution of a new covenant agreement for the Hillside Villas Apartments located at 636 North Hill Place
in Council District 1; and related matters.
Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:
1. AUTHORIZE the General Manager, Los Angeles Housing Department (LAHD), City Attorney, or
designees, to execute the following agreements in substantial conformance with the terms
described herein, for the Hillside Villa Apartments located at 636 North Hill Place:
a. Authorize the LAHD to enter into a new affordability covenant with the Owner of the
Hillside Villa Apartments (Owner), in substantial conformance with the terms described
herein; and, instruct the City Attorney to draft the covenants and any necessary
documents to effectuate such agreement, in exchange for a payment not to exceed
$14,950,000. The covenants are for 106 units for 15 years, two months, through February
28, 2034, with the unit mix as outlined in the chart below:

thereto including:
i. Retroactively reinstate and extend the term of Housing Development Grant (HDG)
Loan CRA871015-003 ($1,860,000 HDG Program loan) with 636 NHP, LLC, from
the original end date of March 1, 2024 to a new end date of February 28, 2034.
Amend loan to a zero percent interest forgivable Service Payback Loan forgivable
in annual increments.
ii. Retroactively reinstate and extend the term of CRA Loan CRA871015-004
($3,585,300 CRA/LA loan) with 636 NHP, LLC, from the original end date of March
1, 2024 to a new end date of February 28, 2034. Amend loan to a one percent
simple interest loan with a payment due annually, and a balloon payment of
principal at the end of the term.
iii. Term No. 8 in the LAHD report dated April 12, 2024, attached to Council file No.
21-0600-S101, shall be amended to read as follows:
EXTENDED REPAYMENT PERIOD FOR COVID-RELATED AND BACK DEBT.
Additionally, a sentence shall be added to the end of that term that states:
The repayment period and any payments required under a repayment agreement
shall not commence until six months after the effective date of this Agreement.
2. REQUEST the Controller to obligate and expend the Affordable Housing Linkage Fee (AHLF)
funds to pay the Covenant Fee to the Owner as follows:

3. AUTHORIZE the LAHD to draw a demand warrant from the Linkage Fee Fund No. 59T, payable

4. AUTHORIZE the General Manager, LAHD, to disburse up to $14,950,000 from the AHLF fund to
be deposited into escrow with an escrow company mutually acceptable to the City and Owner.
5. AUTHORIZE the LAHD, City Attorney, or designees, to make necessary technical adjustments,
including additional Controller instructions, to implement Mayor and Council intent regarding this
matter, subject to the approval of the City Administrative Officer; and, REQUEST the Controller to
implement the instructions.
Fiscal Impact Statement: The LAHD reports that there is no impact on the General Fund.

SUMMARY
At the meeting held on April 17, 2024, your Housing and Homelessness Committee considered a LAHD
report relative to acquisition analysis and execution of a new covenant agreement for the Hillside Villas
Apartments located at 636 North Hill Place in Council District 1; and related matters. LAHD staff provided
an overview regarding the status of the matters and terms of the proposed agreements, and presented
amended recommendations to replace the recommendations contained in the LAHD report dated April
12, 2024.
After discussion and providing an opportunity for public comment, the Committee recommended to
approve the amended recommendations as stated into the record by the LAHD, as detailed above. This
matter is now submitted to the Council for consideration.

HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to executing a Disposition and
Development Agreement with DWC Campus, L.P. (DWC Campus), for the development of supportive
housing on the City-owned property and adjacent parcel located at 501 East 5th Street in Council District
14.
Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:
1. DETERMINE that pursuant to Section 7.27 of the Los Angeles Administrative Code, the public
interest or necessity requires the sale of the City-owned Property and the Adjacent Parcel to
DWC Campus, for its full appraised value to be determined by a California licensed appraiser,
without notice of sale or advertisement for bids.
2. DECLARE, based on the findings contained in the Los Angeles Housing Department (LAHD)
report dated April 3, 2024, attached to Council file No. 20-1449, that the City-owned properties in
connection with the Rosa’s Place are “exempt surplus land” for the Surplus Land Act (SLA) under
Government Code Section 54221(f)(1)(A), which property is to be conveyed for the development
of affordable housing subject to and contingent upon compliance with the restrictions set forth at
Government Code Section 37364; and, DIRECT the LAHD to take any other necessary actions to
ensure compliance with the requirements of the SLA.
3. DETERMINE that the Rosa’s Place Project located at 501 East 5th Street in Council District 14,
qualifies for an Affordable Housing Exemption as set forth in Public Resources Code Section
21080.27 (b)(1) as previously determined by the City Planning Commission on October 26, 2021
(Case No. ENV-2021-2545-SE; Letter of Determination from the Department of City Planning is
contained in the LAHD report dated April 3, 2024, attached to the Council file, as Attachment E).
4. APPROVE Recommendations B through E and G through L as outlined in the LAHD report dated
April 3, 2024, attached to the Council file.
Fiscal Impact Statement: The LAHD reports that there is no impact on the General Fund. The
recommended HOME loan in the amount of $7,785,104 represents $80,258 per LAHD restricted unit, or
approximately 10% of the total development costs. The recommendations in this report will authorize
LAHD to execute a Disposition and Development Agreement and issue a funding award that will allow for
the development of 98 total new construction housing units, of which 97 are designated as supportive
units.

Gardens Supportive Housing Project located at 6714 South Main Street in Council District 9.
3. AUTHORIZE the General Manager, LAHD, or designee, to negotiate and execute the relevant
financing documents for the Marcella Gardens Supportive Housing Project, subject to the
approval of the City Attorney as to form.
Fiscal Impact Statement: The CAO reports that there is no General Fund impact as a result of the
issuance of supplemental tax-exempt multifamily conduit revenue bonds (bonds) for the Marcella
Gardens Project (Project). The City is a conduit issuer and does not incur liability for the repayment of
the bonds, which are a limited obligation payable solely from the revenues of the Project, and the City is
not, under any circumstances, obligated to make payments on the bonds.
Financial Policies Statement: The CAO reports that the recommendations stated in this report comply
with the City’s Financial Policies in that the bonds are a limited obligation payable solely from the
revenues of the Project and the City is not, under any circumstances, obligated to make payments on the
bonds.
Debt Impact Statement: The CAO reports that there is no debt impact as these bonds are a conduit

SUMMARY
At the meeting held on April 17, 2024, your Housing and Homelessness Committee considered CAO and
LAHD reports and Resolutions relative to issuing supplemental tax-exempt multifamily housing revenue
bonds in an amount up to $1,955,095; and executing related financing documents for the Marcella
Gardens Supportive Housing Project located at 6714 South Main Street in Council District 9.
After an opportunity for public comment was held, the Committee recommended to note and file the
LAHD report and move forward the recommendations in the CAO report, as detailed above. This matter
is now submitted to the Council for consideration.
