Minutes_SEChristi an_081715 Approval of the minutes for Case No. 15VARIANCE1029-Southeast Christian Chapel In The Woods Committee Member Fishman motioned, seconded by Committee Member Bergman to APPROVE the August 17, 2015 BOZA minutes, Case No. 15VARIANCE1029 ONLY. The motion carried unanimously. Public Hearing 2. 15VARIANCE1035 Request: Variance from the Land Development Code to allow proposed addition to encroach into the required side yard. Project Name: Proposed Addition Location: 1129 Goss Avenue Owner: Kansas Andrade & Zach Driscoll Applicant: Owner Representative: Tim McIntyre Jurisdiction: Louisville Metro Council District: 10 - Steve Magre Case Manager: Sherie’ Long, Landscape Architect Committee Member Allendorf motioned, seconded by Committee Member Fishman to APPROVE 15VARIANCE1035, a variance from the Land Development Code, Chapter 5, Section 5.4.1.C.6.b, to allow a proposed house addition to encroach into the required side yard. The motion carried unanimously. Louisville Metro Government Page 1 Board of Zoning Adjustment Action Summary August 24, 2015 4. 15VARIANCE1057 Request: A variance from the Land Development Code to allow a proposed addition to be located beyond the maximum setback and waivers for design criteria Project Name: Red Hog Location: 2622 Frankfort Avenue Owner: Red Hog Properties LLC Applicant: Red Hog Properties, LLC Representative: Architectural Artisans, Jeff Rawlins Jurisdiction: Louisville Metro Council District: 9-Bill Hollander Case Manager: Steve Hendrix, Planning Supervisor A motion was made by Committee Member Allendord, seconded by Committee Member Bergman to APPROVE Case No. 15VARIANCE1057: a Variance to allow the addition not to be constructed at the right-of-way line (5.5.1.A.2); Waiver #1, to allow parking between the building and the right-of-way (5.5.1.3.A&C); Waiver #2, to eliminate the masonry wall (5.5.1.3.a); Waiver #3, to allow the 5 foot vehicle use area/landscape buffer area to be in the Franck Avenue right-of-way (Landscape Waiver, Chapter 10). The motion carried unanimously. 3. 14CUP1003 Request: An application for a Conditional Use Permit to allow a potentially hazardous or nuisance use, (staging lot for trucks and trailers) in a M-3 Zoning District Project Name: Cabel Street Lot Location: 151 & 201 Cabel Street Owner: JBS USA, LLC & Swift Pork Company Applicant: John Cliff, Vice President & General Manager Representative: Glenn Price, Frost Brown Todd LLC Jurisdiction: Louisville Metro Council District: 4 - David Tandy Case Manager: Steve Hendrix, Planning Supervisor On a motion by Committee Member Jarboe, seconded by Committee Member Fishman, Case No. 14CUP1003 will be CONTINUED to the October 19, 2015 BOZA meeting. This case will be heard first and the agenda needs to be kept light (no appeals). It's being continued to allow the committee members time to review materials presented, review notes and questions and to allow the 2 parties the opportunity to discuss options that may mitigate some of the issues - Time Limits - 1 hr. each side and 15 minutes for the rebuttal.
