Liberty St. Louisville, KY 40202 Action Summary Board of Zoning Adjustment Monday, February 5, 2018 1:00 PM Old Jail Courtroom Annual Meeting Call To Order Present: 7- Board Member Dwight Young, Board Member Richard Buttorff, Board Member Lester Turner Jr., Board Member Lula Howard, Board Member Betty Jarboe, Board Member Rosalind Fishman, and Chair Person Michael Allendorf Approval Of Minutes 1. BOZA_Minutes_01.22.18 Approval of the Minutes from the January 22, 2018 Board of Zoning Adjustment meeting. A motion was made by Board Member Fishman, seconded by Board Member Jarboe, that the Minutes from the January 22, 2018 Board of Zoning Adjustment meeting be APPROVED. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf Business Session 2. BOZA_Election_Officers BOZA Annual Election of Officers A motion was made by Board Member Fishman, seconded by Board Member Turner, that Mike Allendorf be NOMINATED as Chairperson for the Board of Zoning Adjustment. There being no other nominations, the election was closed and Mr. Allendorf was APPOINTED Chairperson for the Board of Zoning Adjustment. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf A motion was made by Board Member Turner, seconded by Board Member Young, that Rosalind Fishman be NOMINATED as Vice Chairperson for the Board of Zoning Adjustment. There being no other nominations, the election was closed and Ms. Fishman was APPOINTED Vice Chairperson for the Board of Zoning Adjustment. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf A motion was made by Board Member Turner, seconded by Board Member Fishman, that Lula Howard be NOMINATED as Secretary for the Board of Zoning Adjustment. There being no other nominations, the election was closed and Ms. Howard was APPOINTED Secretary for the Board of Zoning Adjustment. Youth Services, Inc. Location: 3735 Lentz Avenue Owner: Angel Black Applicant: Michael McCloud Representative: Michael McCloud Jurisdiction: Louisville Metro Council District: 15 - Marianne Butler Case Manager: Jon E. Crumbie, Planning and Design Coordinator A motion was made by Board Member Jarboe, seconded by Board Member Fishman, that Case Number 17CUP1080, Conditional Use Permit to allow transitional housing in an R-5 zoning district,be APPROVED, noting Relief from items 4A1, 4A2 and 4A5, and SUBJECT to the following Conditions of Approval: Conditions of Approval: 1. The site shall be developed in strict compliance with the approved development plan (including all notes thereon). No further development shall occur on the site without prior review and approval by the Board. 2. The Conditional Use Permit shall be "exercised" as described in KRS 100.237 within two years of the Board's vote on this case. If the Conditional Use Permit is not so exercised, the site shall not be used for transitional housing without further review and approval by the Board. Hold quarterly meetings with interested neighbors or advisory board. Provide a 7 day notice prior to meeting date. 5. No more than 5 residents living at location at any one time. 6. No blending of gender at location. 7. No music or outdoor activity after 8:00 p.m. on any night of the week. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf 5. 16CUP1001 Request: Scrubber System Report Project Name: 16CUP1001 Location: 1200 Story Avenue Owner: JBS USA, LLC & Swift Pork Company Applicant: JBS USA, LLC & Swift Pork Company Representative: Glenn Price Jurisdiction: Louisville Metro Council District: 4 - Barbara Sexton Smith Case Manager: Steve Hendrix, Planning Supervisor A motion was made by Board Member Jarboe, seconded by Board Member Buttorff, regarding Case Number 16CUP1001, that the Scrubber System Report be ACCEPTED as presented. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf A motion was made by Board Member Jarboe, seconded by Board Member Young, that Case Number 16CUP1001 be CONTINUED to the July 2, 2018 Board of Zoning Adjustment meeting for the purpose of receiving another follow up report from the applicant regarding the scrubber system. The motion carried by the following vote: Yes: 7- Young, Buttorff, Turner, Howard, Jarboe, Fishman, and Allendorf Annual Report 6. BOZA_Annual_Report Request: BOZA Annual Report Case Manager: Joe Haberman, Planning & Design Manager Joe Haberman presented the 2017 Annual Report. Staff and Board Members discussed items presented in the Annual Report. This agenda item was for informational purposes only, therefore, no vote or action was taken.
