Approval Of Minutes

Approval of the Minutes from the March 22, 2018 Historic Landmarks and Preservation Districts
Commission meeting.
A motion was made by Commissioner Hartman, seconded by Commissioner
Omidy, that the Minutes from the March 22, 2018 Historic Landmarks &
Preservation Districts Commission meeting be APPROVED. The motion carried
by the following vote:
Yes: 10 - Kirchdorfer, Vice, Weeter, Hartman, Doutrick, Stottman, Jackson, Jones, Omidy,
and Fuller
Absent: 2- Liu, and Haskins
Abstain: 1- Coan

2. LMC_Subcommittee_HPATF
Update on the LMC Subcommittee on the HPATF recommendations.
NOTE: Presentation of Agenda Item #3 was included with this presentation of
Agenda Item #2.
Cynthia Elmore provided an overview of the Historic Preservation Advisory
Task Force and their recommendations. Ms. Elmore then provided an update
on the Landmarks Commission Subcommittee on the HPATF
recommendations.
Ms. Elmore discussed the Subcommittee's draft recommendations for revisions
to the Landmarks Ordinance. Ms. Elmore stated the bulk of changes are found
in the petition and designation process. Ms. Elmore stated staff recommends
review of draft recommendations until the next Landmarks Commission
meeting which is scheduled for June 21, 2018. Ms. Elmore stated the public
will be allowed an opportunity to comment on the draft recommendations as
well.
Chair Vice thanked everyone who has participated in the process. Chair Vice
stated the County Attorney's office has also taken a look at this, and he
deferred to Paul Whitty for further comments.
Paul Whitty, Assistant County Attorney, stated that in the course of their
review, they found an organic flaw in the Ordinance with respect to the
composition of the Commission. Mr. Whitty stated that since its inception, the
composition of the Commission has included a designee of the Metro Council.
However, in 2012 when the Ordinance was revised to include a review by the
Metro Council of the Commission's decisions that created what is known in the
law as an incompatible office. That is, it puts the member of the Commission
that is a member of the Metro Council in a position of passing judgement on
his or her own decision, and that is forbidden by not only the Constitution of
Kentucky, but also Statute and Case Law. Mr. Whitty stated his
recommendation is that this piece of the composition be deferred to the Metro
Council, because it is the President's role in making that appointment. Mr.
Whitty stated that appointment is fine, it is the pool of candidates that's the
issue. The Commissioners discussed this issue.

Therefore, no vote or action was taken.

4. LMC_Annual_Report
Landmarks Commission Annual Report.
Joe Haberman reviewed the Annual Report for 2017.
Mr. Haberman reviewed the history of the Old Jail Building where the
Landmarks meetings are held.
Mr. Haberman explained the Organizational Chart for Planning and Design
Services, including boards, commissions and committees.
Mr. Haberman presented numbers for 2017, including applications received.
Mr. Haberman provided a brief overview of the Comprehensive Plan.
Cynthia Elmore provided additional comments regarding other work
performed by staff. Ms. Elmore introduced the Urban Design Staff, and the
staff members (Becky Gorman, Savannah Darr, and Burcum Keeton) briefly
explained some of the work they perform.

action was taken.
5. ARC's_Report_On_Activity
Reports from ARC Chairs/Representatives.
West Main Street ARC - no representative was present.
Limerick ARC - Stephen Peterson provided an update on the activities of the
Limerick ARC.
Clifton ARC - Jay Stottman provided an update on the activities of the Clifton
ARC.
Old Louisville ARC - Herb Fink provided an update on the activities of the Old
Louisville ARC.
Cherokee Triangle ARC - Michael Gross provided an update on the activities of
the Cherokee Triangle ARC.
Parkland ARC - no representative was present.
Butchertown ARC - Lindsey Stoughton provided an update on the activities of
the Butchertown ARC.
Individual Landmarks ARC - Herb Shulhafer provided an update on the
activities of the Individual Landmarks ARC.
