Call to Order
Chairman Tandy called the meeting to order at 2:05 p.m. and introduced the
members and non-members that were present. A quorum was established.
Roll Call
Present: 4- Chair Person David Tandy (D-4), Council Member Attica Scott (D-1), Council
Member Kenneth C. Fleming (R-7), and Council Member Marianne Butler (D-15)
Excused: 1- Vice Chair Stuart Benson (R-20)

1. O-183-13 AN ORDINANCE PROHIBITING THE CITY AND ITS VENDORS FROM
ENGAGING IN HIRING POLICIES AND PRACTICES AGAINST
PERSONS PREVIOUSLY CONVICTED OF CRIMES AND
PROHIBITING THE PLACEMENT OF A “CHECK THE BOX” ON CITY
JOB APPLICATIONS BY PERSONS HAVING CRIMINAL
CONVICTIONS (AMENDED BY SUBSTITUTION AS AMENDED).

(D-1), David Tandy (D-4), Tina Ward-Pugh (D-9), Barbara Shanklin (D-2) and Mary C.

A motion was made by Council Member Attica Scott, seconded by Council
Member Butler, that this Ordinance be recommended for approval by the Metro
Council.

A motion was made by Chair Person Tandy, seconded by Council Member Scott,
that this Ordinance be amended as follows:
Section V (D) (3) Exceptions (a) delete 7 through 13 and change 14 to 7.
The motion carried by a voice vote and the amendment passed.
A motion was made by Council Member Scott, seconded by Council Member
Butler, that this Ordinance be amended as follows:
Changing will to shall so that Section III (B) 2) reads as follows: If an Applicant
reaches the final stages of consideration for hire, the City shall notify the
Applicant that a criminal background check will be conducted, at which time the
Applicant shall be given an opportunity to inform Louisville Metro of any criminal
background history that the Applicant may have.
Adding language to Section V (D) (2) to read as follows: The standards
established in this chapter and said criminal history policies shall be a part of the
performance criteria when awarding City contracts. The City shall retain at all
times the authority to deny, rescind, revoke, terminate or not renew a contract
with a Vendor for failing to comply with the standards established in this chapter.
The Ordinance was sent to Old Business by the following vote:
Yes: 3- Tandy, Scott, and Butler
No: 1- Fleming
Excused: 1- Benson
2. R-028-14 A RESOLUTION APPROVING THE GRANTING OF LOCAL
INDUCEMENTS TO LUBRIZOL ADVANCED MATERIALS, INC.
PURSUANT TO KRS CHAPTER 154, SUBCHAPTER 32. (Action
Required by July 2014)
Sponsors: David Tandy (D-4)
A motion was made by Council Member Butler, seconded by Council Member
Fleming, that this Resolution be recommended for approved by the Metro
Council. By a voice vote the motion carried and the Resolution was sent to Old
Business due to a no vote.
3. R-180-13 A RESOLUTION TO LOWER THE TAX BURDEN ON THE LOUISVILLE
METRO TAXPAYER THROUGH ENCOURAGEMENT TOWARDS
RECTIFICATION OF ONGOING LITIGATION WITH LOUISVILLE
FIREFIGHTERS. (Action Required by April 2014)
Sponsors: David James (D-6)
Chairman Tandy announced that the Sponsor of this item, Council David James,
has withdrawn his sponsorship and therefore this item lapses.
