R-166-19 A RESOLUTION OVERTURNING THE DECISION OF THE LANDMARKS COMMISSION DESIGNATING THE PROPERTY LOCATED AT 2914 S. 3RD STREET AND 2911 S. 4TH STREET IN LOUISVILLE METRO AS A LOCAL LANDMARK (CASE NO. 19DESGNATION1000) (AS AMENDED). Council Member Flood gave an overview of the need for this legislation that included the following information: - the Holy Name Complex consists of five buildings, and four of the buildings were going to be demolished to allow for an expansion of Catholic Charities; - the new structures are needed for the active parish to have services and allow the Catholic Charities to expand their religious mission; and - during the process of getting demolition permits, there were people who began the process of having the property designated as a Historic Landmark. A motion was made by Council Member Flood, seconded by Council Member Engel, to invoke Rule 5.11(e) to limit debate to 90 minutes. The motion to limit debate carried by a voice vote. Council Member Triplett referred to the vital services Catholic Charities offers to the struggling neighborhood where this property is located, and how during a budget crisis such resources mean even more. Council Member Triplett spoke about how the buildings are in such bad condition that the parish brought in professional architects and designers to inspect the buildings and they found that they are inadequate to support the necessary loading requirements and rehabing them is economically unfeasible. He also mentioned that Catholic Charities has a track record for repurposing properties and buildings, as they did at Most Blessed Sacrement. Council Member Triplett noted that if the landmarking remains there could be five vacant buildings on this property if Catholic Charities leaves due to being unable to use the property to adequately fulfill its mission. Council Member Triplett spoke about the decision to landmark the buildings and the failure to consider the economic hardship rehabilitating the buildings would put on Catholic Charities. Enactment No: Resolution 135-2019 Louisville Metro Government Page 12 Metro Council Action Summary - Final December 12, 2019 Council Member Coan said that he did not dispute the Council's authority to overturn a landmark designation and that the Resolution offers alternative findings of fact based on the criteria the Landmark Commission is supposed to consider, but he thinks its important to make sure the Council understands the process since there have been changes with respect to the demolition of buildings. He explained that the economic hardship issue is a separate process and is not one of the criteria in the designation of a landmark, and that the reasons considered for overturing the landmarking should be those outlined in the Resolution and not the economic hardship issue. He also mentioned the recent changes to the Landmarks Ordinance as it pertains to economic hardships and how a record of the economic hardship can be established at the Landmark Commission level so that the Council can properly consider it, but is should not be the only reason considered. He suggested that as a matter of precedence the new laws should be applied correctly as more cases arise and the Landmarks Commission and Council get better at understanding them. Council Member Yates stated that the proposed amendments do not change the intent of the Resolution, but rather they clarify that if the Council voted to overturn the landmark designation it was only considering what it was allowed to within the set parameters. Travis Fiechter responded by reading from the Landmarks Ordinance [LMCO 32.260(O)(2)(f)] which states that "...the Commission may determine whether the structure or site owner(s) would qualify for an economic hardship exemption...." Council Member Hollander explained that he's going to vote against this Resolution because the consideration of economic hardship is not before us, and that at the Council level there has been virtually no real discussion about the historic relevance of these buildings. Council Member Fowler spoke of her concern that the Landmarks Commission uses the designation process to block development they do not want. She also stated that the subject property is in a blighted neighborhood that needs this development and that they should not be telling the church how it can do business. Council Member George explained that she would be voting against this Resolution. She expressed that she respected Holy Name and the value of their work, that she understood the challenges of maintaining such an old building, and that she also valued the historical integrity of the property and was not convinced that demolishing a historic building in favor of a parking lot was in the best interest of the community. Council Member Winkler asserted that the landmarking process should not be used as a weapon and that anyone concerned with the historic significance of a structure should request that it be landmarked immediately and not wait until a development plan is initiated. A motion was made by Council Member McCraney to table this Resolution. President James asked what the time limitation was on this legislation before the motion to table be considered. Travis Fiechter stated that a decision was required by Feburary 14, 2020 and that there was one additional Council meeting before then, and President James proceeded with the request for a motion to table. A second was made by Council Member Green. The motion to table failed by a voice vote. Council Member Flood spoke about how the Resolution listed several alternative findings of fact that explain why the subject property would not meet the criteria to be designated as a historic landmark. Council Member Fowler suggested that a process be put in place to identify places in the community that have historic significance and that such a process move quickly because she will continue to support overturning landmark designations that are initiated to stop unwanted development. Enactment No: Resolution 135-2019 Louisville Metro Government Page 14 Metro Council Action Summary - Final December 12, 2019 Council Member Yates spoke about how the Council changed the process for designating landmarks to give them the authority to review such designations, and that each Council Member must consider what is good for their District and the city because there may be some things that meet the required criteria but do not take other things into consideration. Additionally, though he feels that the Landmarks Commission will get the message if the Council continues to overturn some of the landmarks designations, he does not want to deter people from serving as a member on the Landmarks Commission because he knows that the members care about their community and that there are a lot of great treasures in the Metro area that should be preserved. He noted that several things have been designated as historical landmarks in the last five years and that the Commission is not only concerned about the historical significance of a structure but they are also concerned with how it can be preserved. He also spoke about the process being long and a lot to go through but that it allows people an opportunity to appeal to the Council, and that he supported the amendments to the Resolution because they help clarify the language in case there is an appeal filed against the Council's decision. Council Member Blackwell explained that for the sake of appearances he would be abstaining from any discussion and vote in this matter because although he does not work for the Catholic Charities he does work for the Archdiocese. Council Member Kramer explained that, out of an abundance of caution, he too would be abstaining because he teaches at Mercy Academy.
