Call to Order and Pledge of Allegiance
Council President James called the meeting to order at 4:02 p.m. and asked all
to rise for the Pledge of Allegiance.
Moment of Silence
Council President James asked for a moment of silence for the lives that have
been lost to the COVID-19 pandemic, prayers for the safety of front-line
workers, and a pledge to continue to work together to get through this safely.
Members Roll Call
The Clerk called the roll. A quorum was established.
Council Members attended the meeting remotely, except for Council President
James, Council Member Kramer, and Council Member Fox who were present
in Council Chambers.

Metro Council Action Summary - Final April 23, 2020
Mayor Greg Fischer's FY 2020-2021 Budget Address
Council President James stated that the Mayor is to present a budget for Metro
Government no later than the second meeting of the Metro Council in April,
and that the Metro Council has until the end of June to review and pass the
budget. He explained the precautions being taken by the Mayor to adhere to
the directives regarding social distancing and staying healthy at home, and
because of such the Mayor's Budget Address has been provided as a video and
will be aired in Chambers and via video conference. He also spoke about how
any technical difficulties would be handled.

Recess
Council President James asked for a motion to recess at approximately 4:38
p.m. A motion was made by Council Member Fox, seconded by Council
Member Kramer. The motion to recess carried by a voice vote.
Council President James asked for a motion to reconvene at approximately
5:11 p.m. A motion was made by Council Member Fox, seconded by Council
Member Engel. The motion to reconvene carried by a voice vote.
Statement Regarding Virtual Attendance by Council Members
Council President James stated that the remainder of the meeting would
involve discussion of public business and action would be taken. He spoke
about provisions regarding any disruptions in remote access for Council
Members, which would require a temporary suspension of the meeting, and
the time allotted to regain remote access before the meeting resumes.

AN EMERGENCY RESOLUTION URGING THE GOVERNOR TO ALLOW
CHIROPRACTORS AND PROVIDERS OF OTHER FORMS OF CONSERVATIVE
TREATMENT TO OPERATE (AS AMENDED).

A motion was made by Council Member Peden, seconded by Council Member
Piagentini, that this Resolution be approved.
Council Member Peden spoke about chiropractic service being considered
'elective' care rather than 'emergency' care and, therefore, has been shut
down during the COVID-19 pandemic. He spoke about having back pain and
the need for urgent care in such situations, and how a chiropractor can help
alleviate such intense pain without pain medicine.
Council Member Peden made a motion, seconded by Council Member
Piagentini, that this Resolution be amended to add the following:
"WHEREAS, the Chiropractic Associations of Kentucky have submitted their
re-start procedures as dictated by the CDC to the Governor’s Office;"
Council Member Sexton Smith asked if all of the Chiropractic Associations in
Kentucky were working together to provide one document to the Governor,
and Council Member Peden responded in the affirmative.
The motion to amend carried by a voice vote.
Council Member Piagentini stated that chiropractors prevent more serious
complications that may need to be addressed in an emergency room, and that
they provide an alternative therapy to the use of opioids.
Council Member Yates stated that physical therapy and other providers of
alternative care should be included with chiropractors, as they too provide
more conservative treatment.
A motion was made by Council Member Yates, seconded by Council Member
Fowler, that this Resolution be amended to include "other forms of
conservative treatment" in the Whereas clauses.
Council Member Kramer spoke in support of the amendment.
The motion to amend carried by a voice vote.

The following spoke to the amended Resolution:
-Council Member Fowler spoke in support of the amended Resolution.
-Council Member Reed spoke in support of the amended Resolution. He also
asked whether physical therapists were included in the businesses being
allowed to re-open on Monday.
-Council Member Coan asked whether chiropractors were included in the
businesses that were being allowed to re-open on Monday as part of the
phased-in restart to the economy; and also stated that he did not want to get in
the habit of recommending to the Governor when businesses should be
allowed to re-open.
-Council Member Sexton Smith stated that she had received confirmation from
Representative Rocky Adkins confirming that chiropractors were among those
businesses being allowed to re-open on Monday. She also stated that she
could make an argument to have several other types of businesses be
re-opened but would not because she believed they should support the course
being provided by leadership, and she would not be supporting this
Resolution.
-Council Member Yates spoke in support of the amended Resolution, though
Resolutions have often been known to get little response in the past. He later
stated that he felt the Resolution was moot and would not be supporting it.
-Council Member Blackwell agreed with Council Member Sexton Smith's
concern about suggesting to the Governor what should be re-opened, and how
the Council could find themselves proposing a Resolution regarding such each
meeting or even daily, and for that reason would not be supporting the
amended Resolution.
-Council Member Winkler stated that choosing one type of pain management
provider over another was problematic for him.
Council Member Peden concluded by stating that he understood that some
may feel that the Resolution is moot, but rather than pulling his sponsorship he
would be willing to send it to a committee so that they can see what happens
on Monday.
A motion was made by Council Member Peden, seconded by Council Member
Yates, that this Resolution be referred to the Community Affairs, Health and

A motion was made by Council Member Piagentini, seconded by Council
Member Fox, that this Ordinance be approved.
Council Member Flood provided background on this Ordinance, which started
with a Resolution requesting the Planning Commission to review the Land
Development Code and make suggestions regarding the tree canopy and the
preservation of trees, and included a series of public meetings. The suggested
amendments to the Land Development Code were provided in the form of an
Ordinance to the Planning and Zoning Committee last summer and it has been
discussed and amended as presented here.
Council Member Hollander briefly reviewed some of the changes (listed
below) being made to the Land Development Code to continue to address the
shrinking tree canopy and heat island effect associated with it:
-the fee-in-lieu provision is to be used as a last resort and those dollars will
stay in the Council district;
-increased the tree canopy requirement for industrial areas to 30 percent;
-allowed trees planted on private lots in major subdivisions to be counted
toward the tree canopy;

-changed spacing for street trees to address concerns about driveways; and
-new requirement that will not allow clear cutting on some pieces of land
and would require the preservation of some trees, and changed a related
provision that discourages tree clearing prior to development.
Council Member Winkler spoke about his concern regarding the look-back
provision and how the solution provided in this Ordinance creates the
potential for a moral hazard that could only be prevented by requiring a
permit to remove any trees, and that is not a solution anyone is interested in
pursuing. He stated that no one got everything they wanted but that it was a
good balance between addressing the tree canopy and heat island effect and
promoting development across Jefferson County.
Council Member Peden also spoke about his concern regarding the loop hole
in the look-back provision, and how a realtor may suggest a property owner
clear all of the trees to raise the value of the land and how it may be easier to
sell. He stated that he may consider proposing an amendment that requires
the name of the person who paid to have the land clear cut be provided
because he doubts that the land owner will want to take on that expense up
front.
Council Member Coan stated that he advocated for stronger provisions that did
not make the cut, but he was fine with it because he thought it was a good
process that he was proud to be a part of, and a good piece of legislation. He
requested to be a co-sponsor as well. He also spoke about the look-back
provision and the balance between conservation and development. He also
stated his concern about over-regulating private property rights.
Council Member Piagentini stated that he appreciated the process used to
create this legislation, as it was not rushed, took into consideration a variety of
thoughts, and had various sources of input.
Council Member Purvis spoke about her concern regarding private property
rights. She stated that a few of her constituents are concerned about not
being able to refuse to have trees planted on or near their property, and when
the trees become problematic they cannot afford to maintain them and the
trees may cause damage to their property.
Council President James requested to be added as a co-sponsor.
