Metro Council Action Summary - Final June 25, 2020
Call to Order and Pledge of Allegiance
Council President James called the meeting to order at 6:00 p.m. and asked all
to rise for the Pledge of Allegiance.
Moment of Silence
Council President James spoke about those who have died from COVID-19 and
those that have tested positive, and noted that more will be affected by the
virus. He asked that everyone continue to stand strong and committed
together.
Council President James also spoke in remembrance of Doug Hamilton,
former Louisville Metro employee, and Bill Young, Councilman for
Jeffersontown, who both recently passed away.
He asked that everyone join him in a moment of silence.
Statement Regarding Virtual Attendance by Council Members
Council President James stated that the meeting was being conducted by
video teleconference, pursuant to KRS 61.826 and in accordance with Senate
Bill 150. He also spoke about provisions regarding any disruptions in remote
access for Council Members, which would require a temporary suspension of
the meeting, and the time allotted to regain remote access before the meeting
resumes.

A motion was made by Council Member Ackerson, seconded by Council
Member Sexton Smith, that this Ordinance be amended as shown in the

Council Member Ackerson spoke about the purpose of the amendment, which
is to give community activists and stakeholders some input into this project
and give the Council final approval to make sure things run properly.

A motion was made by Council Member Coan, seconded by Council Member
Ackerson, that this Ordinance be amended to strike Project #55, Oddfellows
Disposition.
Council Member Coan stated that Project 55 is related to the Omni Hotel
project and that Louisville Metro has an obligation to clear a parcel of the
property that has a building on it that is being considered by the Landmarks
Commission. He also mentioned the recent change to the Ordinance
regarding historic buildings that requires a development plan before a
building that is more than 50 years old can be demolished, and stated that the
Omni has not presented such a plan so this is not likely to be a project that
takes place in the next year.
Council Member Winkler spoke against the amendment and stated that putting
the money in the budget does not mean that the building will be torn down
anytime soon, but allocates the money if or when the time comes.
Council Member Hollander spoke against the amendment and stated that the
allocation is an authorization to spend the money if action is needed on the
site by June 30, 2021, and that money would not be borrowed at this time.
Council Member Sexton Smith spoke against the amendment and stated that
her vote does not mean that she is in favor of the demolition of the Oddfellows
property, and that it is not fiscally responsible to remove the allocation should
action need to be taken on the site before June 30, 2021.
The motion to amend failed by the following vote:

A motion was made by Council Member Peden, seconded by Council Member
Piagentini, that this Ordinance be approved.
Council Member Coan stated that after hearing from some constituent
advocates who were interested in improving parking accessibility for people
with disabilities, he and Council Member Hollander worked with Public Works,
the Jefferson County Attorney's Office, and others to amend Chapter 72 [of the
Louisville Metro Code of Ordinances]. He stated that the goals were mainly to
assure that access aisles had more protections so that people with disabilities
have more room to maneuver.
Council Member Hollander thanked the constituents that brought this issue to
the Council so that it could help fix some of the difficulties had by people with
disabilities.

The following was discussed:
- NuLu Marketplace is a private property consisting of a series of buildings
within one block
- How Entertainment Destination Centers help promote business and tourism
- NuLu Marketplace is a new development that is ready to open, has seven to
nine businesses that have already signed agreements to come to this area,
and covers about 55,000 square feet
- The differences between NuLu Marketplace and the other three
Entertainment Destination Centers in Louisville which are larger in size and
have numerous businesses included
- NuLu Marketplace consists of about a quarter of a block and very few
businesses
- Whether favoritism is being shown for one developer
- Promoting the entire NuLu area
- Similarity of models used at Colonial Gardens and NuLu Marketplace
- Other NuLu area businesses can also apply for the same opportunity to be
Entertainment Destination Centers
- Public should not think that this discussion is about the possibility of an
open-carry situation where people can walk around in the public right-of-ways
anywhere in the community with their open alcoholic beverages
- The amount of square feet required for an Entertainment Development
Center pursuant to Kentucky Administrative Regulations and provisions that
allow for this situation to go forward without that requirement being met
- Having other businesses involved in this would help meet the legal
requirements including one that requires $5M investment in the area
- Responsibility is with Louisville Forward and not each Council Member to
help with these projects in order to see the larger picture and, in this situation,
encompass more businesses in the project

Member Peden, that this Ordinance be approved.
Council Member Blackwell briefly spoke about this item and how the
Appropriations Committee has discussed handling certain circumstances as
requests regarding Neighborhood Development Funds change due to the
COVID-19 pandemic. He stated that this item's scope has changed and some
Council Districts withdraw their funding due to the change.
Council Member Sexton Smith spoke about the seven-part video series being
created in place of the initially planned Juneteenth Celebration this year, and
how the series tells the history of June 19, 1865 in seven 15-minute segments.
She stated that the series would be available to the public and schools on

PBS, KET, and various social media platforms. She stated that it would also
be available on WAVE on Fridays at 12:00 p.m. for the next six weeks.
A motion was made by Council Member Coan, seconded by Council Member

total of $18,000. The motion to amend carried by a voice vote.
