Call to Order and Pledge of Allegiance
Council President James called the meeting to order at 6:00 p.m. and asked all
to rise for the Pledge of Allegiance.
Moment of Silence
Statement Regarding Virtual Attendance by Council Members
Council President James stated that the meeting was being conducted by
video teleconference, pursuant to KRS 61.826 and in accordance with Senate
Bill 150. He also spoke about provisions regarding any disruptions in remote
access for Council Members, which would require a temporary suspension of
the meeting, and the time allotted to regain remote access before the meeting
resumes.
Council Members attended the meeting remotely, except for the following who
were present in Chambers:

A motion was made by Council Member Mulvihill, seconded by Council
Member Triplett, to amend the Ordinance by:
- Amending the definition of 'Healthcare Facility' as it appears in Section
132.09(A)(4) of the Louisville Metro Code of Ordinances, by adding the
following at the end of the first sentence: "and has a designated person(s),
either paid or unpaid, to provide for the safety and security of patients and
visitors that come to the facility."

- Requiring security in order to be allowed to have a buffer zone
- Concern about the person responsible for enforcing the buffer zone being
employed by the entity that does not want people near its facility
- Concern about someone not employed or trained being designated as
security
- The facility's responsibility and accountability for the person it designates as
security
- Whether the buffer zone is in effect if there is no designated security there to
enforce it
- The buffer zone being a tool for the police to clear an area or interact with
someone who is violating the buffer zone, and the buffer zone being in effect
all the time and even when no one is there to enforce it
- Question about how the buffer zone will be enforced
- Buffer zones can already be created on private property any time, but not on
public property
- Designated person being the first line of defense and a on-site contact person
for police
- Only police officers can enforce Louisville Metro Ordinances
- Crime Data report (see attached) from Louisville Metro Police Department
regarding incidents at healthcare facilities
- The right to assemble peacefully
- Abortion
- Whether the buffer zone is related to safety due to COVID-19
- Whether it will hold up to constitutional scrutiny

- Accusation of partisan theatrics in regards to legislation that is sponsored by
only one party
- COVID-19 risks during protests in front of the EMW Clinic versus protests in
Jefferson Square Park
- Communication with the Kentucky Hospital Association and the Kentucky
Primary Care Association
- Counselors providing support services that save lives
- No safety issue at EMW Clinic, everyone peacefully assembling
- Public discussions had by Council Members regarding this topic in the last
few years
- Need for safety zone at the University of Louisville Hospital's Emergency
Room after shooting incidents
- First Amendment issue versus the message
- Narrowly tailoring Ordinance to address a specific issue, such as public safety
due to COVID-19
- Passing legislation that cannot be enforced
- Providing safe access rather than the underlying issue of the services being
provided
- Balance between people's rights to protest peacefully and the right of
patients to be able to enter healthcare facilities without unnecessary
obstruction
- Buffer zones should be made available for other businesses as well
- Need for a sunset clause when the Governor lifts the State of Emergency
Order
- The proposed amendment was about safety at first and ended with just
appointing somebody to provide security - need someone able de-escalate the
violence
- Creating a buffer zone so people do not have to hear a particular message
- Buffer zone improves public safety by protecting access to medical care as
well as protecting protesters' rights
- People getting good at being able to communicate from 6 feet away, even
with masks on, and can still protest or provide counsel
- Proposed sunset clause
A motion was made by Council Member Fowler, seconded by Council Member
Piagentini, that the Ordinance be amended to add a sunset clause stating that
when the Governor's Order is lifted the Ordinance would no longer be in effect
[paraphrased].
Council Member Winkler spoke about the 90-minute limited debate period
ending and suggested the Ordinance be tabled to allow for further discussion.

As Council President James called for a vote on the motion to amend, Hollie
Hopkins, Jefferson County Attorney's Office, interrupted to explain that, due to
the limited debate time having elapsed, no further action or votes on the
pending amendment could be made. Travis Fiechter, Jefferson County
Attorney's Office, quoted the final line of Council Rule 5.11(e), which states:
"Upon the expiration of said time limit, the ordinance, order, or resolution,
amended or not, shall be automatically called for a final vote[.]" He explained
that the most reasonable interpretation meant that the amendment was to be
discarded.
Council President James called for a vote on the motion to approve the
Ordinance.
(During the vote, Council Member Mulvihill, Council Member Fowler, and
Council Member Yates explained their votes.)

Council Member Flood explained that this program provides assistance to the
homeless and asked for additional sponsors.

Piagentini, that this Ordinance be amended as follows:
- add an additional $250 from District 20
- add $250 from District 22
- add an additional $125 from District 13
- add $125 from District 17
The motion to amend carried by a voice vote for a new total amount

Council Member Flood explained that there was a tie vote at the Planning
Commission so no decision was made and, therefore, they did not provide a
recommendation to the Council. Provisions in KRS 100.211 allow time for this
to be sent back to the Planning Commission to try to break the tie before it
comes back before the Council.
