O-264-19 AN ORDINANCE CHANGING THE ZONING FROM C-2 COMMERCIAL AND R-4 SINGLE-FAMILY RESIDENTIAL TO CM COMMERCIAL MANUFACTURING ON PROPERTY LOCATED AT 6611 SHEPHERDSVILLE ROAD CONTAINING 15.91 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 19ZONE1023). Brian Davis, Planning and Design Services, spoke to the item and gave a presentation. A motion was made by Chair Person Flood, seconded by Committee Member Engel, that this Ordinance be amended by changing Binding Element #6 to read, "No idling of trucks shall take place within 200' of residential uses between the hours of 10:00 PM and 7:00 AM. The motion to amend carried by a voice vote. A motion was made by Chair Person Flood, seconded by Committee Member Engel, that this Ordinance be amended by correcting Binding Element #11 to read "the beam" rather than "the filament". The motion to accept the technical correction carried by a voice vote. A motion was made by Chair Person Flood, seconded by Committee Member Reed, that this Ordinance be amended by changing Binding Element #14 to read "Any change of use on the premises requires a review and approval by the Louisville Metro Council". The motion to amend carried by a voice vote. A motion was made by Chair Person Flood, seconded by Committee Member Triplett, that this Ordinance be amended by adding Binding Element #15 that says, A. the Property shall not be used for the storage of; (a) radioactive materials which require signage designating such materials as radioactive or hazardous when being transported or stored, or (b) other substances which when transported over public roads would require the display of hazardous materials signage on vehicles or trailers Louisville Metro Government Page 2 Planning and Zoning Committee Action Summary - Tentative August 27, 2019 conducting such transportation, or (c) other substances or materials which are defined, determined or identified as contamination or as hazardous or toxic under any environmental or hazardous materials law, other than in compliance with all applicable laws. B. The foregoing A. will not preclude; (a) the use of materials of the type and only in quantities customarily used in connection with the construction, occupancy and operation of industrial warehouse properties similar to the Property provided the same are incidental to or required for the use of the Property and are held, stored and used in full compliance with all applicable environmental or hazardous materials laws or, (b) above ground fuel storage tanks for use by a tenant or occupant to fuel its own trucks (and not those of any third parties) and the accessing of the Property by trucks transporting such fuel to supply such fuel storage tanks.
