The motion carried by the following vote: Yes: 6- White, Brown, Blake, Kirchdorfer, Tomes, and Jarboe Absent: 3- Lewis, Turner, and Howard Abstain: 1- Peterson A motion was made by Commissioner Brown, seconded by Vice Chair Jarboe, that the CUP be approved and the DDDP be RECOMMENDED, to the City of Middletown, for approval; also, ON CONDITION that the applicant adds notes to the face of the plan to read as follows: ROW dedication by deed or minor plat is required prior to plan transmittal as well as depicting the area to be dedicated to public ROW; a second note: Construction plans, bond and permit for work along the Aiken Rd. frontage to provide shoulder, ditch and culvert pipes shall be required prior to plan transmittal. Work within the ROW shall include removal of the 3rd entrance to the far east end of the site. The motion carried by the following vote: Yes: 6- Brown, Blake, Kirchdorfer, Tomes, Jarboe, and Peterson Absent: 4- Lewis, White, Turner, and Howard A motion was made by Vice Chair Jarboe, seconded by Commissioner Tomes, that the variance from 5.5.1.A.2 to permit the building to be located more than 5 feet away from the ROW lines at each corner; 5.7.1.B.1 to permit the building height to be 60 feet instead of the required 45 feet; waiver from 10.2.4 to eliminate the buffer and plantings between C-2 and CR; and DDP, be approved.
