A motion was made by Commissioner Lewis, seconded by Commissioner
Howard, that Case No. 15ZONE1039: a variance from table 5.3.2 to permit
parking to encroach 35 feet into 50 ft setbacks along the north property line; a
waiver from chapter 10.2.4 to eliminate the required 5 foot LBA where the
proposed C-1 is adjacent to the proposed OR on the site; a Detiled District
Development Plan and binding elements, be approved. The motion carried by
the following vote:

height of 45 feet instead of the required 35 feet, be approved. The motion
carried unanimously.

A motion was made by Commissioner Howard, seconded by Commissioner
Turner, to RECOMMEND, to the city of Lyndon, APPROVAL of the Revised
Detailed District Development Plan with removal of 9-66-97 binding elements
and addition of the proposed binding elements. The motion carried
unanimously.
