Yes: 9- Brown, Howard, Smith, Carlson, Ferguson, Peterson, Tomes, Lewis, and Jarboe Absent: 1- Gazaway Louisville Metro Government Page 2 Planning Commission Action Summary February 16, 2017 A motion was made by Commissioner Brown, seconded by Commissioner Howard, that Case No. 16ZONE1051, a Detailed District Development Plan and proposed binding elements with a change to binding element 5B (add the following): Encroachment permits must be obtained from the Kentucky Department of Transportation and Transportation Planning prior to plan transmittal and binding element 5E (add the following): A Deed of Consolidation must be recorded for the 2 lots shown on the development plan. A copy of the recorded instrument shall be submitted to Planning and Design Services. Transmittal of approved plans to the office responsible for permit issuance will occur ony after the receipt of said instrument, be approved. The motion carried unanimously. Yes: 9- Brown, Howard, Smith, Carlson, Ferguson, Peterson, Tomes, Lewis, and Jarboe Absent: 1- Gazaway A motion was made by Commissioner Brown, seconded by Commissioner Peterson, that Case No. 16ZONE1067, a Detailed District Development Plan and proposed binding elements with changes to number 9 as follows: The materials and design of proposed structures shall be substantially the same as depicted in rendering(s) as presented at the February 16, 2017 Planning Commission public hearing. A detail of the elevation and materials shall be provided to staff for review for approval prior to issuance of building permits, be approved. The motion carried unanimously. The motion carried unanimously. Yes: 9- Brown, Howard, Smith, Carlson, Ferguson, Peterson, Tomes, Lewis, and Jarboe Absent: 1- Gazaway A motion was made by Commissioner Howard, seconded by Commissioner Peterson, that Case No. 16ZONE1068, a conditional use permit for use as a mini-warehouse, a waiver of the Land Development Code section 4.2.35.B conditional use requirement for a 30 foot landscape buffer area along property lines adjoining R-4 properties and a waiver of the Land Development Code 4.2.35G conditional use requirement limiting the building height to 15 feet, be approved. The motion carried unanimously. Yes: 9- Brown, Howard, Smith, Carlson, Ferguson, Peterson, Tomes, Lewis, and Jarboe Absent: 1- Gazaway A motion was made by Commissioner Howard, seconded by Commissioner Peterson, that Case No. 16ZONE1068, a Revised District Development Plan with waivers from the Land Development Code section 10.2.4/table 10.2.2 requiring a 30 foot landscape buffer area along property lines adjoining R-4 properties, section 10.2.10 requiring a 10 foot landscape buffer area along Freys Hill Rd. and binding elements with changes to binding element number 11, be approved.
