Yes: 9- Brown, Howard, Smith, Carlson, Gazaway, Ferguson, Peterson, Tomes, and Jarboe Absent: 1- Lewis A motion was made by Commissioner Brown, seconded by Commissioner Carlson, that Case No. 16ZONE1050, a Detailed District Development Plan; a waiver from chapter 10, part 2, table 10.2.4 to not provide a property perimeter landscape buffer area for the side of the duplex property; a waiver from chapter 10, part 2, table section 10.2.10 to not provided a 5 foot vehicular use area landscape buffer area for the 2 parking spaces at the rear of the duplex property; and binding elements with the addition of the hours of operation - Sun. through Thurs. 8:00 a.m. to 11 p.m. - Fri. and Sat. 8:00 a.m. to 1:00 a.m., ON CONDITION that the applicant will provide construciton plans, bond and permit for all work within the public right-of-way prior to final transmittal from Metro Council, be approved. The motion carried unanimously.
