Commercial-Neighborhood, and Conditional Use Permit

A motion was made by Commissioner Brown, seconded by Commissioner
Peterson that this Planning Case be RECOMMENDED to Metro Council for
approval of the zoning change from R-4 Single Family Residential to C-N
Commercial Neighborhood. The applicant will update the legal description to
include the access road as part of the C-N rezoning. The motion carried by the
following vote and the Ordinance was sent to the Consent Calendar:
Yes: 6- Brown, Carlson, Ferguson, Peterson, Lewis, and Jarboe
Absent: 4- Howard, Smith, Tomes, and Lindsey
A motion was made by Commissioner Brown, seconded by Commissioner
Peterson, that this Planning Case conditional use permit for a senior living
facility on 3.4 acres be approved. The motion carried by the following vote and
the Ordinance was sent to the Consent Calendar:

Planning Commission Action Summary November 6, 2017
A motion was made by Commissioner Brown, seconded by Commissioner
Peterson that this Planning Case, a variance from table 5.3.2 within section
5.3.1 to allow the maximum front setback to be exceeded for the proposed
buildings on tracts 1 and 2 and the Detailed District Development Plan with
proposed binding elements and on condition that the plan is updated to reflect
the new zoning line for the C-N zoning on tract 2 and to add the 5X12 foot
boarding area near Crossgate Ln. and Brownsboro Rd. as outlined in the staff
report. Also, an additional binding element 10 to read as follows: The
owner/developer will construct a 5X12 boarding area on Brownsboro Rd. at
Crossgate Ln. between the sidewalk and the curb/edge of pavement and
install upon it a bench and trash receptacle. The owner/developer will
maintain the transit stop and empty the trash receptacle on an as needed
basis, be approved. The motion carried by the following vote and the
Ordinance was sent to the Consent Calendar:
