A motion was made by Commissioner Brown, seconded by Commissioner
Howard, that this Planning Case: a waiver of section 10.2.4 to eliminate the
required property perimeter buffer areas on both east and west property lines;
a Detailed District Development Plan; and binding elements with the
elimination of binding elements 9 and 10 and a change to binding element
number 1 as follows: The development shall be in accordance witht the
approved district development plan, all applicable sections of the Land
Development Code and agreed upon binding elements unless amended
pursuant to the Land Development Code. Any changes/additions/alterations to
the use or of any binding element shall be submitted to the Planning
Commission and/or Planning Commission designee review and approval; any
changes/additions/alterations not so referred shall not be valid; and a
Condition of Approval added to the development plan as follows:
Landscaping be provided comparable to the landscaping on the abutting
properties in the area, be approved. The motion carried by the following vote
and the Ordinance was sent to the Consent Calendar:
