Howard, that the Variance from the Land Development Code, section 5.3.1.C.5
to reduce the required 30 foot setback at the rear property to 5 feet be
approved. The motion carried by the following vote and an abstention by
Commissioner Daniels.

A motion was made by Commissioner Brown, seconded by Commissioner
Howard, that Waiver 1 - Waiver of the Land Development Code, section
5.5.2.A.1 to not provide windows along the primary facade; Waiver 2 - Waiver
of Land Development Code, section 10.2.2 to reduce 25 foot landscape buffer
area to 5 feet along the rear property line; and Waiver 3 - Waiver of Land
Development Code, section 10.2.4.B.3 to allow for easement/landscape buffer
area to overlap, be approved. The motion carried by the following vote with
an abstention from Commissioner Daniels.
