Howard, that a Variance from the Land Development Code section 5.3.1.C.5 to
allow parking encroachments into 30 feet non-residential to residential setback
(north property line) as shown on the development Plan and a Variance from
the Land Development Code section 5.3.1.C.5 to allow the building to exceed
the maximum 95 foot setback as shown on the development plan and a
Variance from the Land Development Code section 5.3.1.C.5 to allow the
building to exceed 30 feet with a maximum height of 49.5 feet be approved.

Howard, that a waiver of the Land Development Code section 5.8.1 to not
provide the required sidewalk along Smyrna Parkway be approved. The

A motion was made by Commissioner Carlson, seconded by Commissioner
Robinson, that the Detailed District Development Plan and binding elements
with the following additional binding elements: 7. Generator testing shall not
occur before 8:00 a.m. and no later than 10:00 p.m. Monday through Friday
and all testing shall be for the minimum time required by the applicable codes
and manufacturers recommendations; 8. Evergreen plantings at the rear of the
subject site shall be installed at a height of 8-10 feet, be approved. The motion
carried by the following vote:
