The motion carried by the following vote: Yes: 7- Tomes, Peterson, Daniels, Brown, Howard, Carlson, and Jarboe Absent: 3- Robinson, Smith, and Lewis A motion was made by Commissioner Brown, seconded by Commissioner Howard, that the Revised Detailed District Development Plan, abandoning the existing binding elements and adopting the proposed binding elements with elimination of BE9 and revision to BE8 as follows: Office hours for veterinarian care shall be limited to 6 a.m. - 9 p.m., although emergency veterinarian services and animal care may occur at any time as necessary, be approved. The motion carried by the following vote: Yes: 6- Tomes, Peterson, Brown, Howard, Carlson, and Jarboe Absent: 3- Robinson, Smith, and Lewis Abstain: 1- Daniels A motion was made by Commissioner Brown, seconded by Commissioner Carlson, that a waiver of the Land Development Code (LDC), section 10.2.4 to reduce the required 15 foot landscape buffer area adjacent to the railroad right-of-way and a variance from the LDC, section 5.1.12 to allow height in excess of the infill established range be approved. The motion carried by the following vote: Yes: 7- Tomes, Peterson, Daniels, Brown, Howard, Carlson, and Jarboe Absent: 3- Robinson, Smith, and Lewis A motion was made by Commissioner Brown, seconded by Commissioner Carlson, that the Detailed District Development Plan with alternative site design and proposed binding elements with an additional BE7 as follows: Bricks within the driveway approach to be removed shall be salvaged and delivered to Public Works prior to bond release, be approved.
