Roll Call Chair Person James introduced the committee members present. A quorum was established. O-398-16 AN ORDINANCE AMENDING SECTION 115.451 OF THE LOUISVILLE/ JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES RELATING TO REMOVAL OF VEHICLES BY PRIVATE TOW OPERATORS; FEE LIMITS. Committee Member Flood spoke to the item. A motion was made by Committee Member Flood, seconded by Vice Chair Peden, that this amended Ordinance be amended by substitution as read into the record by Committee Member Flood. The motion to amend by substitution carried by a voice vote. Sarah Martin, Jefferson County Attorney's Office, spoke to the item and also stated the amendments just read into the record by Committee Member Flood were approved by the committee at the previous committee meeting. She then referenced and explained the correct proposed amendment document (see attached). A motion was made by Vice Chair Peden, seconded by Committee Member Flood, that this amended Ordinance be amended by substitution with the correct proposed amendment document (see attached). Committee Member Flood explained that the correct proposed amendment document (see attached) referenced by Sarah Martin, Jefferson County Attorney's Office, is the document she intended to move for the amendment by substitution. Angela Downes, Emergency Services, and Mindy Glenn, MetroSafe, spoke to the item. A motion was made by Committee Member Leet, seconded by Committee Member Sexton Smith, that this amended Ordinance be tabled. The motion carried without objection. A motion was made by Committee Member Leet, seconded by Committee Member Sexton Smith, that this amended Ordinance be untabled. The motion carried without objection. Louisville Metro Government Page 2 Public Safety Committee Action Summary - Final March 29, 2017 A motion was made by Vice Chair Peden, seconded by Committee Member Denton, that this amendment by substitution be amended by replacing proposed Section 115.455(C) with the following language: "Private tow operator shall notify the registered owner of the motor vehicle by registered mail to the name and address obtained from the Jefferson County Clerk’s Office. Private tow operators must also comply with state notification requirements under KRS § 376.275." The motion to amend the amendment by substitution carried by a voice vote. The motion to amend by substitution the amended Ordinance carried by a voice vote. A motion was made by Committee Member Flood, seconded by Committee Member Leet, that this amended Ordinance be amended by adding a new Section V in this Ordinance which will replace the first sentence of Section 115.999(J) of the Louisville Metro Code of Ordinances with the following language: "Any person who violates §§ 115.450 through 115.458 shall be punished as follows: for the first violation a minimum civil penalty of $150 or a maximum civil penalty of $200; for the second violation within a period of 24 months of the date of the first violation, a minimum civil penalty fine of $200 or a maximum civil penalty of $250; and for any additional violations after the date of a second violation within a period of 24 months from the date of a first violation, a minimum civil penalty of $250 and a maximum civil penalty of $300." The motion to amend carried by a voice vote. The motion to recommend for approval carried by the following vote and the amended Ordinance was sent to Old Business: Yes: 6- James, Peden, Sexton Smith, Leet, Denton, and Flood Absent: 1- Green Adjournment Without objection, Chair Person James adjourned the meeting at 4:34 p.m. *NOTE: Items sent to the Consent Calendar or Old Business will be heard before the full Council at the Metro Council Meeting on April 13, 2017.
