Call to Order The meeting was called to order at 6:06 p.m. Mount Moriah AME Church Associate Member Minister, Rose Houston gave an invocation and Vice Mayor Wade led the Pledge of Allegiance. 2. Roll Call Mayor Nancy Smith joined the meeting telephonically. Present: 7 - Councilmember AnnaMarie Knorr, Councilmember Vincent Manfredi, Mayor Nancy Smith, Councilmember Bob Marsh, Councilmember Amber Liermann, Councilmember Eric Goettl and Vice Mayor Henry Wade 3. Proclamations, Acknowledgements, Awards and Presentations There were no proclamations, acknowledgements, awards or presentations. 4. Report from the Mayor Councilmember Marsh reported attending a meeting of the State Transportation Board in Surprise where State Route 347 (SR 347) was discussed. He shared the meeting was well attended by Maricopa, who spoke on their favorite topic, SR 347, and he stated that he thinks the Transportation Board got the message. He reported attending the Pinal Partnership Water Resources Committee meeting on February 24. Next, He reported attending the Pinal Partnership Government Relations Committee Meeting on February 25. He reported participating in a market research focus group with 10 other Phoenix area city leaders for the State Board of Regents. He reported participating on the Board of Adjustment and Appeals at the county level on February 27 where several cases and one appeal were processed. Lastly, he reported attending the Annual Master Gardeners Plant Sale at the University of Arizona Agricultural Center. Councilmember Liermann publicly recognized Maricopa’s Public Safety Departments. She specifically thanked Maricopa Police Department for being heroes as they put their lives on the line for us every single day, while sending continuous prayers to the officer who was injured in the line of duty. She also acknowledged Maricopa Fire Department celebrating their 20-year anniversary. She reported attending their anniversary ceremony this past weekend and shared a story she heard there about the City of Maricopa Page 1 City Council Regular Meeting Meeting Minutes - Final March 4, 2025 early years of the Fire Department where Maricopa turned down the idea of a single fire truck and paid volunteers being the city’s entire fire department. Mayor Smith provided an update on efforts to secure funding for SR 347 improvements. She reported attending a recent senate meeting with a group of residents to advocate for Senate Bill 1617, which moves $49 Million from February 2028 to February 2026. She reported if the bill passed, it would allow for the bid to go out for the Riggs overpass project. She also attended a house meeting to support House Bill 2057, which would allocate $16 Million to 347 improvements. The bill was presented by Representative Lopez and shared that bill passed its third reading. She reported the same individuals attended the State Transportation Board Meeting in Surprise to speak on the importance of 347 improvements being on the state’s five-year plan. She encouraged the city to create a newsletter with this information, while encouraging residents to provide public feedback on ADOT's 5-year transportation plan to emphasize the importance of SR 347 improvements. Vice-Mayor Wade reported that he was able to throw out the first pitch alongside the Chief, Mark Goodman, for the Maricopa softball and baseball leagues. He acknowledged how respectful all the children were towards their parents during the entire event and thanked Chief Goodman for attending with him. 5. Report from the City Manager City Manager Bitter yielded his time to City Clerk Vanessa Bueras, who announced that Deputy City Clerk Adriana Carpio had accepted a position as City Clerk for Casa Grande after 12 years of service to Maricopa. She thanked Adriana for her service and wished her well in her new role. 6. Call to the Public Peggy Chapados addressed the Council to thank the Maricopa Police Department and Fire Department for their service, especially considering recent challenging events. She expressed her disappointment, but also her support for the Council's decision not to move forward with the Arts Center in the old police headquarters building, suggesting the space could instead be used as an economic development services center. Ms. Chapados encouraged continued recognition and support for public safety personnel. 7. Consent Agenda 7.3 CON 25-06 The Mayor and City Council shall discuss and take action on approval of Consent to Sublease and Leaseback between Verizon Wireless, LLC and ATC Sequoia, LLC, for a cellular tower erected on City owned property located at 18800 N. Porter Road and authorizing the City Manager to execute any future consents to sublease related to this tower. Discussion and Action. A motion was made by Councilmember Goettl, seconded by Councilmember Marsh, that this Contract be Tabled. The motion carried by a unanimous vote. Approval of the Consent Agenda A motion was made by Councilmember Bob Marsh, seconded by Councilmember AnnaMarie Knorr, to Adopt the Consent Agenda.The motion carried unanimously. City of Maricopa Page 2 City Council Regular Meeting Meeting Minutes - Final March 4, 2025 7.1 MISC 25-02 The Mayor and City Council shall discuss and take action to approve the Special Warranty Deed from the Tortosa Homeowners Association for public roadway and utility purposes along the Honeycutt Road median, east of Hartman Road. Discussion and Action. This Miscellaneous Item was Approved. 7.2 RES 25-09 A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, supporting the submission of a grant application to the Gila River Indian Community for MCAASA dba Be Awesome and agreeing to act as the designated fiscal agent of such funding. Discussion and Action. This Resolution was Approved. 7.4 CON 25-07 The Mayor and City Council shall discuss and take action on authorizing the City Manager to execute a Lift Station Easement Agreement with Global Water - Palo Verde Utilities, Inc., an Arizona corporation. Discussion and Action. This Contract was Approved. 7.5 ORD 25-02 An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, amending the zoning map as described in Zoning Case ZON25-02 for the Zzeek's Rezone which is approximately 2.93-acres generally situated east of the southeast corner of N. Porter Rd. and W. Honeycutt Rd. within the Maricopa incorporated limits. The parcels of land are situated in a portion of Section 25, Township 4 South, Range 3 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona. Discussion and Action. This Ordinance was Approved. 7.6 CON 25-08 The Mayor and City Council shall discuss and take action to approve the First Amendment to Promissory Note with BEA 1031 Exchange, LLC as Qualified Intermediary FBO James A. Smith and Diana D. Smith, as Co-Trustees of The JD Smith Living Trust dated June 5, 2013 in the amount of $4,358,769.06 and authorize City Manager Ben Bitter to execute the amendment. Discussion and Action. This Contract was Approved. 7.7 MIN 25-12 Approval of Minutes from the February 18, 2025 City Council Regular meeting. Discussion and Action. These minutes were Approved. 7.8 LIQ 25-03 The Mayor and City Council shall discuss and take action on recommending approval to the Arizona Department of Liquor License and Control regarding an application for a liquor license submitted by applicant Charles Ross Ciraolo on behalf of Maricopa Moose Lodge located at 40521 W. Magnolia Road, Building B, Maricopa, Arizona 85138. Discussion and Action. This Liquor License was Approved. 8. Regular Agenda and/or Public Hearings 8.1 PRES 25-05 The Mayor and City Council shall hear a 2024 Maricopa Police Department Annual Report Presentation from Police Chief Mark Goodman. Discussion Only. City of Maricopa Page 3 City Council Regular Meeting Meeting Minutes - Final March 4, 2025 Chief Goodman presented the Maricopa Police Department's 2024 annual report. He highlighted the department's new police building and emergency communications center, noting it would meet the city's needs for the next decade. Chief Goodman reported on call volume, response times, and the launch of a new mental health program embedding professionals in the communications center. He discussed staffing levels, community engagement efforts, and partnerships with other agencies. Council members expressed appreciation for the department's work and Chief Goodman's leadership. They noted Maricopa's recent ranking as the safest small town in Arizona and praised the collaboration between police and fire departments. Chief Goodman emphasized the department's focus on community policing and creating a family-oriented culture among officers. Mayor Smith thanked Chief Goodman for the detailed presentation and for quickly responding to resident concerns about traffic issues. She highlighted the value of the annual report in tracking crime trends and department performance over time. The Presentation was heard. 9. Executive Session There was no executive session. 10. If you wish to speak on a matter concerning Maricopa city government that is on the agenda, please fill out a speaker card and give it to the City Clerk before the meeting starts. The Mayor will call your name when that portion of the agenda is reached. The Call to the Public portion on the agenda provides citizens an opportunity to identify for the City Council matters of interest or concern related to city government that are not on the printed agenda. Under the provisions of the Arizona Open Meeting Law, the City Council is prohibited from responding to issues that have not been properly noticed. Therefore, the City Council may only listen to citizens who wish to address them on non-agenda items. We regret that the City Council cannot respond beyond thanking you for your comments. City staff will follow-up on your questions via telephone or email, whichever is preferred. A speaker card is not required for this portion of the meeting but it is appreciated. Whenever any group of persons wishes to address the City Council on the same subject matter, it shall be proper for the Mayor to request that a spokesperson be chosen. The City asks that, when your name is called, you come forward to the podium, state your name and then begin speaking. All speakers are expected to observe common standards of decorum and courtesy. Personal attacks, political speeches, or threats of political action are inappropriate in this forum and will be grounds, at the discretion of the Mayor, for ending a speaker's time at the podium. In the event that the meeting is disrupted in any way that the City in its sole discretion deems inappropriate, the City reserves the right to immediately remove the individual(s) from the meeting. Reasons for removing an individual include but are not limited to making offensive remarks or statements, disrespectful statements or actions, and any other action deemed appropriate. All remarks shall be addressed to the City Council as a body and not to staff or the public. No person other than a member of the City Council, the City Manager or the City Attorney and the person having the floor, shall be permitted to enter into any discussion without the permission of the Mayor. Depending on the number of items on the Council agenda and the number of speaker cards submitted, the Mayor may establish shorter time limits for speakers. Call to the Public The procedures to follow if you address the Council are: Council requests that you express your ideas in three minutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellow citizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever they deem such an action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public, individual members of the Council may respond to criticism made by those who have addressed the Council, may ask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of the Council shall not discuss or take legal action on any matters during an open call to the public unless the matters are properly noticed for discussion and legal action. Finally, a word on decorum at our meetings. Periodically, we may want to applaud a success or show our approval of a comment and occasionally, we may personally disagree with something that is said. However, when we’re hearing input from our City Council and our residents, whether we support their comments or disagree with their comments, please do not applaud or negatively respond to a speaker unless invited to do so by the presiding authority. It is important that every person who addresses the City Council has a right to speak and not be intimidated. 7. Consent Agenda All items on the Consent Agenda are considered to be routine matters and will be enacted by one motion of the Council.
