VISION STATEMENT Marina will grow and mature from a small town bedroom community to a small city which is diversified, vibrant and through positive relationships with regional agencies, self-sufficient. The City will develop in a way that insulates it from the negative impacts of urban sprawl to become a desirable residential and business community in a natural setting. July 12, 2026 Item No. 4a Honorable Mayor and Members City Council Special Meeting of the Marina City Council of July 15, 2026 CITY COUNCIL CONSIDERS ADOPTING RESOLUTION NO. 2026-, AUTHORIZING STAFF TO PROCEED WITH THE PUBLIC BIDDING PROCESS FOR THE REHABILITATE RUNWAY 11-29 PROJECT AT MARINA MUNICIPAL AIRPORT REQUEST: It is requested that the City Council consider: 1. Adopting Resolution No. 2026-, authorizing staff to proceed with the public bidding process for the “Rehabilitate Runway 11-29” project at Marina Municipal Airport. BACKGROUND: On October 1, 2025, City of Marina Airport staff met with representatives from the Federal Aviation Administration (FAA) Airport District Office to review and update the Airport Capital Improvement Plan (ACIP) for FAA grant-funded airport improvement projects. As part of this effort, staff are seeking authorization to proceed with public bidding process for the Fiscal Year 2026 designated project, Rehabilitate Runway 11-29, at Marina Municipal Airport. The City of Marina continues to pursue FAA Airport Improvement Program (AIP) grant funding for eligible airfield improvement projects identified in the ACIP. The proposed Runway 11-29 Rehabilitation Project is a high-priority pavement preservation and maintenance initiative designed to extend the useful life of the runway pavement and ensure the continued safe operation of aircraft at Marina Municipal Airport. Tartaglia Engineering has completed the construction plans, technical specifications, and contract documents required to advertise the project for public bidding and proceed with project implementation upon receipt of grant funding. ANALYSIS: The project generally consists of rehabilitating the full length and width of Runway 11-29. The construction scope includes the removal of existing pavement markings within the project limits, crack filling and sealing, application of an asphalt emulsion seal coat, and installation of new pavement markings. The project will be bid under a single bid schedule with no additive or deductive alternates. The proposed improvements are intended to preserve and maintain the operational integrity of Runway 11-29 by addressing surface deterioration and extending the useful life of the pavement. Upon completion, the project will enhance airfield safety, reduce long-term maintenance costs, and support continued compliance with FAA design and operational standards. The project is included in the current Airport Capital Improvement Plan (ACIP) on file with the FAA. Subject to City Council authorization, staff will proceed with advertising the project for public bidding in accordance with applicable state and federal procurement requirements. FISCAL IMPACT: The estimated construction cost for the project is $365,000 and will be included as part of the total project costs, which are anticipated to be funded primarily through a Federal Aviation Administration (FAA) Airport Infrastructure Grant (AIG). Including a 10% contingency, the total estimated construction cost is $401,500. The FAA grant is anticipated to provide funding of up to $381,425, representing 95% of eligible project costs, with the remaining $20,075 to be funded by California Department of Transportation in the amount of $19,071.25 (5%) and the City of Marina in the amount of $1,003.75 (.25%). CONCLUSION: This request is submitted for City Council consideration and possible action. Respectfully submitted, _______________________ Adarian “AJ” Lawson Airport Manager City of Marina REVIEWED/CONCUR: _____________________________ Layne Long City Manager City of Marina RESOLUTION NO. 2026- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARINA AUTHORIZING STAFF TO PROCEED WITH THE PUBLIC BIDDING PROCESS FOR THE REHABILITATE RUNWAY 11-29 PROJECT AT MARINA MUNICIPAL AIRPORT WHEREAS, the City of Marina maintains Marina Municipal Airport and continues to pursue eligible airport improvement projects through the Federal Aviation Administration (FAA) Airport Improvement Program (AIP); and; WHEREAS, the “Rehabilitate Runway 11-29” project has been identified as a priority airfield pavement preservation project within the Airport Capital Improvement Plan (ACIP); and; WHEREAS, the project generally includes rehabilitation of the full-length, full-width surface of Runway 11-29, including pavement marking removal, crack filling and sealing, application of an asphalt emulsion seal coat, and application of new pavement markings; and; WHEREAS, Tartaglia Engineering has prepared the construction plans, specifications, and contract documents necessary for the public bidding process in accordance with FAA requirements; and; WHEREAS, the work is presented in a single bid schedule with no additive or deductive alternates; and; WHEREAS, the estimated construction cost is anticipated to be funded primarily through a Federal Aviation Administration (FAA) Airport Infrastructure Grant (AIG), which is expected to provide up to $381,425, representing 95 percent of eligible project costs, with the remaining $20,075 to be funded through a grant from the California Department of Transportation (Caltrans), Division of Aeronautics, in the amount of $19,071.25, and a local matching contribution from the City of Marina in the amount of $1,003.75; and WHEREAS, the City Council finds that proceeding with the public bidding process is in the best interest of the City and necessary to facilitate timely completion of the project. Delgado, Mayor ATTEST: ______________________________ Anita Sharp, Deputy City Clerk July 15, 2026 Item No. 5a Honorable Mayor and Members City Council Meeting of the City Council of July 15, 2026 CITY COUNCIL CONSIDER ADOPTING RESOLUTION NO. 2026-, WHICH WOULD AMEND THE BALLOT QUESTION FOR THE PROPOSED UTILITY USERS TAX ORDINANCE THAT THE CITY COUNCIL PREVIOUSLY PLACED ON THE BALLOT FOR THE NOVEMBER 3, 2026, GENERAL MUNICIPAL ELECTION RECOMMENDATION: It is recommended that the City Council adopt: 1. Resolution No. 2026-, which would amend the ballot question for the proposed Utility Users Tax Ordinance that the City Council previously placed on the ballot for the November 3, 2026, general municipal election, pursuant to Resolution No. 2026-100. BACKGROUND: On July 7, 2026, the Council adopted Resolution No. 2026-100, which placed a proposed Utility Users Tax Ordinance on the ballot for the November 3, 2026, general municipal election. The Council also directed staff to return to the Council with proposed revisions to the ballot question and to draft language for potentially adding a sunset provision to the tax. Staff met internally to draft proposed changes responsive to Council member concerns and then subsequently discussed those proposed changes with Mayor Delgado and Council Member Biala. Based on those discussions, staff are recommending the changes to the ballot question shown below. ANALYSIS The revised proposed ballot question, which is exactly at the 75-word maximum word count allowed under state law, is as follows: MARINA 911 EMERGENCY, PUBLIC SAFETY, AND COMMUNITY SERVICES MEASURE. To ensure firefighters, EMTs, police officers, YES emergency operations, response to emergencies and/ natural disasters including, emergency operations during an earthquakes; maintain safe/clean drinking water; repair streets/potholes; prevent disruptions to City services; repair and upgrade police/fire/city buildings; protect water supply; repair streets/potholes; and provide general city municipal services, shall NO the City of Marina’s measure establishing a 7% utility users’ tax with low-income rates, generating approximately $3,830,000 annually until ended by voters, requiring spending disclosures, audits, all funds spent locally, be adopted? (A clean copy of the proposed ballot question without strikethrough appears in the accompanying proposed resolution.) In staff’s view, this revised proposed ballot question best addresses the concerns expressed by Council members as well as the various legal and practical constraints governing ballot questions. 1 1 As a legal matter, because the UUT ordinance is being proposed as a general tax, the revenues generated by the tax must be available for general city purposes and the ballot question must inform the voters of this fact. The Council may in the future decide to issue bonds for specific purposes such as the construction of police and fire buildings and city hall, which as a practical matter could be paid for through additional revenue generated by the tax. But the ballot question itself cannot limit the revenue for that purposes. The ballot question must also be impartial. As a practical matter, the 75-word ballot question cannot address every potential use of the revenue generated by the tax. However, staff believe the proposed question accurately addresses the types of concerns that Marina residents have indicated they are most concerned about, while still describing the tax in an impartial manner. Additionally, staff does not recommend a sunset for the tax measure. As a result, the proposed ballot question retains the language specifying that the measure would remain in effect until ended by the voters. Pursuant to City Council Resolution No. 2023-68, Rule 15, this Resolution may be adopted by a simple majority vote. Future Actions If Council adopts the resolution, and the voters approve the UUT measure, no further action is needed from Council with the exception of certifying the election results. FISCAL IMPACT: There is no fiscal impact currently, other than the costs of the election. If the voters approve the tax measure, the tax measure would generate substantial additional revenues, projected to be approximately $3.83 million annually. CONCLUSION: Staff recommends that Council adopt Resolution No. 2026-__. ATTACHMENTS: 1. Ortega City Attorney City of Marina 2 2 RESOLUTION NO. 2026- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARINA AMENDING THE BALLOT QUESTION FOR THE UTILITY USERS’ TAX MEASURE PREVIOUSLY PLACED ON THE NOVEMBER 3, 2026, GENERAL MUNICIPAL ELECTION BY RESOLUTION NO. 2026-100 WHEREAS, a general municipal election has been called on Tuesday, November 3, 2026, by Resolution No. 2026-71, adopted on June 16, 2026; and WHEREAS, on July 7, 2026, the City Council adopted Resolution No. 2026-100, placing on that same November 3, 2026, election the proposed Marina 911 Emergency, Public Safety, and Community Services Measure (“Measure”), which if approved by the voters would impose a 7% Utility Users’ Tax as a general tax; WHEREAS, the City Council wishes to amend the form of the ballot question for the Measure; and WHEREAS, Elections Code section 9605 authorizes the City Council to amend that ballot question up until the 83rd day prior to the election (which is August 12, 2026); and WHEREAS, Resolution No. 2023-68, Rule 15 authorizes the City Council to adopt this Resolution by majority vote; WHEREAS, on the basis of the foregoing, the City Council has determined it is appropriate to amend the ballot question for the Measure; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Marina as follows: Section 1. Amended Ballot Question That the City Council, pursuant to its right and authority, does order amended Section 1 of Resolution No. 2026-100, to amend the ballot question on the Measure that will be submitted to the voters of the City of Marina at the general municipal election on November 3, 2026, so that the ballot question will read as follows: MARINA 911 EMERGENCY, PUBLIC SAFETY, AND COMMUNITY YES SERVICES MEASURE. In addition, the City Manager and/or his designees are authorized and directed to do any and all things and to execute, deliver, and perform any and all agreements and documents that they deem necessary or advisable in order to effectuate the purposes of this Resolution. Section 4. Certification The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
