1. 221948 Resolution removing deed restrictions from a former tax-deed vacant lot at 433 West
Brown Street, in the 6th Aldermanic District.
Whereas, The City of Milwaukee (“City”) conveyed to In-Place Machining Co. Inc. a
tax-deed vacant lot at 433 West Brown Street (“City Lot”) on June 15, 1982; and
Whereas, The Deed contains restrictions that the City Lot be used as green space and
that no conveyance may occur without Common Council of the City of Milwaukee
(“Common Council”) approval (collectively “Deed Restrictions”); and
Whereas, The Deed Restrictions cannot be released except upon approval of the
Common Council; and
Whereas, Light Ray Development, LLC, the current owner of the property, has
requested the release of the Deed Restrictions in order to pursue a sale for future
development; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Deed
Restrictions for the City Lot contained in the Deed are hereby released, waived and

disclaimed; and, be it
Further Resolved, That the Commissioner of the Department of City Development, or
designee, is authorized to execute the necessary legal document(s) to release, waive

Ald. Brostoff moved that the Council go into a Committee of the whole. There

Ald. Brostoff escorted Ken Leinbach from the Urban Ecology Center
commending him for his service, upon his retirement.
Ald. Spiker escorted Terry MacDonald, retiring city clerk employee, to thank her
for her many years of service.
Ald. Bauman moved that the Committee reconvene into the Council. There
were no objections.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 115-4-5 of the code is amended to read:
115-4. Granting of Permits.
5. Whenever a permit for excavation or installation in a public way or public place is
granted, the permit holder shall, as a condition of permit issuance, be required to serve
written notice of the impending excavation or installation work to each occupant of
abutting private property at least [[48]] >>72<< hours prior to commencement of

work if the excavation or installation will be in progress for more than [[96]] >>24<<
hours, impede or obstruct access to abutting private property, or result in interruption
of utility service to abutting private property. >>If work will be in progress for more
than 96 hours, the<< [[The]] commissioner shall provide similar notice to the common
council member in whose district the excavation or installation work will occur. The
notice >>to the abutting property owners<< shall include a name and telephone
number of a person who is affiliated with the permit holder and directly responsible for
and knowledgeable of the work to be performed. >>The notice shall identify the type
of work to be performed and the estimated duration of the work. A color photograph
or video shall be taken by the permit holder or person affiliated with the permit holder
of the written notice being served. Photographs and video recordings shall be time and
date-stamped and shall be maintained and made available to the commissioner, or the
commissioner’s designee, upon request. Proper photographs or video-recordings shall
depict written notice being served to the occupants of abutting properties in a clear
and unobstructed perspective, as determined by the commissioner.<< No notification
shall be required for emergency public way excavation, such as but not limited to an
excavation relating to a gas, water or steam leak or an electrical outage, or for an
excavation carried out in conjunction with minor maintenance activities, such as but not
limited to manhole adjustments, hydrant or valve repairs or work on utility services to
individual properties.
Part 2. Section 115-4-6 of the code is created to read:
6. FAILURE TO NOTIFY. If work is started or the public way occupied without
first providing notification as required in sub. 5, any person, firm or corporation
violating this section shall be subject to penalties as provided in s. 115-48.

ADOPTION OF THE FOLLOWING:
6. 221448 Substitute resolution relating to the Clean Water Advisory Council.
Whereas, When faced with drinking water-related public health concerns, the City of
Milwaukee seeks to undertake an integrated approach by sharing technical
information among relevant bodies, analyzing and improving Milwaukee Water

Works’ operations and services, and communicating effectively to customers when
taking action to address emerging water quality concerns; and
Whereas, In 1993 the Common Council adopted File Number 930554, creating a
Clean Water Advisory Council as a result of the Common Council Water Crisis Fact
Finding Committee’s recommendation that such that such a body, holding regular
meetings, be created; and
Whereas, The Advisory Council’s mission was to protect public health by promoting
the regular exchange of information about water quality, and public health-related
science; and
Whereas, The names and responsibilities of many participating agencies of the
Advisory Council have changed since being created; and
Whereas, Modern surveillance tools and reporting requirements, along with
technologies such as email, cellular phones, and video-conferencing, allow health
officials to monitor water quality data and communicate with other officials in
real-time; and
Whereas, The Department of Public Works and Water Works recognize the need to
maintain regular communication and work collaboratively with other departments and
agencies such as the Department of Neighborhood Services, the Milwaukee Health
Department, the Milwaukee Metropolitan Sewerage District, the Wisconsin
Department of Natural Resources, and the Wisconsin Department of Health Services;
now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that Common Council
resolution Number 930554 creating the Clean Water Advisory Council is rescinded;
and, be it
Further Resolved, That the Safe Drinking Water Work Group is established as an ad
hoc work group, which may include representatives of the Administration,
Infrastructure and Water Works Divisions of the Department of Public Works,
Department of Neighborhood Services, Milwaukee Health Department, Milwaukee
Metropolitan Sewerage District, Wisconsin Department of Natural Resources,
Wisconsin Department of Health Services, and other departments, organizations and
individuals as needed; and, be it
Further Resolved, Although the Safe Drinking Water Work Group has no formal
duties, its general mission is to protect public health by promoting the regular exchange
of information about water quality and public health-related science and the resiliency
and preparedness of drinking water infrastructure, and to support Milwaukee Water

facilitate an integrated approach to water quality issues

7. 230032 Resolution relating to the cost participation and installation of traffic control signal
improvements under two Signals and ITS Standalone Program projects at 41
intersections in various Aldermanic Districts at a total estimated cost of $320,832.91
with an estimated grantor share of $288,749.62, and an estimated City share of
$32,083.29.
Whereas, The Project Agreements for the installation of traffic control signal
improvements at 41 intersections was approved by the Common Council under File
Number 220560; and,
Whereas, The Signals and ITS Standalone Program is intended to fund traffic signal
improvements on roadways on the Connecting Highway system; and
Whereas, Forty one intersections have been identified for the installation of larger
twelve inch signals and video vehicle detection; and
Whereas, The installation of video detection is expected to reduce delays for all
roadway users at 7 intersections citywide; and
Whereas, The installation of larger twelve inch signal displays at the 34 intersections
will reduce the frequency and severity of crashes throughout the project area,
particularly right angle and rear end crashes; and
Whereas, The total estimated cost of the two projects is $297,067.51 for the upgrade
of traffic control signals; and
Whereas, The total estimated cost for state review for the project is $23,765.40; and

Whereas, $32,083.29 is not reimbursable and is included in the Division’s 2023
Capital Purpose Project Grant Number ST320230000; and
Whereas, $267,360.76, is reimbursable from the Wisconsin Department of
Transportation, and should be earmarked for this project in the 2023 Capital Grant
and Aids Projects Fund Project Grant Number SP032230100; and
Whereas, $21,388.86, is non-reimbursable from the Wisconsin Department of
Transportation; and
Whereas, The State cannot proceed with any project cost overruns and changes in
scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the
City of Milwaukee at the next scheduled meeting of any such project cost overruns
and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City
may be 100% liable for any such project cost overruns and changes in scope as
approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City
may be liable for any costs incurred by the State should the City decide to withdraw
from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner
of Public Works and the Comptroller are authorized to enter into a funding
agreements and are directed to execute the agreement with the Wisconsin Department
of Transportation for the installation of traffic control signal improvements under two
Signals and ITS Standalone Program projects at 41 intersections with unit prices
based on a predetermined estimate prepared under the Federal State aided highway
program, copies of which are attached to this resolution, and is incorporated into this
resolution as though set forth in full; and be it
Further Resolved, That upon approval of this contract, that the Commissioner of
Public Works is directed to install traffic control improvements at the 41 intersections
identified; and, be it
Further Resolved, That upon approval of this contract, the City Comptroller is hereby
authorized to create within the Capital Grant and Aid Projects Fund the appropriate
Project Grant Chartfield Value for the two projects; and transfer to these accounts the
amount required under the agreement and City accounting policy, but not to exceed a

calming speed hump(s). (Assessable Reconstruction Paving Fund - $1,875;
Nonassessable Reconstruction Paving Fund -- $1,000). The total estimated cost for
this project including the requested amount is $6,500. This project is anticipated to be
completed during the 2023 construction season.

Whereas, The report of the Commissioner of Public Works has been filed with the
City Clerk; and
Whereas, Notices have been sent to all interested persons and public hearings held;
now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner
of Public Works’ Report, as amended at said Public Hearing, is approved and the
properties therein identified are benefited; and, be it
Further Resolved, That said Commissioner of Public Works is authorized and directed
to proceed with said work in accordance with said report pursuant to Section
66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner
directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the proper departments take such action as is required of them
to assess the abutting or adjacent properties and collect such assessment in the
manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the City Comptroller is authorized to transfer such funds which
are available for this purpose to the appropriate capital Project/Grant accounts; and,

23. 221755 Resolution approving the form of the Preliminary Official Statement used in connection
with the sale of City of Milwaukee, Wisconsin, debt.
Whereas, The City Comptroller has prepared a Preliminary Official Statement (the
form of which is attached hereto), and will prepare an Official Statement, for the
purpose of providing comprehensive financial and economic information respecting the
City of Milwaukee in connection with the sale of the City of Milwaukee, Wisconsin,
General Obligation Bonds, Notes, Revenue Anticipation Notes, and/or utility revenue
bonds (individually, an “Offered Obligation”, and collectively, the “Offered
Obligations”); and
Whereas, Financial and economic information has been compiled by the Office of the
Comptroller from its annual financial report, property tax records maintained by the
Assessor's Office and from other books and records of the City; and
Whereas, Concurrently with the delivery of the Offered Obligations, the City will
deliver its certificates signed by its Comptroller stating that the descriptions and
statements, including financial statements, as pertaining to the City contained in the
Official Statements as of their dates and the date of sale and delivery of each Offered
Obligation, were and are true and correct in all material respects and do not contain
an untrue statement of a material fact or omit to state a material fact required to be
included therein or necessary to make the statements contained therein in the light of
circumstances in which they were made not misleading; and
Whereas, Such certificates will further confirm to the effect that insofar as the
descriptions and statements including financial data, contained in the Official
Statements of or pertaining to non-governmental bodies and governmental bodies
other than the City are concerned, such descriptions, statements and data have been
obtained from sources believed by the City to be reliable, and that the City has no
reason to believe that they are untrue or incomplete in any material respect; and
Whereas, It is the intention of the Common Council to approve the aforementioned
Preliminary Official Statement on the basis of the representations of the Comptroller to
be included in the certificates signed by the Comptroller and delivered concurrently
with the delivery of each Offered Obligation; and
Whereas, The City desires to use the Master Continuing Disclosure Certificate
approved by Common Council File Number 181110 adopted on December 18,
2018 in connection with the issuance of the Offered Obligations; now, therefore, be it

S.C., for legal services in the matter of Peden v. City of Milwaukee.
Whereas, On or about September 22, 2020, the City Attorney entered into a
Contract for Legal Services between the City of Milwaukee and Crivello Carlson,
S.C. for representation of Aleah Ellis regarding the claims made against her in Peden
v. City of Milwaukee, et al., Case No. 20-CV-1307 (E.D. Wis.); and
Whereas, The original agreement attached to the file authorized payment in an amount
not to exceed $30,000; and
Whereas, The total cost of legal services has exceeded the prior agreed amounts in
order to get the matter through a motion for summary judgment; and
Whereas, The City desires to pay Crivello Carlson, S.C. for the reasonable costs of
its legal services that it has incurred and will incur in its representation of Aleah Ellis;
now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is
authorized to execute the First Amendment to Contract for Legal Services between

feet of a school during school hours and also moves enforcement from MPD to
DPW parking checkers. Ald. Brostoff does not support this amendment as he
sees the annual review as a means of tweaking the ordinance and DPW is not
supportive due to the work load. Ald. Zamarripa also did not support the
motion as she also sees the annual review as a way to examine the entire
ordinance. Ald. Spiker withdrew his motion.

Part 1. Section 68-1-20 of the code is amended to read:
68-1. Definitions.
20. FOOD ESTABLISHMENT shall have the meaning provided [[in ch. DHS 196,
Appendix,]] >>for “retail food establishment” in ch. ATCP 75,<< Wis. Adm. Code,
as amended. This term shall include any restaurant, food peddler >>vehicle<<, micro
market, community food program, school, college, university, or temporary food
stand.
Part 2. Section 68-1-24 of the code is amended to read:
24. FOOD PEDDLER VEHICLE means any pushed, pedaled, pulled or motorized
vehicle from which food is prepared or sold >>and includes any mobile or transient
retail food establishment licensed under s. ATCP 75.06, Wis. Adm. Code <<.

Part 3. Section 68-37-1 of the code is repealed and recreated to read:
68-37. Food Peddlers.
1. SALES ON THE PUBLIC RIGHT-OF-WAY. a. Findings. The common council
finds food peddler vehicles parked on the public right-of-way in areas where there is a
high concentration of traffic and pedestrian density jeopardize the safety of pedestrians
and drivers, and dangerously increase traffic congestion. The common council further
finds limiting the locations and times these vehicles may park on the public
right-of-way in specified areas contributes to public safety. The common council shall
review annually the ordinances relating to food peddler vehicles. It is the intent of the
common council to work in cooperation with the police department, health
department, and department of public works to administer its food peddler vehicle
program.
b. Definition. For purposes of this subsection, “limited operation food peddler vehicle
zone” means a portion of a public right-of-way designated by the common council for
parking of food peddler vehicles subject to specified limitations. A limited operation
food peddler vehicle zone shall be recorded on a map that may be found in the
common council proceedings. The official record shall be on file in the city clerk’s
office.
c. Locations Restrictions.
c-1. Public Right-of-way. All sales shall be made on the public right-of-way directly
from a food peddler vehicle or a carried container unless one of the following
exemptions is met:
c-1-a. A food peddler is selling food at the invitation of a business owner on private
property provided all sales are made only to employees of the business and not to the
general public.
c-1-b. A food peddler is issued an occupancy permit by the department of
neighborhood services allowing food sales by the food peddler on a private property.
d. Time Restrictions. A food peddler shall not offer for sale or sell food between 3
a.m. and 6 a.m., Monday through Friday, or between 3:30 a.m. and 6 a.m. on
Saturday and Sunday.
e. Limited Operation Food Peddler Vehicle Zone. The department of public works
shall mark a limited operation food peddler vehicle zone by either posting a sign or
painting the designated area.
e-1. Type 1, Time-Limited Food Peddler Vehicle Zone. Notwithstanding sub. d, a
food peddler vehicle that is parked in a type 1 limited operation food peddler vehicle
zone shall not:
e-1-a. Offer for sale or sell food between 1 a.m. and 6 a.m.
e-1-b. Park in that zone for more than 6 hours within a 12-hour time period.
e-2. Type 2, Density-Limited Food Peddler Vehicle Zone. The maximum number of
food peddler vehicles allowed on a block face in a type 2 limited operation food
peddler vehicle zone shall be determined for that specific block based upon density
and traffic safety, as determined by the common council in consultation with the

department of public works and the police department.
e-2-a. Application. Application for a parking space in a type 2 limited operation food
peddler vehicle zone shall be made with the licensing division using an application
established for that purpose. In the first year this ordinance is in effect, applications
shall be filed no later than July 1, 2023, and shall be filed no later than March 1 of
each year thereafter. If granted a parking space, the licensing division shall notify the
applicant of the assignment, and the applicant shall accept the parking space in writing
within 10 calendar days of receiving notification of the assignment or shall forfeit the
assignment. Only one parking space shall be assigned per food peddler vehicle. No
food peddler vehicle may be assigned a space in more than one zone. Parking space
assignments may not be transferred.
e-2-b. Parking Space Assignment Seniority. Parking space assignment shall be
determined by seniority, calculated by counting the number of years a food peddler
has operated in the zone for which the applicant is applying as reported on their
itinerary. Spaces shall be assigned to applicants in order of seniority until all applicants
have been assigned a parking space or until all parking spaces are assigned. If
applicants remain after all parking spaces are assigned, a waiting list shall be created
using the same seniority system.
e-2-c. Additional Points. One year of seniority shall be added for a vehicle that is all
of the following: 12 feet or less in length, 11 feet or less in height, and 7 feet or less in
width, including wheels and all extensions, counter space, foldouts, awnings, or other
contrivances attached to the main body of the food peddler vehicle.
e-2-d. Tie. If more than one food peddler has the same number of years of seniority,
this tie shall be broken using the following criteria, considered in order:
e-2-d-1. Whichever food peddler has been licensed by the City the longest.
e-2-d-2. Whichever food peddler’s average food establishment grade is higher, as
determined by the health department pursuant to s. 68-9-7.
e-2-d-3. Whichever applicant has received the fewest demerits for being disciplined
by the city for offenses relating to the operation of food peddler vehicles. Each
warning letter from the licenses committee shall count as one demerit. Each suspension
of more than 10 days or revocation shall count as 5 demerits.
e-2-d-4. A game of chance administered by the license division.
e-2-e. Waiting List. Late applicants and food peddlers who forfeit their parking space
as provided in subd. e-2-a shall be placed at the bottom of any waiting list. Any
parking space that becomes available after parking space assignments have been
made shall be offered to the highest-ranking food peddler on the waiting list.
f. Special Permission. The common council may grant permission to a food peddler to
park a food peddler vehicle and offer for sale or sell food at a location, on a date, and
during a time period not otherwise authorized by this subsection.
Part 4. Section 68-37-5.5 of the code is created to read:
5.5. LITTER CONTROL. A food peddler operating from a food peddler vehicle

shall provide a sufficient number and capacity of litter receptacles adjacent to the
peddler’s point of sale, and within any area patrons may reasonably be expected to
congregate while eating. A food peddler shall:
a. Regularly monitor any area patrons may reasonably be expected to congregate
while eating during operations, and collect litter found on sidewalks and the public
right-of-way, regardless of the source of the litter.
b. Promptly empty litter receptacles whenever full to minimize litter on sidewalks and
the public right-of-way.
c. Return litter receptacles and litter collected to a home base kitchen at the end of
each day’s operations and properly dispose of collected litter.
Part 5. Section 80-8 of the code is amended to read:
80-8. Notice to Abate Nuisance. It shall be the duty of the commissioner to give
notice in writing to the person, firm or corporation owning, occupying, in charge or
control of any premises >>or vehicle<< wherein a public nuisance shall be, to
forthwith abate and remove the same; and any premises or conditions so described in
ss. 80-6 to 80-7 which shall be so maintained or permitted to exist for a period of 2
hours after reasonable notice in writing, signed by the commissioner, shall have been
given to the person, firm or corporation owning, occupying, in charge or control of the
same, are declared to be public nuisances which shall be forthwith abated.
Part 6. Section 80-44-1 of the code is repealed and recreated to read:
80-44. Dumping. 1. DEFINITION. In this section, “dumping” means either of the
following:
a. Depositing solid waste on public or private property, as defined in s. 79-1-12 in
an amount greater than the capacity of a standard 20-gallon container without the
consent of the property owner.
b. Depositing liquid waste on public or private property, as defined in s. 79-1-6 in
any amount by a food peddler or by the operator of a food peddler vehicle without
the consent of the property owner.
Part 7. Section 92-3-2-c of the code is amended to read:
92-3. License Required; Exceptions.
2. EXCEPTIONS.
c. Any person solely selling food and licensed under ch. 68, or exempted from
licensing under ch. 68. >>This exemption does not apply to any food peddler vehicle
licensed by another municipality or mobile or transient retail food establishment
licensed by the state.<<
Part 8. Section 101-23-9.5 of the code is created to read:

9.5. FOOD PEDDLER VEHICLE ZONE. a. Limited operation food peddler vehicle
zones, as defined in s. 68-37-1-b, shall be established by the common council subject
to the following regulations:
a-1. Width of Roadway. Limited operation food peddler vehicle zones shall be
confined to places alongside the curb and along the center of the street where the
roadway, exclusive of the sidewalk, is 35 feet in width or more.
a-2. Designation. The location of limited operation food peddler vehicle zones shall be
designated by signs attached to posts adjacent to the zones. The location of food
peddler vehicle spaces on a block face within a Type 2 limited operation food peddler
vehicle zone shall be determined by the department of public works in consultation
with the local council member and the police department. These spaces shall be
marked with signage or paint markings.
a-3. Time Limit in Type 1 Time-Limited Zone. A food peddler vehicle shall not park
in a Type 1 time-limited food peddler vehicle zone more than 6 hours in a 12-hour
period, and shall park in the zone only during the hours of operation set forth on the
sign.
a-4. For Food Peddler Vehicles Only. No person shall park, stop or leave standing
any vehicle in a Type 2 density-limited food peddler vehicle parking space except a
food peddler vehicle operating under a permit issued under s. 68-37-1-e-2-a.
a-5. Food Peddler Vehicle Parking by Permit Only. No food peddler vehicle may
park in a Type 2 density-limited food peddler vehicle zone unless operating under a
permit issued under s. 68-37-1-e-2-a and within a designated space.
a-6. Locations. Locations of specific zones are to be found listed in the proceedings of
the common council, the official record on file in the city clerk’s office and the code on
file in the legislative reference bureau.
Part 9. Section 101-23-9.6 of the code is created to read:
9.6. NO PARKING OF FOOD PEDDLER VEHICLES. A food peddler vehicle
shall not be left parked within 50 feet of a restaurant without drive-through facility.
Notwithstanding the foregoing, this provision may be waived by the common council.
Part 10. Section 101-34-2-m of the code is created to read:
101-34. Stipulation or Contestation Procedure; Nonmoving Traffic Violations.
m. Citations issued for violation of s. 101-23-9.5 and 9.6: $50 for the first violation,
$100 for the second violation, $200 for the third violation, and $450 for the fourth and
each subsequent violation.

Part 13. Section 115-45-1 of the code is amended to read:
115-45. Selling Articles from Parked Vehicles.
1. REGULATIONS. >>a. Findings.<< To help protect the safety of pedestrians and
drivers, to help relieve traffic congestion on certain public highways and sidewalks
within the city and to provide for the freer flow of traffic, both vehicular and
pedestrian, on such highways and sidewalks, it is declared to be unlawful for any
operator to park any vehicle on any public highway or sidewalk enumerated
specifically or by area or classification in this section during the periods specified, or
on any public highway or sidewalk within 300 feet thereof, during such periods for the
purpose of offering for sale or selling any articles of any nature whatsoever in a public
manner from such vehicle.
>>b. Specific Streets and Highways Where Selling Prohibited. The public highways,
sidewalks and areas to which this section applies may be found in the common council
proceedings, the official record on file in the city clerk's office, and the code on file in
the legislative reference bureau.<<
Part 14. Section 115-45-2-c of the code is repealed and recreated to read:
115-45. Selling Articles from Parked Vehicles.
2. LOCATIONS WHERE SELLING PROHIBITED.
c. Near Restaurants.
c-1. Within 50 feet of a restaurant without drive-through facility, as defined in s.
295-201-501.
c-2. Notwithstanding the foregoing, subd. 1 may be waived by the common council.

subject Detailed Planned Development, which is restricted to the time limit of 5 years
from the effective date of this ordinance unless the criteria per s.295-907-2-c-11 are
met as referenced in Exhibit A, a copy of which is attached to this Common Council
File which is on file in the office of the City Clerk and made a part as though fully set
forth herein.
(2) The zoning map is amended to change the zoning for the properties located at:
1443 North Prospect Avenue, Tax Key No. 359-0013-113; and 1451 North

Detailed Planned Development (DPD).
(3) The requirements set forth in said detailed plan attached to this Common Council

approval of such detailed plan is that such plan shall limit and control construction,
location, use and operation of all land and structures included within the detailed plan
to all conditions and limitations set forth in such detailed plan.
Part 2. Any persons, firm, company or corporation owning, controlling or managing
any building or premises wherein or whereon there shall be placed or there exists
anything in violation of the terms of this ordinance; or who shall build contrary to the
plans or specifications submitted to and approved by the Commissioner of the
Department of City Development, or any person, firm, company or corporation who
shall omit, neglect or refuse to do any act required in this ordinance shall be subject to
the penalties provided in Section 200-19 of the MCO.

64. 230050 Resolution approving the HaRUNbee 5K Walk/Run for Healthy Birth Outcomes as
part of Bronzeville Week 2023.
Whereas, The Bronzeville Cultural and Entertainment District, located in the area
bounded by Center Street, Garfield Avenue, Dr. Martin Luther King, Jr. Drive and
7th Street, is a redevelopment initiative seeking to create economic development and
vibrancy in this neighborhood; and
Whereas, Bronzeville Week is a celebration of African-American culture, history, art
and entertainment that will take place August 5-12, 2023; and
Whereas, In conjunction with Bronzeville Week, the National Coalition for Healthy
Black Families has organized the HaRUNbee 5K Walk/Run for Healthy Birth
Outcomes, which will be held live, virtually and in-person, on the morning of Saturday,
August 5; and
Whereas, In order to maintain the safety and comfort of participants who would prefer
not to participate in-person, the 2023 HaRUNbee Walk/Run will also take place
virtually, allowing participants to complete the 5K individually, in their own
neighborhoods, on self-designed routes; and
Whereas, The HaRUNbee Walk/Run seeks to raise awareness of and to prevent
infant mortality, a problem that disproportionately affects Milwaukee’s
African-American community; and
Whereas, The HaRUNbee Walk/Run also strives to promote community wellness by
encouraging families to stay healthy and fit, both physically and mentally; and
Whereas, Promoting wellness and encouraging communities to eat healthier and
exercise more will help reduce the risk of infant mortality in Milwaukee; now,

Resolved, By the Common Council of the City of Milwaukee, that the Common

Opportunities for Persons With AIDS (HOPWA) $1,000,000; and
Whereas, The Community Development Grants Administration (CDGA) was notified
by HUD that the actual 2023 funding awards are as follows: CDBG $15,931,961;
HOME $5,921,708; ESG $1,420,425 and HOPWA $1,447,975; and
Whereas, The increase for CDBG is $131,961, an increase for HOME of $421,708,
an increase for ESG of $120,425 and an increase for HOPWA of $447,975. Refer
