Dimitrijevic presiding over the meeting. The question was put: Are there any corrections to the Common Council Journal of Proceedings for the regular meeting of May 31, 2023? There being none, the minutes of the meetings were approved without objection. Alpha Kappa Alpha Sorority Day at City Hall, hosted by Ald. Coggs, and Alpha Kappa Alpha Sorority sisters in attendance were recognized. Ald. Zamarripa moved that the Common Council resolved itself into Committee of the Whole for making presentations. There was no objection. Led by Ald. Zamarripa, Sarah Wallisch and The HIVE LBGQT ERG employee resource group were recognized. Ald. Taylor moved that the Common Council rise from Committee of the Whole. There was no objection. Sponsors: THE CHAIR The question was put: Have the members of the Common Council read the report and recommendations of the Licenses Committee and the exceptions filed under this matter? The report and recommendations for the Nonrenewal of the Parking Lot license based upon the preponderance in the police report that demonstrates the operation results in a threat to health, safety or welfare of the public and the aldermanic testimony; for the premises located at 701 W St. Paul Av. ("Interstate Parking Company # 1148") in the 4th aldermanic district was not before the Common Council. All members of the Common Council indicated reading the report and recommendations of the Licenses Committee and the exceptions filed under this matter. Ald. Coggs moved that the Common Council resolve itself into a Committee of the Whole for the purposes of hearing oral arguments on behalf of the complainant or the licenses in opposition to the report and recommendation and then a statement by the City Attorney. There were no objections. The question was put: Are any of the following or their counsels present and, if so, do they wish to address the Common Council: Davinderjit Kaur? Coggs moved that the committee now rises. There were no objections. Ald. Coggs moved to hold this file until a later point in the meeting to allow legal counsel for Davinderjit Kaur to appear. This item was reconsidered later in the meeting after item 40. Ald. Coggs moved that the Common Council resolve itself into a Committee of the Whole for the purposes of hearing oral arguments on behalf of the complainant or the licenses in opposition to the report and recommendation and then a statement by the City Attorney. There were no objections. The question was put: Are any of the following or their counsels present and, if so, do they wish to address the Common Council: Davinderjit Kaur? Analysis This resolution authorizes and directs the Commissioner of Public Works to execute project agreements with the Wisconsin Department of Transportation for the programming, study, design and construction of bicycle facilities with 80 percent Federal and State aid under the Transportation Alternatives Program (TAP). This resolution also directs the City of Milwaukee Comptroller to transfer funds and establish project grant chartfield values for the preliminary engineering for these projects. The estimated total cost of the projects is $4,930,338 of which the City’s share is $986,068 and the grantor share is $3,944,270. The estimated preliminary engineering cost for these projects is $1,156,068 and an estimated City of Milwaukee share of $231,214 and a grantor share of $924,854. Construction funds for these projects will be included in future resolutions. Body Whereas, The project agreements have been requested from the Wisconsin Department of Transportation to be executed by the City of Milwaukee for the programming, study, design and construction of the following paving projects with Federal and State aid under the Transportation Alternatives Program (TAP): State I.D. 2984-30-01/71 Hopkins Protected Bike Lane Along W. Oklahoma Ave. State I.D. 2984-35-02 South Powerline Trail Planning Study Two We-Energies Corridors; Hale I/C to HAST and Pondview Park to Lake Michigan Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; and Whereas, Construction funds for the projects will be included in a separate resolution; now, therefore, be it Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby directed to execute agreements for the programming, design and construction of the aforementioned projects with Federal and State aid under the Surface Transportation Program, copies of which are attached to Common Council Resolution File Number 230183, and are incorporated in this resolution by reference as though set forth in full; and, be it Further Resolved, That the Commissioner of Public Works is hereby directed to undertake, or engage a consultant to undertake, design engineering for the improvement of the aforementioned projects and to reimburse the Wisconsin Department of Transportation for design engineering costs they incur for the improvement; and, be it Furth Resolved, that the Commissioner of Public Works is hereby authorized and directed to sign documents that are required if right-of-way acquisition is necessary as part of the project work; and, be it Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to enter into an agreement with the Wisconsin City of Milwaukee Page 7 COMMON COUNCIL Meeting Minutes June 20, 2023 Department of Transportation pertaining to the cost participation for the installation and modification of traffic control facilities in conjunction with the improvements of the aforementioned projects; and, be it Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to negotiate and enter into cost sharing agreements with adjacent municipalities for those projects whose project limits extend beyond the City of Milwaukee boundaries; and, be it Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design engineering for the projects (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows: State I.D. 2984-30-01 Hopkins Protected Bike Lane Along W.
