They have been operating past their hours of operation, have illegal music formats
and illegal tables and palm trees on the sidewalk. He does not support a change of
hours. He sees that "Heels" night club has "creeped in" under the banquet license,
which was for weddings and banquet.
Ald. Kovac would suggest holding the sidewalk dining, and close at midnight on

Friday and Saturday, and at 10 p.m. otherwise.

Items 23, 25, 26, 27, 28, 30 and 31 are being contested in court, so any committee
action will not be based upon these items. Asst. City Attorney DeSiato objects as
officers are present to testify, so this matter was left open and the committee will hear
that testimony.
On item #22 in the police report, refers to Marcus Nuell, the licensee's son, not the
licensee. The committee so stipulates.
Ald. Kovac moves to make the binder provided by Atty. Arena part of the record.

Ald. Wade at the table - he is not in support of lowering the age limit.
Captain Jackson said that All Stars continues to be a problem with a number of
violent crimes and continues to use a lot ofpolice resources. He feels that because of
bad management individuals with weapons are able to enter the tavern and there are
numerous incidents of overcapacity - once 98 individuals and once 81 individuals,
and that leads to more fights and escalating violence. His other concern is loitering
outside the establishment. He does not support lowering the age requirement at this
establishment.
Atty. Arena noted that no guns have been fired inside the establishment and that
individuals with guns are removed from the establishment. Item #33 in the police
report actually occurred across the street and All Stars management was unaware of
any problems occurring across the street.
Sgt. Tom Lieske - 7th district - testified that he has gone to the establishment nearly

every weekend for over a year. He has seen, on numerous occassions,
overcapacity, a metal detector that isn't used, nor do they wand individuals and they
miss weapns on pat-downs, which are later found. They have let individuals under 25
into the establishment and have traffic issues after closing. Overcapacity causes
public safety concerns, the possibility that security staff may be overwhelmed, and
overall congestion at closing. He was present when 5 incidents of overcapacity were
ticketed; he feels they were all valid tickets. There were no cases in which it was
suspected they were overcapacity and a full-blown count was done and they weren't
overcapacity. His other concern is letting in individuals in who are under the age of
25.
Atty. Arena noted that a full-blown count isn't verified by a second officer counting as
well. He is concerned that the video surveillance from the bar does not show that
counting procedures were being performed in the manner in which police said they
were being performed. Ms. Nuell says that she has 12 cameras and all of them are
operational. For those 5 nights in which the bar was cited for overcapacity, the
investigator calculated capacity from the video (when available - one night was not
available), and the establishment, per his calculations, was always undercapacity.
The commtttee watched various videos from the establishment'svideo.
Ald. Kovac moved to make the pictures provided by Atty. Arena from the police
department part of the record. Prevailed. 5-0 (Exhibit 2)
Police Officer Brian LaRoque - District 7 - deals with All Stars on a weekly basis. The
establishment does have a parking lot, but customers also park on the street. He has
responded to a shots-fired call after a patron was denied access, an altercation
across the street, and another shots-fired report on three separate occasions.
Security at the establishment did not call police for the last incident,which involved a
patron leaving the establishment. On mutiple occasions, the security guards at the
door didn't know what the patron count was, or what the capacity of the
establishment was. Ms. Nuelll said that that was the first night those security guards
were working.
Supporters:
Marcus Nuell - 8135 W. Mariel Place - oversees All Stars or DJs if needed, and
assists security. They got new security right after shooting by the individual in the red
car and the security force is now more diligent in all respects. Mr. Nuell was present
during all 5 counts in question and never saw the police perform a full count in the
manner in which they said they did.
Jason Beverly - 4900 N. 58th St. - works security at All Stars. He has observed the
counting, but said the sergeant stands by the front door and the side door and alley
are blocked off. The police start at the front of the bar. He can't expain how a patron
got through with a gun.
Trinaga Smart - 3286 N.40th St. - she goes to the establishment approximately twice
a month. She doesn't really see any problems or hear any noise. She doesn't see
exiting patrons loitering, except for maybe 10 minutes, but there are also patrons
from Gene's. She has never observed officers at the establishment.

Ms. Nuell said that they are upgarding the camera system, added security personnel,
and the police department did a security survey. They also use cones and staff to
block off streets to deal with indiividuals who cruise the area. The police said she
could not use the cones.
Asst. City Attorney DeSiiato noted that the licensee does have felony and municipal
violatons which were not listed on her alcohol application.
Per Sgt. Raden, Ms. Nuell was cited for not being truthful on her notarized application
for the establishment off Highway 100 (which was a new application).
Deny the request to remove the age restriction, with a 45-day suspension, based on

The Licenses Committee may convene into closed session, pursuant to s. 19.85(1)(g), Wis.
Stats., for the purpose of conferring with the City Attorney who will render oral or
written advice with respect to litigation in which the city is or is likely to become
involved.
This meeting will be webcast live at www.milwaukee.gov/channel25.
Common Council members who are not members of this committee may attend this meeting to
participate or to gather information. This meeting may constitute a meeting of the Common
Council or any of its standing committees although no formal action will be taken at this meeting.
Upon reasonable notice, efforts will be made to accommodate the needs of persons with

Parking for persons attending City Hall meetings is available at reduced rates (5 hour limit) at
the Milwaukee Center (southwest corner of E. Kilbourn Ave. and N. Water St.) Parking tickets
must be validated in Room 205, (City Clerk's Office) or the first floor Information Booth in City
Hall.
Persons engaged in lobbying as defined in s. 305-43-4 of the Milwaukee Code are required to
register with the City Clerk's License Division. Lobbyists appearing before a Common Council
committee are required to identify themselves as such. More information is available at
