Individuals present in opposition: Manju Sanikh representing Maharaja Restaurant stated this application will have a negative impact on their business, the neighborhood, parking, and increase loitering and panhandling. Balbeer Singh owner of Maharaja Restaurant stated he agrees with the previous speaker. Peggy Noonan 1570 N Farwell stated it would be a disturbance to her peace and quit and parking would be an issue for her business. Individuals present in support: Robyn Linder 1556 N Farwell stated he owns the building and at the community meeting the people who were in opposition was because of business competition. Michon Kearney 1325 E Albion stated the food will be good and he is in support. Rosie Sachdeva stated she is the wife of the applicant and they will be selling Indian groceries, clothes, jewelry, and handicrafts. She added that people who buy their high end beer will not be loitering and parking is a persistent problem. There will only be dry goods and food will not be prepared on premises. Theresa Morton 1601 N Van Buren St, president of the Brady Street Association stated the Association is in support of specialty beers only, no liquor. She added their is a positive response to the Indian aspects of the business. Ald. Kovac stated the floor plan indicates the beer will be sold towards the back of the store and is only 10% of the store space. Security cameras will be installed, no drinking on premises and the sign will not have "beer" on it. Ald. Kovac moved to amend the application for beer only, no liquor. Ald. He added that the parking lot is not maintained. He would like to store to be involved with the local business improvement district. Individuals present in opposition: Ruben Cruz 1028 S 17th St stated there are panhandlers in front of the store and there is trash in his yard from the store. Rhonda Cruz 1028 S 17th St stated she has been followed by panhandlers and has seen kids jumping in the dumpster. She was in the store while someone was shoplifting and there is no security. Ald. (Expires 4/8/2016) Appearing with the applicant: Atty. Michael Chernin stated the applicant allowed another operator to continue to run his bar which created problems, and that operator and security guard have since been terminated. He added that the applicant and his family will solely operate the premises. He stated there was an attempted lease agreement for the premises between the applicant and another individual, but the deal fell through. The business and licenses were not being rented. He requested a 60 day suspension instead of nonrenewal. The applicant stated when he ran the business there were no problems and that is what he is doing now. Individual also present: Ald. Donovan stated he has serious concerns and does not support renewal for this operator because it is not in the best interest of the neighborhood or the district. He added the applicant rents the business out for other people to run and it probably is not legal. He stated he had met with another applicant who had signed a lease with this applicant to rent the premises and obtain his own licenses, but the deal fell through because someone else offered more money to lease the business. The police report is also concerning with the prostitution and underage drinking. Individuals present in support: Andrea Curiel 2039 W National Ave stated every time there is a problem with the bar she has called the police and she supports her father. Juan Carlos Curiel 2039 W National Ave stated his father's bar has never had problems until he started having different renters at his business. He added that he is not really involved in his father's business and he believed the manager who was terminated was renting the business. But clarified that he meant the manager runs the business, not rents the business. Three additional individuals were present in support. Ald. Stamper moved approval with a 60 day suspension based on police report and applicant testimony. (Failed 2-2, Alds. Kovac and Puente voting no) Ald. Kovac stated the police report is not enough to warrant a 60 day suspension because the case for progressive discipline isn't there, however the allegations of a collusive arrangement, the applicant's inability to speak English half way through his testimony, his son's testimony regarding the manager or tenant, and the request for a 60 day suspension is troubling as to whether the applicant can be trusted.
