Emmanuel Coley 4208 N 26th St stated the applicant feeds the homeless and is a great businesswoman and asset to the community. Clarice Dozier 9077 N 70th St stated she has known the applicant since high school and has worked with her in catering. She added the applicant is a hard worker. She stated that she would like a place in the area for older adults. Ald. Lewis stated she had received numerous objections via phone and email to the application from residents because they do not want more alcohol establishments in the area. She added that she would like to work with the applicant to determine the best fit for the community. Ald. Lewis moved denial based on neighborhood objections. (Prevailed 3-0-1, Ald. Kevin Douvette stated the applicant had a Packer party outside in the vacant lot next to the premises and when the police responded to the noise complaint, the applicant shut the event down. Bauman stated he has received substantial complaints regarding noise and loud music at this premises and Ugly's. He added that this application is a Thursday night and doesn't see the need for outdoor music. He stated that he does not support any music after 8 PM on Thursday and 11:30 PM on Friday and Saturday. Ald. Perez moved to amend the application to end music at 8 PM on Thursday and 11:30 PM Friday and Saturday. (Prevailed 5-0) Ald. Perez moved approval as amended. (Prevailed 4-0-1, Ald. The applicant stated he did not properly store his firearm and he also had an open beer in his car. Individuals present in opposition: Davinder Tour 12033 Wilbur Ave, Greenfield, WI stated he owns property on the street and there are a number of liquor stores in the area and other types of businesses are needed. Murphy Jamison 9102 N 75th St stated he operates two daycares including one near the premises and other businesses are needed in the area, not more liquor stores. Sujit Tour 9520 W Walfor Rd, Franklin, WI stated there were problems at the previous premises and there are 4 liquor stores in 5 blocks. Ald. Coggs stated she met with the applicant and the neighborhood objections are legitimate. She added that the business has done good work in the community and she hopes it continutes. She added that the amout of liquor in the area is overconcentrated. Ald. Coggs moved approval of the Food Dealer license application and denial of the Class A Malt license application based on concentration and neighborhood testimony. Joseph Domask stated he has heard from neighbors and they are in support. He added that they have removed the outside tables to help with the noise complaints. Wilfredo Ortiz, manager stated he has gone to court regarding the violations and he is working on the repairs. He added that people smoking outside has added to the noise and he has talked to the complainant on several occassions and complies with his requests. He stated that he cleans up litter every morning. Ald. Coggs recommended closing the doors at 9 PM and talking with the neighbors regarding complaints. Ald. Coggs moved approval. (Expires 3/3/2017) The applicant stated the police officer told him that he was going to be charged with all the items the located at the premises including the drugs. He added that he installed more cameras, hired a security guard for 5 months, posted no loitering signs, and contacted the police regarding the loitering. He added that not all the litter comes from his premises because he doesn't sell certain products. He stated that he does his best and will develop a game plan to straighten things out. Individual present in opposition: Rick Banks 2609 N Fratney St stated there is loitering and he brought a bag of liquor bottles that he picked up himself from around the outside of the premises. Ald. Coggs stated she has witnessed loitering herself outside the premises and asked about the litter. She added that the issues in the police report are about management of the premises and abatement strategies need to be developed. Ald. Zielinski stated the applicant has received several warning letters and it doesn't seem to be sinking in. He added that litter needs to be picked up more than once a day and loitering is not acceptable. Ald. Coggs moved approval with a 10 day suspension based on the police report and neighborhood and applicant testimony. (Prevailed 5-0) A motion was made by ALD. COGGS that this Motion be AMENDED.
