Coggs joined the meeting at 9:19 AM Present 5 - Zielinski, Perez, Coggs, Lewis, Rainey 1. 161064 Motion relating to the recommendations of the Licenses Committee relative to licenses. Sponsors: THE CHAIR 14 DHILLON, Inderjeet S, Agent for "Best Liquor, LLC", Class A Malt & Class A Liquor License Application with 18+ Age Restriction for "Best Liquor" at 555 W BECHER St. The applicant stated he was set up by Mr. Witkowiak and there are no charges pending. The applicant added he borrowed $1.5 million from the bank for development. He stated there are chain restaurants and several gas stations and questioned the concentration of chain operations. Appearing with the applicant: Fred Royal representing the Milwaukee NAACP 2745 N Dr. Martin Luther King Jr Dr stated they are in support of the application. He added that there are only 2 other liquor stores near the proposed location. He adedd that the applicant and his wife have owned a gas station for the last 20 years, they employ 7 people, and have invested $1.5 million in the neighborhood. He added that the NAACP did not take a vote on supporting this application. Individuals present in opposition: Jan Schlei 2116 S 6th St stated the applicant does not know how to maintain a laundry mat and there is litter around. She added that there are other liquor stores in the area. Carol Hoppe 2119 S 6th St stated she is against the liquor store because there are problems with the restaurant in the same building. Chris Bystra 2119 S 6th St stated he is concerned about the concentration of liquor in the area. James Witkowiak 529 W Historic Mitchell St stated the applicant tried to bribe him in 2011 and he contacted the FBI regarding the incident. Ald. Rainey moved to enter into the record as exhibit #1 the written statement from Mr. Witkowiak. (Prevailed 5-0) Individuals present in support: Robert Bergeron 2414 N 16th St stated he is the head chef at Monterrey and there is no litter or unwanted persons. He added that there is no litter problem and no problems with the restaurant. Chad Roziniak 2000 S 5th Pl stated he has lived there his whole life and he believes the applicant will be bringing business to the area. He added that there is litter everywhere. Ald. Perez asked if the adding liquor to the neighborhood would help it. Mr. Roziniak responded that adding liquor to the neighborhood would help it. Edward Tylack 2051 S 5th Pl stated the applicant helps out everyone in the neighborhood. Ald. Zielinski stated the area is challenged and adding liquor is not a good way to turn the neighborhood around. He stated adding liquor exasparates the existing problems in the area. Ald. Zielinski moved to deny the application based on concentration and neighborhood testimony. (Prevailed 4-0-1, Ald. Coggs abstaining) A motion was made by ALD. ZIELINSKI that this Motion be AMENDED. He added that the 24 hour license is good because they can call the police if necessary. Carol Hoppe 2119 S 6th St stated she is opposed to the 24 hr license and would like the gas station to close at 12 AM. Ald. Zielinski moved approval. (Prevailed 3-1-1, Ald. Coggs voting no and Ald. He added that he supports the application because the applicant has always been responsive to picking up litter, removing graffiti, and responding to neighborhood complaints. She stated the liquor store is too close the Bethune Academy and she has been approached by panhandlers. She added that she does not feel safe because of the people who frequent the premises. She stated she talked to the applicant regarding the car wash, but none of the other issues. Ald. Lewis stated she does not take the complaints lightly and would like to see an action plan in place. Ald. She added she saw a guy urinating in front of the store and there was no security. She added that staff is unprofessional. Emil Ovbiagele stated MPD is keeping up with their duties and are going above and beyond. He added the applicant was unaware of the trash issues and will take them seriously and handle them. The applicant stated incident #34 on the police report occured on a party bus. He added incidents #35-37 have been taken care of and retraining was conducted and the employee was terminated. He stated he was cooperative with the police for incident #38 and the incident did not occur at the premises. He stated his staff sweeps and picks up trash nightly and he personally picks up trash. Individuals present in opposition: Mike Brenner 706 S 5th St stated there is a lot of trash in the area and he is upset by the cones in the road for parking. He also added that this is occuring while MPD is present. He added that the street at bar close is full of people and police. Jose Serrante owner of La Fuente Restaurant stated there is trash all over the street. Ald. Zielinski stated there should be people picking up trash in the night and in the morning. Ald. Perez stated he doesn't want trash and nuisance behavior in the neighborhood. Ald. Perez moved approval with a warning letter based on neighborhood testimony.
