He stated this issue came up 10 years ago, but now it's back. He added the residents
are entitled to quiet enjoyment and the premises must conform. He recomemended
nonrenewal unless the applicant is willing to stipulate to ending all music at 10 PM and
no outdoor music. He recommended a change in the plan of operation to end outside
music at 6 PM and stop all music at 10 PM daily.

Martin Tierney 1111 N Marshall St stated everything was fine until 2015 when the music
became louder and they tried calling numerous times. He added he can hear the music
in his living room while watching tv with the windows closed. He stated he starting
calling the police to complain. He stated the 2017 application stated there will be no
amplified music, but there is amplified music. He added that every other weekend
amplified music goes past 10 PM. He requested that the music stop at 10 PM, below
50 decibels outside, 30 decibels inside his unit, no outdoor music, and keep all doors
and windows closed.
Janet Tierney 1111 N Marshall St stated she lives in a 44 unit condo building and she
has called the police when the noise gets too loud. She stated that she spoke with a
community liaison officer and he reached out to the applicant. She added that she
agrees with the previous speaker about the noise in their condo.
Brian Schwanagen 1111 N Marshall St #905 stated he agrees with the previous
speakers. He added that he saw a tent being erected with amplified music. He added
that the 50 ft Rule is not in effect at the premises. He stated that the music can be
heard in his condo.
Doug Downey 1114 N Marshall St #202 stated he moved in in February and noticed a
problem in May. He stated there was no music, but the patrons outside were being so
loud he could hear them in his apartment.

voted to oppose the liquor sales at the premises. She added that there is a lot of
processed foods and frozen meat that is black.

Neighborhood Association and the premises was purchased as a grocery store but he
has witnessed beer trucks unloading daily. He added there is drug dealing and

validated in the first floor Information Booth in City Hall.

register with the City Clerk's License Division. Lobbyists appearing before a Common Council
