Jose Perez at the table - there were no complaints on file for the previous licensee, but the office was aware there were issues. This applicant has done everything the alderman's office has requested. His office will not tolerate any loud noise. The applicant will run a bar and grill and respect the residential neighborhood. Objector: Vahid Bakhtiari- 207 W. Mitchell St. - he is the property owner right next door. - he is concerned about the potential noise with the music license. He complained about the noise to the former owner of the bar at this location. The applicant is willing to put a hold on the karaoke and the juke box so the neighbor knows she is serious about respecting the neighborhood and being a place for the neighbors. Ald. Layton Blvd. - all of the other businesses in the mini-mall close at the latest at 9 p.m. Ms. Doherty said this is a fair compromise and the applicant will apply for extended hours in the fall. Grant the food dealer license and hold the extended hours application, by Ald. Coggs. A motion was made by ALD. COGGS that this Motion be AMENDED. Donovan present at the table - the alderman is fine with it as long as no neighbors are objecting and there are none. The applicant said he will have a small selection and only behind the counter. This McDonald's opened about a month ago. Ald. Dodd likes the interior and the servers were kind, but it was a mixed bag of employees in terms of service. She was waiting a long time in the drive-thru and there were no customers in the store itself. She would like to see more landscaping at this site as well. The licensee said the store is 43 years old and he would like to tear it down and the parking lot as well. Grant, by Ald. Dodd. A motion was made by ALD. DODD that this Motion be AMENDED. Dan Fiorenza present for the licensee Sherman Morton - aide to Ald. Rainey present at the table - the alderman has concerns with loitering, parking and litter. He leaves the decision to the committee. Atty. Fiorenza has all of the invoices; he wasn't aware they had to be on the premises. Two objectors: Lauretta Turnbull - 2728 N. 50th St. - his sidewalk is perpetually blocked by something, ranging from a dumpster, cars and he does not clear his snow on the sidewalk and actually piles snow on his sidewalk. Ald. Lewis moved to make 6 photos provided by Ms. Turnbull part of the record as Exhibit 1. Prevailed. 5-0 The licensee said that he contacts the dumpster company about the dumpster, but he isn't getting any positive response from the company. He was not aware he couldn't sell food past his license expiration date. He does not have a provisional license. Pamela Burks - 2719 N. 50th St. - she lives right next door and she gets all the litter from his property on her property. His patrons roar onto the sidewalk and will hit someone at some point in time. He also allows another business's customers to park on the sidewalk, grass, curb, up to about 20 vehicles. She calculates his lot could hold 5 cars. One time it went a month before the dumpster was emptied. The illegally parked cars will also physically move the dumpster to wherever they wish. He has limited groceries; his biggest sales are in nachos. She has been talking to him for 4-5 years about the trash and parking. The applicant mailed in his application for renewal on April 10th. Ms. Burks doesn't want to see another vacant building, but the licensee was also aware she would be here today. Her main concern is the parking on his lot as she gets woke up every Wednesday, Thursday and Friday nights due to the parking noises. Ald. Coggs had issues with this gas station years ago, but improvements have been made since. It's important that this gas station be an asset to the area. Ald. Per the licensee, the violence in the police report relating to the bathroom involved miscommunication and a misunderstanding. The licensee talked to both parties involved and it has been resolved. For the second item, a younger, new customer was trying to pickpocket from a senior in the establishment. It was a family involved and the female pickpocket hit a man with a bottle. The police never came into the bar and talked to the Whiteheads; they just talked to the family group outside. No neighbors present. Ald. Coggs asked what the protocol is when motorcycles are parked on the sidewalk. The establishment has 8 cameras and all staff can access the videos from the cameras. Ald. Coggs encouraged the licensee to meet with the police and also her office. She would also encourage him to call the police proactively. Grant, with a warning letter, by Ald. Coggs. This was a vacant store and they will be running a grocery store with drinks, chips, snacks, and tobacco. They will not be selling meat or produce. Center St. - goes to the store frequently as the licensee is respectful Herb Carson - 2607 N. 40th St. - that address is his mother's and he was at her house and she patronizes this store. All of the employees have now been paid who hadn't been paid in the past. The Dept. of Workforce Development did not object to dismissing the case. The domestic violence case is with a brother-in-law and there is no conviction on this mattter and a resolution has been offered. For the over-charging of the credit cards, there were 3 incidents of overcharging in three years and he has changed credit card services which had a glitch and he reimbursed his customers and dealt with their banks. He provided four letters from four customers who are satisified with the resolution of the matter. Ald. Witkowski moved to make four letters part of the record as Exhibit 1. Prevailed. The first two items in the police report were dismissed, but an earlier-than-normal closing time was instituted for the first time and for the second item, the police were called by the establishment. The bartender who was supposedly selling a firearm at the bar was dismissed, although he did have a gun and was dismissed for that reason. Ald. Witkowski has gotten occasional noise complaints.
