from neighbors. He stated after 25 phone calls to the store, he called corporate and
was told that the police should be the personal security for the store. He added that he
left 3 voicemail messages for Ms. Robinson with no response.

Linda Mongold 140 E Gauer Cr stated there have been people arguing and playing
music in the parking lot late at night. She provided a list of phone calls she made to
MPD.

The applicant stated #1 on the police report is the suspect saying he was in the
premises, but he wasn't found in the premises. He stated the police report was the first
time he heard of the incidents. He stated that the manger during incidents #1-3 is no
longer employed at the premises. He stated that they had 2 or 3 managers last year,
and now have a manager that communicates freely.
Appearing with the applicant:
Andrew Deuster 9506 N Wakefield Ct, Bayside, WI stated the surveillance equipment
was lost in a fire at the premises. He added that security is at the door checking IDs.
He stated #1-3 in the police report happened under a manager who is no longer
employed at the premises. He stated that some of the security guards are still working
at the premises. He stated that he tried to get in touch with the previous manager, but
he did not respond. He added that their internal reports states that in #2 in the police
report the security did not strike the subject, but restrained him. He stated that the
manager reports to his group, and he reports to the agent. He stated that the cameras
are now working and communication is a lot better. He added that there is a lead
security guard that is at the door and recaps the night with management. He stated
there is an incident report sheet that was implemented 5 months ago. He stated that
#3 in the police report was a bartender who is no longer employed at the premises. He
stated the premises always cooperates with MPD and they do not have a bad
relationship. He added that he is open to suggestions on improving security.
James Hernandez 2632 N Oakland Ave Apt 32 stated he is the current manager and
there were 2 security guards present during #4 in the police report. He stated there
were 4 security guards during the day, but it was slower so he let 2 go, and there was 1
guard inside and 1 outside. He stated that it was slower so he left and when home
around 10 PM, but returned after the incident for bar close. He stated that he talks to
his head door guard every night and is in constant communication, and puts all
incidents in an email. He stated that he talks to MPD all the time when they come in,
and cooperates with all investigations.

Jodi Lemmer 4th District Legislative Assistant stated Ald. Bauman believes there is a
lack of training, preparedness, responsiveness, and responsibility based on the police
report and he requests a 10 day suspension.
Ald. Coggs asked if there was survelliance at the premises and if they use ID
scanners. She asked if the same security is working that was in the incidents in the
police report and what steps have been taken to address the issues. She added that
she doesn't feel the applicant is taking responsibility for the police report. She asked
about the reporting process. She stated that she finds it interesting that no employees
said anything about the incidents on the police report.
Ald. Lewis asked if there is a written report of incidents that occur at the premises.
Ald. Hamilton stated there was a break down in operations that was slow to be
corrected. He added that there was hesitance in accepting responsibility for the
incidents. He stated that there have been some changes, but there are still
challenges. He added that the underage drinking seems to be acceptable at the
premises, and he hopes that will be corrected.
Ald. Hamilton moved renewal with a 10 day suspension based on the police report and
aldermanic and applicant testimony. (Prevailed 5-0)

dumpsters to get the pizzas. She stated that she spoke with corporate about getting
locks on the dumpsters.
Rachel Williams manager stated they clean the parking lot 3 times a day.

Joe Kaltenburg 1724 E Geneva Pl stated there are issues with litter, loud noises, and
rodents. He added that there is hood cleaning going on after midnight and he would
like notice of that. He stated that the sidewalk isn't shoveled in the winter. He provided
photos of trash in the parking lot by the dumpsters.

The applicant stated that she is concerned the employee went to the hospital and was
overserved. She added that they will no longer employ people under 21 years old.
Appearing with the applicant:
Atty. Kendrick Yandell stated the patron in #2 on the police report was not thrown to
the ground, but was ejected from the premises. He added that staff was concerned
about their safety and the safety of the patrons. He stated #3 in the police report will
be litigated because he does not believe the premises was over capacity. He added
that prior to opening the premises that night there was a meeting with staff about crowd
control. He stated that there is no procedure for checking people for firearms. He
added that no one was injured in #4 on the police report and the behavior was unusual
for the premises. He stated that #6 in the police report Mr. Vitucci was unaware that he
couldn't have the doors open after 10 PM. He added that signs are now posted saying
music has to be turned off at 10 PM. He stated that #8 in the police report is
disturbing and the staff was unaware that she was under 21 years old. He added that
the employee was terminated, and the bartender who served her was suspended for 2
weeks and had his hours cut. He stated that the premises is evaluating if they need to
have further staff training. He stated security guards work Thursday-Sunday and they
card anyone who appears to be under 35 years old. He added that an ID scanner is
used at the door by security. He stated that the premises routinely confiscates fake
IDs and turns them over to MPD. He stated that the premises will implement a
responsible server training program, ask MPD to come in a provide training on spotting
fake IDs, and rebrand the premises because the neighborhood has changed.
Individual also present:
Cpt Rowe stated it is not uncommon to have a Preliminary Breath Test (PBT) for a
patrons involved in a bar fight. She start these tests are used to gauge what is
happening inside premises. She stated that they do several underage stings in the
district per year. She stated that the issues on the police report are all within the
control of the premises because they are general business practices.
Individual present in support:
William Burtachi 2340 N Cramer St stated he's never had an issue with noise and has
seen staff check IDs.
Ald. Kovac stated he received a complaint from a resident regarding noise at the
premises from music and patrons. He added that North Avenue is changing, but some
of the anchors are still there. He stated that it would be helpful if the manager was
present to answer questions about the day-to-day operations.
Ald. Coggs stated she is concerned because an employee was overserved and so
drunk she needed to be carried to the car and the discipline for the bartender wasn't
severe enough. She added that the police report doesn't include all the times underage

patrons were let in and patrons were overserved where the police did not catch them.
She asked what the plan is for the future to prevent these issues. She stated that she
is disappointed in this conversation because the manager was not present, the
applicant is unwilling to speak, and there's no plan to address the recurring issues in
the police report.
Ald. Hamilton stated the premises has a history of underage patrons getting in and the
comfort level of serving the underage employee is concerning. He added that there are
also consistent issues with being overcapacity.

2. 190220 A substitute ordinance relating to signature, notary, and residency
requirements for alcohol beverage licenses and cigarette and tobacco
licenses.

In the event that Common Council members who are not members of this committee attend this
meeting, this meeting may also simultaneously constitute a meeting of the Common Council or any
of the following committees: Community and Economic Development, Finance and Personnel,
Judiciary and Legislation, Licenses, Public Safety and Health, Public Works, Zoning, Neighborhoods
& Development, and/or Steering and Rules. Whether a simultaneous meeting is occurring depends
on whether the presence of one or more of the Common Council member results in a quorum of the
Common Council or any of the above committees, and, if there is a quorum of another committee,
whether any agenda items listed above involve matters within that committee’s realm of authority.
In the event that a simultaneous meeting is occurring, no action other than information gathering will
be taken at the simultaneous meeting.
Times for specific agenda items are estimations. If items cannot be heard at their specified times,
they will be heard as soon as practicable thereafter.

Persons engaged in lobbying as defined in s. 305-43-4 of the Milwaukee Code are required to
register with the City Clerk's License Division. Lobbyists appearing before a Common Council
