The applicant stated the shooting happened during closing time and he got nervous.
He added that had 2 bouncers on the day of the shooting, but they were breaking up a
fight when the women entered with a gun. He stated it was his mistake in not reporting
the shooting, and he will call the police whenever there is a problem. He stated that he
guarantees that it will never happen again.
Appearing with the applicant:
David Eisner 10621 W Lincoln Ave #1 West Allis, WI read a written response to the
police report. He added that a third bouncer was hired after the meeting with MPD at
District 2. He added that the applicant panicked and the buck stops with him.
Ald. Coggs moved to enter in to the record as exhibit #1 the written response to the

Individual also present:
Patricia Doherty 8th District Legislative Assistant stated she has received calls about
patrons being loud when exiting at closing time. She added Ald. Donovan has a lot of
concern about trust and honesty, because there was a bartender, 2 security guards,
and the applicant present during the shooting and no one called the police. She added
and that maybe a suspension is in order because they already received a warning
letter.
Ald. Kovac stated he is more concerned with the failure to report the shooting, than the
actual shooting itself. He added that the worst possible thing is not to call the police
when there's a shooting. He added that he agrees a suspension is in order given the
failure to report.
Ald. Lewis asked when the third bouncer was hired and how a patron was able to enter
with a gun. She added that last year there was also a failure to report.
Ald. Johnson stated last year there was a battery/cutting at the premises and the
applicant was reminded to call the police when incidents occur.
Ald. Johnson moved approval with a 15 day suspension based on #11-12 in the police

spoke with the neighbor previously and a resolution was agreed to that live music
bookings will not be disruptive, and the applicant will hire a sound engineer to abate
noise. He added they will hire a private security firm to monitor from 9:30 PM until
10:30 PM, and the neighbors will have their direct phone number. The neighbors will
also be provided with a list of all scheduled events. He added that this is a venue with
small weddings. He added that a non-disparaging clause will be added to the
agreement.

Ald. Bauman stated there was a blatant disregard of the plan of operation agreed to
last year and he recommends nonrenewal. He added that the exact same discussion
was had last year, with the same neighbors, and nothing has changed. He stated that
this is a residential area and the premises should have a small footprint in terms of
noise and car activity.
Individuals present in opposition:
Martin Tierney 1111 N Marshall St he stated he is interested in a written agreement
with the premises, but he feels ambushed because this was the first time it was
brought up to him. He added that he wants a peaceful resolution and doesn't want to
shut the business down, but there are real problems regarding excessive noise and
amplified music. He stated that he has concerns and that he was threatened with a
restraining order by Tony Sanfilippo.
Janet Tierney 1111 N Marshall St #404 stated she asked the premises to lower the
volume and it was turned down, and then increased again so she called the police. She
stated she feels threatened and bullied by the applicant and their attorney, she added
that they said they would ruin her reputation.
Ald. Kovac stated he remembers the hearing last year and he was reluctant to
suspend the license because of the scheduled weddings. He added that he is shocked

that the applicant is back again with the same issues, given how close they were to a
suspension, and that they neighbors haven't be made happy. He added that he is
stunned that the neighbors were threatened.
Ald. Lewis stated the applicant is flippant and doesn't understand how serious this is or
how to work with the neighbors.
Ald. Coggs stated she hopes that the applicant isn't before the Committee again next
year with the same issues and complaints by neighbors.

In the event that Common Council members who are not members of this committee attend this
meeting, this meeting may also simultaneously constitute a meeting of the Common Council or any
of the following committees: Community and Economic Development, Finance and Personnel,
Judiciary and Legislation, Licenses, Public Safety and Health, Public Works, Zoning, Neighborhoods
& Development, and/or Steering and Rules. Whether a simultaneous meeting is occurring depends
on whether the presence of one or more of the Common Council member results in a quorum of the
Common Council or any of the above committees, and, if there is a quorum of another committee,
whether any agenda items listed above involve matters within that committee’s realm of authority.
In the event that a simultaneous meeting is occurring, no action other than information gathering will
be taken at the simultaneous meeting.
Times for specific agenda items are estimations. If items cannot be heard at their specified times,
they will be heard as soon as practicable thereafter.

Parking for persons attending City Hall meetings is available at reduced rates (5 hour limit) at the
Milwaukee Center (southwest corner of E. Kilbourn Ave. and N. Water St.) Parking tickets must be
validated in the first floor Information Booth in City Hall.
Persons engaged in lobbying as defined in s. 305-43-4 of the Milwaukee Code are required to
register with the City Clerk's License Division. Lobbyists appearing before a Common Council
committee are required to identify themselves as such. More information is available at
