He added that he wants the fence to be repaired in the next 30-45 days. He stated that
he is concerned about the shoplifting occurring at the premises. He recommends a
warning letter.

into his yard. He added that the store needs to do better and shovel their lot.
Ebony McCoy 2640 N 60th St stated they didn't shovel at all during the winter. She
added that there is a mattress at the premises right now.

Atty. Michael Murray stated they have been in contact with MPD since January and
now have armed security guards. He stated they've added security cameras,
bulletproof glass, and lights in the alley. He added that the premises provides services
to residents in the area and bulletproof glass is the best way to keep employees safe
and deter robberies. He stated that they are trying to mitigate the issues at the
premises.
John Cunningham 2705 Baldwin Ct, Valparaiso, IN stated he is the security manager
for the corporation. He added that they have security on Friday and Saturday overnight.
He stated that if the store was closed for third shift they may have to rethink their
operations.

Ald. Dimitrijevic stated she denied the provisional so they can get their act together.
She added that there is an abatement plan, but it's not enough and she's disappointed.
She stated that she is concerned about the safety of employees and residents. She
added that they should consider full time security guards. She stated that only the gas
pumps should be open 12 AM-5 AM for credit cards only. She recommends a
suspension so they premises can resolve the issues.
Sgt. McBride stated the premises is in nuisance status and has been responsive to
MPD and neighborhood complaints.
Ald. Borkowski stated this place isn't unique and they are taking up too much of the

police services for the district.
Ald. Lewis stated that an hours of operation change may help with the issues. She
added that she has a Speedway in her district that closes at 6 PM every day, and is
only open for gas sales after that. She stated that there is a way to alleviate the issues
in the area by closing earlier. She added that the premises has the same level of
responsibility of other licensees, and they should rethink their plan of operation.

Atty. Murray stated the bulletproof glass was ordered in January. He added that they
would like to stay open 24 hours to serve the community.
Erin Moosbrugger 500 Speedway Dr, Enon, OH stated the premises will now have
security 7 days a week. She added that there have been delays with the bulletproof
glass because it had to be custom made and they are just waiting for it to be
delivered. She stated that they will look into closing from 12AM-5AM. She added that
the people that come in to the premises in the middle of the night are critical essential
workers such as health care workers and police officers. She stated that they do their
very best to operate safely in the community and work with MPD.

added that there are many gas stations that operate gas only during the nighttime. She
stated that she is not here to manager their business, but things need to change to
protect the quality of life of residents in the area.

The applicant stated that they take reservations to let people in to the premises, but if
they know the person they don't need a reservation. He added that he can drop off
letters to residents about the premises this weekend.
Appearing with the applicant:
Jennifer Vidrio 3573 S 46th St, Greenfield, WI stated she is the manager of the
premises stated they are working to address the issues at the premises. She added
that since they got the nuisance letter they have added a security guard outside with a
metal detector, and a security guard inside who checks IDs, and are working with the
police. She stated that they close 30 minutes earlier now and they turn on the lights
and turn off the music to help disperse the crowd. She added that they have security
cameras and no loitering and no trespassing signs. She stated that she hasn't been
able to contact neighbors due to COVID, but in the summer she wants to have a
neighborhood barbecue so neighbors can share their ideas. She added that they have
a list of people who make reservations who are allowed in the bar. She stated that they
will try their best to make their business better and make the neighbors not feel afraid.
She added they will do their part to not cause any problems.
Individuals also present:
Ald. Dimitrijevic stated the premises is working on their nuisance abatement plan, and
some of the goals have been met. She added that she recommended the applicant
reach out to neighbors about improving their business plan, but they have not done
that yet and it is disappointing. She stated that she has received complaints from
neighbors and there is room for improvement. She added that she recommends a 30
day suspension to allow the premises to reach out to neighbors because that should
have happened prior to this meeting.
Sgt. McBride stated they premises has been in nuisance status since September 10,
2020 and they are concerned about the number of calls for service. He added that
management has been very responsive and is working with MPD to reduce the calls for
service and are following the recommendations. He stated that the applicant has
reached out regarding instances that are occurring in the general area and how they
can help abate them. He added that they have participated in 1 block watch meeting
and have been cooperative and responsive to MPD and residents.

The applicant stated they have a camera outside facing West and he doesn't know why
the inside camera wasn't working. He added that he saw the patron storm out and
cause a small scene, but he didn't think he was going retaliate or to harm anybody. He
stated that his cameras are working, but one has issues with Wi-Fi. He added that the
police came in and downloaded the security camera footage. He stated that he just
hired the security guards and the comments are terrible, so they have to get rid of
them. He added that he plans to come back with a whole new team. He stated that the
DJ was paid for and he's not there often, and it was for a birthday party, but he knows
he doesn't have a license for a DJ. He added that he has his COVID plan approved
and has security to deal with the crowd outside. He stated that security guards tell
patrons to turn their music down and to go home safely. He added that he has a guy

who cleans every day and they clean every morning. He stated that he made a post on
Facebook and he has 10,000 followers, and neighbors commented saying they love
the place, it's spotless outside, and they don't have any problems. He added that he
will do a meet and greet in mid-April with the community to discuss what is going on.
Individuals also present:
Ald. Zamarripa stated that the 2 new incidents on the police report occurred just 2 days
after the Licenses Committee hearing when the applicant received at 60 day
suspension. She added that the Public Entertainment Premises license application
was denied at the previous hearing and he was spoken to at length about the behavior
at the premises. She stated he was encouraged to reach out to her and to neighbors,
but that was not done. She added that the applicant has had a DJ on numerous nights
with amplified sound, not just for the birthday as he stated. She stated that on March
12th she went to observe the activities of the premises and saw a man outside
brandishing a gun pointed at the premises in a threatening manner and she called 911.
She added that the man then drove off erratically. She stated that she viewed the
security camera footage and saw the premises was overcapacity, many people were
not wearing masks, people were smoking hookah and milling around. She added that
she is concerned about the public safety and health of people when frequent the
premises, and those residents who live around the premises. She stated that she
recommends nonrenewal because she has no confidence that the applicant is
managing or will manage the premises properly because he is not taking the direction
of the council members, the Police and Health Departments, or residents.
Carly Hegarty - Health Dept stated on March 12th they went out and issued 3 citations.
She added that she emailed the premises about their COVID safety plan and that they
were to maintain a 25% capacity, which meant 22 total persons including patrons and
staff. She stated that there were additional violations after the previous hearing,
including overcapacity, not wearing masks, and people not remaining seated.
Lt Klein - MPD stated that there are several concerns about the premises including
repeated violations of the capacity rules from the Health Department; the DJ that has
been at the premises even though they have no Public Entertainment Premises
license; patrons outside being loud and disorderly with security guards not addressing
or trying to deescalate the issues, but responding with guns; a security guard making a
comment about "just shoot him and this will be over with"; and not taking advice from
the Police or Health Departments addressing issues at the premises.
Ald. Coggs stated she has never seen in 13 years the Committee dealing with a
problem establishment and 48 hours later there are major police incidents. She added
that part of the problem was the premises not obeying what was discussed at the
hearing. She stated that a license is a privilege, not a right, and residents have a fear
about what is becoming of the premises because of the inaction of the applicant. She
added that how the applicant addresses issues is critically important, but in 48 hours
the applicant didn't address the concerns and disobeyed what the Committee said,
which caused heightened situations to occur. She stated that the applicant has to
operate responsibly and take actions to prevent incidents of people being hurt, injured,
or killed, but it seems that in this situation the applicant did the opposite.
Ald. Borkowski stated if ever there was a time for nonrenewal this is it. He added the
premises is a powder keg and a cancer in the City. He added that when an alderperson
witnesses a person point a gun at a building that is a wakeup call, and the applicant
cannot be trusted.

May 2020. She added that a problematic employee was fired in July 2020. She added
that the applicant is trying to clean up the premises and an abatement plan was put in
to place in July 2020. She stated that the applicant has met with residents and
provided them with his contact information. She added that #12-19 on the police report
were employees reporting issues.

Dameon Ellzey - 15th District Legislative Assistant stated Ald. Stamper has been in
contact with the applicant about his concerns surrounding the premises. He added that
the applicant is cleaned up the premises and is trying to change the culture that
created all the problems with the previous owner. He stated that Ald. Stamper is in
support.

Trasus Wright 1103 W Garfield stated the applicant participates in neighborhood
walks, but trash needs to be cleaned up in the area.

added that he is very sorry for what his employees did. He stated that he hired a
security guard to handle the problems in the stores from 2 PM-10PM. He added that he
installed 20 security cameras that MPD will have access to. He stated that he will put
up no loitering signs and work with the police. He added that nobody deserves to be
beat up like that, he is very sorry, and it will not happen again. He stated that he fired
the employee who beat up the customer, and he takes responsibility for the actions of
his employees.

Atty. Michael Maistelman stated the applicant takes accountability for the problems
and there is a mitigation plan on file. He added that the person who was beat up has
been panhandling and causing problems at the store for years. He stated that the
employees called the police to report a trouble with subject. He added that all

employees will undergo training to deal with people who have mental health issues. He
stated that there will never be extended hours at the premises. He added the premises
has been there for 30 years and the police report is 1 horrific incident. He added that
they have been closed since February 21st. He stated that a suspension is warranted.
Khalid Farhud stated he and his nephew were wrong and he's sorry. He added that he
has worked at the store for 4 different owners for 30 years. He stated that pushed his
nephew and told him to stop, and he called the police twice. He added that he is very
sorry and apologetic, and there is no excuse for what happened. He stated that he has
a good relationship with customers, residents, and the police. He added that he
deserves a second chance to improve himself and he attends the block watch
meetings and helps customers.
Individual also present:
Dameon Ellzey - 15th District Legislative Assistant stated there is no excuse for a
resident to be beat down at an establishment. He added that a cover up is taking
place because the cameras had to have been working, and for the cameras to not
have been working at this moment is suspicious. He stated the employees know the
egregious nature of what took place. He added that they cannot allow the message to
get out that it is okay for an owner to stand idly by while a customer is beaten and
stomped on the ground. He stated that ownership matters and it is lacking at this
premises. He added that he sympathizes with Mr. Farhud but this was a matter of a
customer with mental health issues being stomped while Mr. Farhud was standing
there. He stated that there is a heavy handed way to dealing with issues and precedent
being set. He added that the egregious nature of what happened and was seen on the
video, the owner not being at the store, and the security cameras not working show the
premises isn't being ran correctly at this time. He stated that Ald. Stamper
recommends nonrenewal.
Individuals present in opposition:
Mabel Lamb Sherman Park Community Association stated the actions taken against
the patron were inappropriate, inexcusable, and perpetuated violence. She added that
store owners behaving this way cannot be tolerated in this community. She stated that
she read the apology on Facebook, but that type of behavior by the employees
towards patrons is inexcusable.
Ms. Farina stated she is a community leader and she went to the store with other
residents to talk with the owner about what occurred. She added Mr. Farhud told her
that he beat up the victim and she told him that nobody deserves that.
Danell Cross 2470 N 46th St stated her son was beat up at this premises years ago
when he was drunk and causing problems and the video was traumatizing to her. She
added that she has known Mr. Farhud for 13 years so testifying against him is hard for
her. She stated that there is a potential for this to happen again and the victim was
devalued as a human being. She added that the customers in the store also
experienced trauma by witnessing the man get beat up.
Individual present in support:
Derry Johnson 2743 N 34th St stated he has known the family for over 35 years. He
added that Mr. Farhud has always been a good guy and he is a pillar of the community.
Ald. Coggs stated watching the manager and his nephew participating in the egregious
act of beating someone up makes her question the applicant's ability to manage
employees. She added that everybody deserves to be treated with humanity and that
customer was not on that day.
Ald. Kovac moved nonrenewal based on the police report, and applicant,
neighborhood, and aldermanic testimony. (Prevailed 5-0)

She stated that she has taken an active management roll at the premises. She added
that there will now be 5 managers for the premises, and 2 of them have applied for
manager's licenses. She stated that every employee will now know what the capacity
is. She added that the scanner that security uses to check IDs will count the capacity.
She stated that one of the women fighting in the video was someone who snuck in
from the alley and was removed by security. She added that when she found out about
the overcapacity, Mr. Lockett began shutting the premises down. She stated that the
overcapacity was unacceptable and she has ended the contract with the security
company. She stated that Dante was managing the night of the overcapacity and he is
no longer a manager. She added that she has retrained staff and made them sign the
safety plan. She stated that February 28th was an isolated incident.

Royce Lockett stated he is the co-owner and he signed a contract with a new security
company. He added that the security guard has a hand gun and a M16, not an AR15.

not wearing masks, no social distancing, and overcapacity.

Patrick Bauer 2215 N Vel R Phillips Ave #305 stated that he has heard gun shots and
called the police. He added that when the premises closes he has seen patrons driving
recklessly, urinating in public, dancing on cars, and partying in the street, and the
security guards do nothing. He stated that patrons sit in front the premises in their cars
playing music loudly. He added that he has called the police regarding problems at the
premises.
Individuals present in support:
Travis Clark 9418 N Green Bay Rd, Brown Deer, WI stated he is in support. He added
that premises shouldn't be responsible for the actions of their patrons. He stated that
when establishments close it hurts the employees and the community.
Deshea Agee Executive Director of the King Drive BID stated these issues are an
irregular occurrence, but it will cause people to reflect on King Dr differently. He added
that he goes to the establishment, but he is concerned about what is happening at the
premises. He stated that he has spoken with the applicant and Mr. Lockett about the
seriousness of the incidents.
Ald. Coggs stated the capacity should be reduced to 200 because a lot of the issues

have to do with the amount of people at the premises. She added that security guards
should not have such large firearms at the premises. She stated that the premises
should no longer use promoters. She added that there is a belief that there is a culture
where the premises permits certain behaviors. She stated that after the February 28th
incident she got calls, emails, and messages about what happened. She added that
she spoke with the applicant and Mr. Lockett and there was in instant commitment to
make changes. She stated that this is about how the premises responds to incidents
like this, what their abatement plan is, and their ability to implement their abatement
plan and turn it around. She added that the amount of time, investment, and energy put
in to make King Dr the best in the nation, it is important that all establishments
operate in the best ways possible to not disrupt the neighbors around them and to
keep their patrons safe.
