The applicant stated the guy who made the comments to the police was drunk.
Appearing with the applicant:
Josefine Gonzalez stated that they were eating upstairs in their house when they heard
the police coming they all went downstairs. She added that she didn't call the police,
they just arrived and acted like they were the one causing problems. She stated that
the person on the report wasn't even present at the time, he was in his room sleeping.
She added that the guy from the police report is the wrong guy and there are a lot of
incorrect things in the police report. She stated that the police are harassing her and
her husband and they were victims, but they were treated like criminals. She added
that she didn't know where to go for help. She stated that the applicant was in the
back room stocking the refrigerators and it only took him a few minutes to get to the
front bar, and the bartender was not alone. She added that they didn't call the police
because they just chased the guys away because it happened before. She stated they
provided the cameras to the police and still have not received them back. She added
that she and the applicant were in squad cars for over 2 hours. She stated that the
police went into her house when she asked them not to because she has a 20 year old
autistic son. She added that she called Ald. Zamarripa 3-4 times and never received a
call back.

Ald. Zamarripa stated she spoke with Capt Salazar regarding the police items and that
if the applicant has concerns he should contact her office. She added that Ald. Perez's
office reached out to her regarding the premises, and she has been following the case
closely. She stated that she is concerned about the premises being open after hours
because it puts the residents in danger. She recommends renewal with a 20 day
suspension.
Ald. Borkowski moved approval with a 20 day suspension based on the police report

The applicant stated he asked the officer why they were pulling up in front of the
premises because nothing happened. He added that he and his staff were not picking
up shell casings, they were picking up loose change and jewelry. He stated that the
police told him where the shooting occurred and that's why he knew where to look. He
added that he was moving the gravel around with his foot and he threw the jewelry
away.
He stated that his cameras have a blind spot because of a roof. He added that he
wasn't able to provide the video the night of the incidents, but the police could come
back later to retrieve the video. He stated that he plans to reposition the camera so
there isn't a blind spot.

Atty. Kendrick Yandell stated the applicant is cooperative with the police and provides
video evidence when things occur at the premises. He added that they use a hand held
counter, to count patrons as the enter and exit. He stated that over the past 2 years
the premises has substantially improved their operations by putting up cameras,
increasing security, and cooperating with the police regarding problems in the area. He
added that there are no incidents with weapons at the premises because security does

a rigorous screening of patrons and they have metal detectors. He stated that the
premises now blocks the entrance to the alley and they have added lighting and
fencing. He added that charges were dismissed at circuit court and there's no evidence
that the applicant picked up any shell casings. He stated that the shooting didn't
happen at the premises, it happened at a nearby property. He added that the applicant
never argued with the police officers and didn't cover anything up. He stated that the
patrons who talked to the police about a gun at the premises were drunk, and a gun
was never brandished. He added that the applicant has cooperated with the police and
their security guards frequently walk the block to make sure people aren't breaking in
to cars. He stated that the applicant has made a lot of efforts and spend thousands of
dollars to make sure the premises is safe for the patrons, community, and employees.
He added that they have assisted in numerous police investigations by provided
videos. He stated that the premises is trying to be an asset not a drain on the
community and is doing everything feasible to make the place safe. He added that
they cannot read the minds of their patrons to know if they have a gun in their car or
are going to start a fight.

PO Kevin Vodicka narrated the videos provided by the Police Department. He stated
the applicant appeared to have spent shell casings in his hand and was shaking them.
He added that a responsible business owner should turnover evidence of a crime. He
stated that the police didn't know where the shots came from because the responded a
few minutes after the shots were fired. He added that there have been issues with
cooperation between the police and the applicant.
Capt Salazar stated he has viewed the videos in the file regarding the firearm
incidents. He added that he is concerned about the patterns of behavior and violent
crime. He stated the gunfire is likely involving patrons and security personnel is seen
in 2 of the videos. He added that there is also a lack of cooperation and he is
concerned about someone getting injured.
Individual also present:
Ald. Perez stated he doesn't know why the applicant didn't call the police. He added
that in 2019 there was a 10 day suspension with an age limit of 25 and up based on
the police report. He stated that last year there was a 15 day suspension with several
neighbors testifying. He added that he is concerned about the gun play and the
behavior of the applicant. He stated that he is not in support based on the police report
and testimony he heard today. He added that a neighbor had an issue and the
applicant put up cameras in the alley, put up a fence, and paid for the damage to the
garage. He stated that there are no issues with guns at other bars in the area. He
stated that the applicant has been responsive to an extent, but it is reactive. He added
that successful bars make people feel safe, and make people who want to cause
problems uncomfortable.
