Individual present in opposition: Daniel Zelonky 1031 W National Ave stated the premises doesn't clean up outside and has patrons loitering outside. He added that there's already enough bars and lack of parking. He stated that he is concerned about property values. Ald. Kovac moved to hold to the call of the chair so Ald. Appearing with the applicant: JB Lathers 1814 N 51st St stated he is the property owner and the applicant is the main bartender. He added that he is aware of the issues in the past and the premises will not be open until bar time. He stated that the police told him the previous issues were from the rooming house not the bar. He added that he will be putting apartments in the premises also. He stated that this will not be a loud establishment. He added that he has received support from some neighbors, businesses, and the Walker's Point Business Association. He stated that he is disappointed because he has done everything to accommodate the neighbors. He added that he will install security and activate that corner of the block. Individual also present: Ald. Perez stated this location has a history of issues with the bar and rooming house. He added that he has spoken with the neighbors and he does not support the application at this time. Individuals present in opposition: Rebekah Kopec-Farrell 813 S 3rd St stated that there have been problems at the premises previously and she is not in support. She added that JB Lathers is the owner and agent of the property and LLC. She stated that the applicant was told the neighborhood is not in support of the premises. Brian Kopec-Farrell 813 S 3rd St stated he agrees with the previous speaker. He stated that the noise levels can be intolerable for his children and lack of parking has been an issue also. He added that this is not a good business for a residential neighborhood. Betty Ulmer 821 S 3rd St stated she is a long time resident and when the premises has been operating as a bar has been a nuisance. She added that there have been issues with noise, shootings, and interrupts her enjoyment of her home. She stated that parking is already an issue on the street. She added that she strongly objects. David Martin 828 S 3rd St stated he has been in the neighborhood for 30 years and he strongly objects to any bar on 3rd St because of the effect on the revitalization efforts in Walker's Point. Ald. Dodd moved denial based on neighborhood and aldermanic testimony. (Prevailed 3-0) A motion was made by ALD. DODD that this Motion be AMENDED. The applicant stated she is willing to change the opening time to 5 PM. She added that they have security and a patrol car. She stated that everything will be cleaned up at night time. Appearing with the applicant: Atty. Robert Webb stated there will be security cameras, security personnel to manage parking and bar close, and there will be several trash receptacles for patrons to use. Individuals also present: Danielle Wren 3611 N Teutonia Ave stated she runs an adult daycare center and parking becomes a problem in the afternoon and evening. Richard Steggeman 3629 & 3718 N Teutonia Ave stated the property is dirty and 2 months ago there was a repass party that required his business to close because of threats by members of the party. The applicant stated he just wants to get his license and support his family. He added that he wasn't aware of any of the neighborhood complaints. He stated that there are four different businesses in the premises and he plans to put a fence up and buy the building. He added that he can't address issues until he gets his license. Appearing with the applicant: Atty. Christina Balistreri stated the applicant didn't know the citation was on his record, but it has been paid. She added that the applicant hasn't received any citations about noise. Individual present in opposition: Marcia Townsend 7745 W Beckett Ave stated there has been loud music playing and there are cars getting detailed. She added that having cars in alley is a nuisance for children. She stated that the premises has been open since September 3rd opening at 8 AM every day. She added that she has contacted the alderwoman's office and the police several times. Ald. Dodd moved to hold for clarification about the property. Individual also present: Dameon Ellzey 15th District Legislative Assistant stated Ald. Stamper has received similar complaints about this premises. He added that DNS has issued orders about illegal dumping and littering. He stated that Ald. Stamper does not want more than 1 machine in a store at a time. Individual present in opposition: Nuputer McBroom 1304 W Garfield Ave stated she lives directly behind the gas station and has complained about the trash in the alley and her yard from the premises. She added that she has talked to the employees about the patrons loitering and they have been disrespectful to her. She stated that the premises is packed with cars, loud music, prostitution, and drug dealing at all hours of the night. Ald. Dodd moved to hold to the call of the chair. Stamper would like the lot to be cleaned 3 times a day because of the debris around the lot. Ald. Borkowski moved to amend the plan of operation to include cleaning 3 times a day. Vincent Bobot stated the premises has 16 cameras, 4 outside and 12 inside. He added that it was an employee's boyfriend who was the one causing the issues in #8 on the police report. He stated that the employee was terminated. He added that the applicant is willing to close at 12 AM. He stated that the applicant is committed to hiring people from the neighborhood and he does not support storing drugs at the store. He added that the applicant is committed to running lawful operation and a 30 day suspension is too harsh. Individual also present: Dameon Ellzey 15th District Legislative Assistant stated Ald. Stamper is concerned about the premises because of the October drug incident and there was no explanation. He added that it is unacceptable to have drug activity at the premises. He stated that some kind of punishment is necessary because there seems to be a lack of control by the applicant at the premises. He added Ald. Stamper recommends a suspension of 30 days and removing the Extended Hours license. Ald. Kovac moved nonrenewal of the Extended Hours Establishment license application and approval, with a 30 day suspension of the Filling Station, Food Dealer, and Weights & Measures license applications based on the police report and aldermanic testimony. She added that they previously operated in Riverwest for 6 years with no issues. She stated that they live in the community and they notice a lot of vacant buildings. She added that the premises is like a Starbucks with spirits. Individual also present: Dameon Ellzey 15th District Legislative Assistant stated Ald. Stamper is not in support of this location because there are issues in the evenings on the corner. He added that this is near another bar that's already open. He stated that this area has an issue with concentration. He stated that this could be held for further clarification about the business operations. Ald. Kovac stated the applicant has no issues at their Riverwest location. Ald. Dodd moved to hold for meeting with applicant. (Prevailed 4-0) A motion was made by ALD. DODD that this Motion be AMENDED. He added that there are already problems in the area with scooters and parking. He stated that he was assaulted at the premises in 2013. Ald. Kovac stated the premises is a neighborhood institution.
