Establishments and Food Dealer License Renewal Applications for "McDonald's" at
2520 W National Av. (Expires 2/16/2022
The applicant was present and said that it was a horrible incident regarding the item on
the police report but that they have hired security, remodeled the entire building and
secured the bathrooms and have trained the staff to avoid a situations like that one.
Added that they are making sure that it never happens again.
Individuals also present:
Ald. Perez asked the applicant what has worked from what was talked on the
neighborhood meeting from 2020?
The applicant said that he has retained the employees that were there before Covid,
that the lobby is closed since then and that the 24 hours license is not working in full
since then and that hey have trained the staff to keep everyone safe and to deescalate
situations.
Individuals in Opposition:
Francisco Limon Jr - 772 S 27th St - Said that they leave behind the drive thru and that
things have slowed down since they are not open late hours but when it is working they
have cars with loud music, traffic, garbage dumped at his property, fights. Added that
he understands that they cannot control their patrons but hopes that something can be
done to stop this issues for the neighbors.
Ald. Perez asked if Mr. Limon has contacted the manager.
Mr. Limon said that he has not because he is not sure what the manager can do.
Mr. Kennedy said that his email and phone number is posted on the store and that he
can be contacted at any time.
Ald. Perez asked if he has staff checking the outside of the premises.
Mr. Kennedy said that he has sign up sheets and that every 30 minutes they check the
outside.
Ald. Perez said that if neighbors can call him if they don't observe those checkouts
around the premises.
Mr. Kennedy said that he will give his personal phone number and that he has other
businesses in the area.
Ald. Perez asked if the 24 hr license is necessary.
Mr. Kennedy said that it is a good amount of business at late hours but not at the
point to upset the neighbors and agreed that a sign is not going to stop people from
doing what they don't want them to do.
Ald. Zamarripa said that her office reached out to him because he missed the first
hearing but that she heard that Mr. Kennedy is willing to change the hours because
she is very concerned about the incident that happened almost a year ago and that
she wishes he closes at midnight and that he will need to watch for the garbage
because he needs to show pride in the business and neighborhood.
Mr. Cooney said that a withdrawal of the extended hours is recommended for this
matter.
Ald. Perez moved to withdrawn the extended hours application.

The applicant was present.
There were about 18 callers to testify in favor of this business.
Individuals also present:
Ald. Rainey said that this application was held to hold a neighborhood meeting
because one neighbor was in opposition but that she is not present today and that he
does not think it is necessary to hear all of the supporters.
Atty. Toran on behalf of the applicant said that there were about 25 neighbors and all
of them supported the business and he agreed on bypass the supporters testimony.
Ald. Rainey said that there are a couple of things to be recorded. He asked the
applicant to stripe the parking lot and to put up a fence just to check next year if this
was accomplished.
Atty. Toran said that they are aware of the request and that they will work on when the
weather permits.
Ald. Kovac moved to include the stripe of the parking lot and to put a fence on the plan
of operations.

The applicant was present.
Atty. Michael Maistelman said that the police report shows that his client has
cooperated with the investigations and that it is an epidemic of gun problems in the
city and that he has submitted an amended plan of operations to the license division
and that he wanted to make sure that it is on file.
Mr. Cooney said that it is on file.
Atty. Michael Maistelman talked about the submitted plan of operations (attached to
the record) and that he will take any questions from the committee regarding the plan.
Individuals also present:
Ald. Perez said that he wanted to hear an historical context because he believes that
the same things were said at last year's hearing and that it does not seem to be
reflected on the current file yet so he wants to know what is the difference between last
and this year.
Atty. Maistelman said that they brought the security guards in, and that they have done
a much better job and that there has been a significant change from last year. Added
that by looking at the police report, there is a security guard involved in every incident
and that actually one of them was shot while walking outside and trying to address
situations like these. Said that it has not been any problems with people coming in

with weapons since they implemented the plan.
Ald. Perez said that a homicide happened inside the premises on the last cycle and
another homicide happened outside this year and that Atty. Maistelman talks about
things have changed but he does not see how things are different from last year.
Atty. Maistelman said that there is an epidemic of gun violence in the city and that is
not easy to take the guns off the streets but that the security guards are addressing
the problem the best they can and that we are up against of a mayor tidal wave of
violence.
Individuals in opposition:
Lori Banks - resident of the neighborhood around the bar - said that she has written
multiple letters because this establishment must be closed because it was what they
were told at the meeting held last July and that we are here like last year (February
2021) discussing the same issues. Added that there have been two murders, multiple
shootings, constant break-ins to her home and neighbors, to cars and that, she is
aware of some strategies that might work but they don't trust this business anymore
and that they live in fear.
Theresa Scott - 4535 W Leon Tr - asked that the license not to be renewed because
the shootings on the police report actually happened on her block and that Mr. Jones
never took the phone calls of the neighbors until today that was the hearing date which
shows that he is not interested in the neighborhood. She said that it is true that the
violence is happening in the entire city but that she is here because of the violence
that is happening right at her door and that there is no trust on this bar anymore and
that it shouldn't take the police to come to check on the noise complaints from the
residents. Added that the meeting with the police and the applicant was held on July
30, 2021 and that none of the neighbors has heard from the applicant or his attorney
since then.
Timothy Scott - 4535 W Leon Tr - said that he is disturbed about the comments made
by the applicant's attorney because the neighbors are the ones dealing with the
shootings, garbage, empty bottles, noises and disturbances coming from the bar and
with the patrons using the alley.
Mabel Lamb - Sherman Park Community Association - said that they have received
numerous complaints about houses being broken-in, guns stolen out of vehicles,
noise, garbage and that this establishment has been creating a situation that
neighbors are planning on to move out and that as a community association will
support the quality of life of the residents. Added that the area is over saturated with
alcohol licenses, and that it is hurting the neighborhood and that the association is not
in support.
Mr. Prince Harris - 4541 W Leon Tr - said that he does not want the license to be
renewed and that since July that they held the meeting with the police, he has
observed that the clientele is 21-29 years old and not older than 30 years old like it
used to be when Mr. Jones (the previous owner) held the license. He added that he is
not happy about having virtual hearings because not everyone can do it or connect to
the meeting and about the radius used for the notices. Said that a building as big as
Mr. Jays the neighbors from 3- 4 blocks radius should be informed.
Carla Harris - 4541 W Leon Tr - said that she agrees with what her neighbors have said
and that the neighborhood does not benefit at all from this business and asked for the
license not to be renewed.
Individuals in support:
Phelon Thadison - 11010 W Heritage Dr - said that he understands the neighbors'
position but from his professional point of view as a retired police officer and as a
patron; the problems are not directly related to the establishment itself and that this is
an epidemic that it is beyond the scope of the business that is trying to provide jobs
and that he has observed that this business have 30+ years old crowds and that they
do everything to deescalate situations and that whatever happens outside Mr. J's

happens in the city of Milwaukee not at the bar and that we cannot close businesses
for that.
Ald. Borkowski said that he has not a question for the retired police officer and also
thanked him for his service but explained him that they are here not to destroy
businesses but to represent the neighbors and that these are not minor things, that
there were 10 incidents on the police report and that it is disappointing to hear his
testimony because he does not know the history of this license and the severity of the
issues.
Atty. Andrew Arena said that he represents the owner of the building and that he
organized the meeting on July 30th including Ald. Rainey and neighbors.
Ald. Rainey clarified that meeting that Atty. Arena is talking about was for a liquor
store application and that the one that the neighbors are talking about was organized
by the police.
Atty. Arena said that the meeting that he organized was about a grocery/liquor store in
the same building and that the neighbors did not want it because of the saturation. He
added that Mr. J's was at the meeting as well and that they were made aware of the
issues with the business at the meeting so he talked to Mr. Jones because it seemed
that the problem was that Mr. Jones increased the size of Mr. J's by taking the half on
the back of the building and having entertainment geared toward younger people. He
explained that they even talked about cutting it in half to have a separate lounge for
older people and this is what he thought the applicant was doing today. He stated that
it is what they agreed on and that he's just finding out that it's not as such and that
what the applicant wants to do seems not to be a good fit according to the neighbors.
Atty. Arena added that he, representing the owners of the building can do things with
the lease like punishing or even evicting if the problems are not corrected and
suggested to the applicant to get a handle and that he is available to answer any
questions.
Michael Chisholm - 3637 N 49th St - said that he is a customer and that he has
noticed the changes that have done in the community and for the community like
scholarships and that they clean around the premises.

Ald. Rainey said that he does not support the renewal based on the neighborhood
testimony.
Mr. Jones said that he filed a renewal application and that no one has addressed a
problem with him involving the club and that he does not relate to any of these
complaints and that he has reduced the capacity from 350 to 99.
Atty. Maistelman said that one person killed is too many but that we see the violence
happening everywhere we go and that the measures that they have taken will help with
the gun violence and with the loitering and noise complaints and that he respectfully
requests a small suspension to resolve and address other issues.

Atty. Vincent Bobot appeared with the applicant and an interpreter.
Atty. Bobot said that regarding the incident from June 13, 2021 still do not know what
happened on that particular date and time but that the incident did not happened inside
the premises and that on December 11, 2021 he was handling the citation at that
moment and that somewhat disagrees with the change of events but that the business
it is closing 30 minutes earlier to avoid situations like the one on the police report.

Ald. Perez asked if they are doing something about the complaints made on the
redacted record that was mailed out to them.
Atty. Bobot said that the are doing a very comprehensive parking analysis and will do
something in conjunction with the neighbors and the city of Milwaukee and that her
client is committed to close half an hour earlier and that she is working with the
neighbors to address issues respectfully.
Ald. Perez said that he has communication with the applicant and the attorney and that
he is satisfied with the plan of action about the parking and calling the parking
checkers and that the applicant lives upstairs so that explains why people comes in
and out from the building at any time and that he took this complaint very seriuos.

but a deeper conversation is needed with the neighbors.

talking with Ald. Lewis about to become a better neighbor.

The applicant was present and said that he has been on Capitol Dr for seven years and
that they have grown out this location so he is taking this opportunity at MLK Dr.

Ald. Coggs said that she had the opportunity to visit the location which has turned out
be beautiful and hopes that he is successful at this location as well but that she will
hold the public entertainment premises application because it is a new business but
that she will work with the applicant for special events permits.

impacting the life of the residents which is an inconvenient to everyone. Added that the
Disc Jockey and the Karaoke are a problem because the bass sound and the
frequency hurts the neighbors.
The applicant asked for an opportunity to prove that she is willing to amend the sound
issues.
Mr. Barnard said that he wants the applicant to succeed but the he wants to make
sure that measures are taken to level down the bass noise.
