Mr. Cooney said that the address of the premises was entered correctly but the mailing
addresses list came back with addresses from the north side of the city so Ald.
Borkowski reached out to the applicant to explain the issue and requested to hold the
application to fix the issue.

The applicant was present and said that they are trying to open a beer garden at this
location and that it is a seasonal operation (six months) and that everything will be
taken down during the off season.

Ald. Coggs said that she had an opportunity to meet with Mr. Marking and that her
greatest concern is the Disc Jockey.
The applicant said that the types of entertainment won’t be frequently

The applicant was present and said that the proposal is to have a six food truck park
with indoor seating with a coffee and pastries bar and adult beverages. Added that this
business model is based on others around the city and that each vendor will have their
own food license.

Ald. Coggs said that she held the meeting with the neighbors and that the majority
supports the application and that she will hold the Disc Jockey request for a while just
to make sure that the Public Entertainment Premises license can be handled.

Atty. Vincent Bobot appeared with the applicant.
Atty. Bobot said that the employee had the weapon secured at the counter and
that when the employee was asked to retrieve an item from the back of the store, he
left the door unlocked and the weapon was taken. Added that no weapon on premises
is stored since the incident on the police report and that his client has terminated the
employee for this matter.
Ald. Borkoswki moved approval with a warning letter based on the police report.
(Prevailed 4-0).
Ald. Borkowski moved to reconsider the application at 11:32 am due an individual
testimony was not heard.
Individuals in opposition:
Finn Phoenix - 2662 N Palmer St. – said that she has a variety of concerns with a lot
of gun violence tied to the store, lots of garbage all over the place and people loitering
in the neighborhood after visiting the store. Added that she is not willing to work from
home and to spend time around due the harassment to her and partner. She is worry
about the police report not truly representing what the real problem is.
Ald. Coggs offered to work together with Ms. Phoenix and Atty. Bobot on the issues
that the neighbor brought up and asked Atty. Bobot what is the plan for the loitering.

Atty. Bobot said that her client is a very responsible owner and that they were not
aware of loitering issues and that they are surprised about these issues being brought
up today and that he recognizes that area have some challenges.

is that those no loitering signs have been posted.

Ald. Coggs said that she lives close and that she has experienced the loitering as the
neighbors do and that the outside looks filthy and dirty and that a business like
Walgreens should have a better management.
Mr. Cooney looked at the plan of operations which says that the premises are cleaned
and pressure washed daily.
Ald. Coggs said that he does not believe that it is true and asked Atty. Butler to work
with her office on this issue.

Ald. Bauman said that the committee recommended not to renew this license about
two years ago based on the police and neighborhood testimony and that discussions
have been going on since then. Added that he has a plan of operations that is
acceptable to him and asked the committee to approve this application.

The applicant was present along with Atty. Jason Luczak who said that regarding the
incident on the police report from June 13th, 2021 that there was no fight inside the
club (according the report as well) and that these groups were separated down the
street. Added that regarding on the incident of March 28th, 2021 said that these minors
got in with fake id’s and that everyone is checked for id.

Ald. Coggs asked if the business has a scanner id.
The applicant said that they have a scanner id and that it was used on the night of
March 28th, 2021.
Ald. Coggs asked if they have cameras by the door where the id’s get checked.
The applicant said that she has 2 cameras right there and that the police did not
request to review the surveillance video neither the scanner.
Individuals in opposition:
Ms. Youngers – said that she opposes based on the police report incidents and also
because one person died from the injuries received during a fight that happened at the
bar.
Atty. Luczak asked Ms. Youngers when this incident happened.
Ms. Youngers said that it happened on 2019.
Mr. Erinson – 608 N Broadway said that he opposes to this license based on the police
report.
Individuals also present:
Ald. Bauman asked to Mr. Cooney what has been the history of this business.
Mr. Cooney said that it received a warning letter on 2021, a 15 day suspension on
2020, a 20 day suspension on 2019 and a 10 day suspension on 2018.
Ald. Bauman said that this business and the other one next door are very good at
pointing fingers at each other at renewal so he recommends a 30 day suspension
based on the police report and history.
Atty. Luczek asked for a warning letter instead because the other business is a larger

one and that his client has been cooperative with the police.

The applicant was present.
Individuals in opposition:
Mr. Erinson – 608 N Broadway – said that he has no objections with the operation but
has concerns regarding the speaker on the rooftop (travel sound) and the business
hours.
Mr. Bauman asked Mr. Erinson about the rooftop’s operation.
Mr. Erinson said that he has lived there for 50 years and that they never have a
problem with sound and noise until the rooftop opened.
Ald. Bauman said that the music on the rooftop is a concern for many neighbors and
that he wants no music at the rooftop and that it closes at midnight.
The applicant said that it is an open area that can be rented for private events.
Ald. Bauman said that the problem is the private events with loud music outdoors and
asked to hold this application until an agreement is reached or to sort the use of it
because the rooftop is a problem waiting to happen.
Ms. Youngest - said that they were told that no dumpster was going to be visible
The applicant said that they have created an indoor dumpster expense with a garage
door to cover it.

and shot the customer. Added that he was told by the police that the victim was being
followed up.

The applicant was present said that the incident on April happened a week after he
took over and that there is a policy about no weapons on premises but they let the
patron to carry the gun while he shopped just to avoid a confrontation.

The applicant said that they do and that it is the same security business from 10 years
ago.
Ald. Dodd said that there are no other issues and that the applicant has been trying to

The applicant was present and said that the item on the police report is very rare.

Ald. Spiker said that this application was scheduled because his office received a
complaint about scraping metal at early hours and that he talked to the applicant
about it and that he is positive that it won’t be an issue in the future so he
recommended approval.

The applicant was present.
Individuals in opposition:
Susan Thompson – 2702 N 46th St – said that she is concerned about the young
people loitering around the store and the cars that go around the neighborhood and
blocking garages. Added that the amount of trash is unbelievable.
The applicant said that he has been very cooperative and asked Ms. Thompson how
he has not being cooperative.
Ms. Thomson replied that he has not reach out to the applicant personally.
Annie Young - 2707 N 40th St – said that they are selling food that they are not
licensed for and the gathering of young kids skipping school and that she is afraid
from something bigger to happen and that she does not see any efforts from the
business to work with the neighborhood just band aids.
Peter Blewett – 2750 N 45th St – said that he picks up garbage everyday and that the
parking is the less of the issue but the reactions from the patrons when they are
asked to move their cars from blocking garage doors is what he is the most
concerned about because they are exposed to unnecessarily violence and that there is
need to be a light on the back of the premises and to make sure that no students are
hanging out at the store during school hours.
The applicant said that he changed the business hours to 9am to 9pm and limiting the
numbers of students to 5 at the time and that he is working with the school.
Ald. Coggs asked about the lighting on the back.
The applicant said that the landlord brought an electrician and that a light will be
hooked up.
Coree Coppinger - 2700 N 45th St – brought to the attention that we were speaking to
two different persons.
Atty. McNally asked for a clarification of the situation.
The interpreter said that he has been interpreting with the microphone off and that his
name is Ahmad Issa and turned the camera on as a petition from Atty. McNally
Ms. Coppinger said that we have a book from her complaints and that it is a very
complicated corner needs which needs a lot of attention and that she has been
working with the police, Ald. Rainey and the applicant and that she realizes that the
cruisers and the location are also the issue. Added that she believes in collaboration

and that they have had different owners making promises that they cannot keep but
Adel has put up signs for no weapons allowed and Aman has been asking cars to
move from garage doors and that she is asking to the applicant to keep up with the
security plan and the collaboration with the business and neighbors and to clean up
the premises. Added that it is a work in progress.
The applicant asked to Ms. Coppinger how it has been since they took over the
ownership.
Ms. Coppinger said that it has improved and that she hopes to see it getting better
along the year.

Ald. Coggs asked for a clarification of the application.
Mr. Cooney explained that this premises address were scheduled before with a
different legal entity but the application got denied upon second nonappearance.
Ald. Rainey said that he wants to be thoughtful and to sit down with neighbors and the
applicant to set up a plan of standards that works for both and requested to hold the
application to the call of the chair.

not opposed, but wants the appearance of the property improved.

Individuals in opposition:
Robert Bach - 5128 W. Bluemound Rd. Unit 401- said that it is a nuisance property
and that the applicant didn't fulfill his promises as regards to noise, lawless behavior
and waste management. He said that he has tried to express his complaints to MPD,
but gave up after long hold periods. Added that there is excessively large sound music
with large bass and that he can hear the bass beat after midnight on weeknights. He
said that there is also excessive motorcycle noise and the dumpster is often left open,
which is a rat attractant. Added that he would like a penalty or non-renewal and that he
wants assurance that there will be compliance on the promises made last year.
Leslie Quade - 5128 W. Bluemound Rd. - said that the noise complaints occur after 10
pm and that she called MPD this past weekend at Added that she has contacted both
MPD and Caliente about the noise and once, an employee, when asked to turn the
noise down responded, "Why would I want to do that?" The noise is audible in every
room of her home, even with closed windows.
Gail Shah - 5128 W. Bluemound Rd. Unit 301 - said that she agrees with her neighbors
and that on Feb. 26th there was a large RV parked on the street blaring loud music,
drinking, smoking, swearing and yelling in Spanish and that they took off once they
heard a siren coming and then sped through a red light. She said that she is afraid
this is becoming an after-hours neighborhood hangout.
Gretchen Schuldt - 5128 W. Bluemound Rd - said that they have been a horrid
neighbor as she has spoken with the applicant twice, who suggested it was personal.
Also said that the noise is consistent on Friday and Saturday and animals digging in
the dumpster. She said that she sees people at the restaurant at 4 and 5am who
appear to be customers. Added that the fire pit installed last summer has resulted in
drinking and increasing noise throughout the night.
Dave Umhoefer - 5128 W. Bluemound Rd, Unit 402 - spouse of Ms. Schuldt - said that
there are events at the bar that are even louder than the music; it penetrates their
windows and all rooms at his condo. Added that the applicant has not been
cooperative and that the outdoor patio is used for after-hours party.
Individuals also present:
Ald. Muprhy said that forthe record, he has shared all the complaints from the
neighbors with the applicant and that based on the neighborhood testimony he
recommends a 30 day suspension with the clear message that the applicant must
keep his promises and to cooperate with neighbors and that he would not support the
additional requests for entertainment from the applicant.
Atty. Michael Maistelman - said that they they will close at 10om on weeknights, no live
bands and that they will hire a sound technician to address the noise, including the
bass sound, as well as set up monthly meetings with the neighbors and that the
applicant will provide his personal contact information. Added that they will also hire a
new garbage contractor prior to the Council meeting.
Mr. Fonseca said that his establishment is primarily a restaurant and that it is hard
running a business now, particularly if he has a 30-day suspension. He said that he
was not aware about any of these complaints except for the ones from Ms. Gretchen

and Ald. Murphy and that no one is allowed on the patio after 11pm after there was a
problem with employees on the patio, but he dealt with it (suspended an employee).
Ald. Kovac requested a clarification for the current types of entertainment.
Mr. Cooney said that the license includes a jukebox and 2 amusement machines.
The applicant said that the establishment currently has no performers and he would
like to add salsa dancing as his wife is a salsa dancer, as well as dancing by
customers and that he is getting speakers with no bass sound to reduce the sound
and no longer will allow anyone under the age of 25.
Ald. Murphy said that the mayor complaints from the neighbors are the noise outside,
the loud music and the unresponsiveness from the owner and that the neighbors don't
trust the owner to keep his word.
Mr. Bach said that the promises the applicant made a year ago have not been fulfilled
so he does not trust with more promises.
Ms. Gretchen said that if the applicant have replaced the speakers as he said he did,
it is not working and that what he is requesting today, it is already happening according
to the business Facebook page and that she no longer trust him.
Ald. Coggs said that Atty. Maistelman mentioned few things that the applicant is doing
now and she asked to Mr. Cooney if those are part of the record.
Mr. Cooney said that they are not.
Atty. Maistelman said that the plan is closing at 10 pm Sunday - Thursday, to hire a
sound technician to reduce the sound emanating from the building, to have monthly
neighborhood meetings to address any concerns

contacted for any issue and that signs have been posted about the shopping carts and

incident from January 7th of 2021 which happened at the gas station however that the
person (victim) was in a party and not feeling well and that it was reported immediately
to the police. On the panhandling issue said that he is working with the owner and
working with the alderwoman and neighbors to run a responsible business.

believes this location should be declared a nuisance and that she fears for their
customers and employees. Added that she needs a written plan for on-site security.

neighbor complaints and that she has no issue with renewal.

The applicant explained that they had two locations before this license was
implemented and that they were asked to select one as the main yard and the other
one as the additional per Ald. Kovac's request.
Individuals in Opposition:
Jean Bikomeye - 305 N 95th St. - said that his car was towed and that he was charged
$348.15 which he believes was an over-charge and the tow was done very quickly and
that there is a discrepancy on the tow report about the time that the car was towed.
Ald. Kovac if someone has reached out to him to explain the over charge.
Mr. Bikomeye said that no one has reached out to him with the explanation that he
requested regarding the overcharge and the time discrepancy.
Atty. Obviagele noted that Mr. Bikomeye had gone to an establishment across the
street, and that he spent more than the 60 minutes permitted and that special
equipment was used to tow the car per the exhibits (photos) used.
Ald. Kovac noted that 3 out of every 4 tows is a "special tow" and that the customer is
charged double and that no specific explanation was given for the use of that special
equipment. Added that this "special tow" is permitted through state law but thinks it is
an abuse.
Atty. Obviagele noted that only 69.5% of tows are "special tows".
Atty. Maistelman said that the 69.5% of special tows is for all the towing licenses in
the city not only from his client.
Ald. Kovac said that it might be a way to look up at these numbers and to make a
communication file with this data to see if it needs a red flag.
Atty. Maistelman and Atty. Obviagele waived their closing.
Ald. Borkowski moved approval with a warning letter.
Mike Tarantino - 8219 W Carmen Ave. - said that he filed a complaint with the License
Division and that he has formed a company that represents the consumer side of the
towing process with the idea to educate the public.
Atty. Maistelman said that they do not have the letter on the file that Mr. Tarantino is
talking about.
Mr. Cooney said that the redacted letter is included on the file with links from
YouTube.
Atty. Maistelman agreed that he has the documents on the file.
Mr. Tarantino continued per Ald. Kovac's request said that the company was violating
provisions of the State Code as it concerned Terrence Smith as a subcontractor. He
said that he felt his vehicle was being held hostage if he didn't sign a statement
holding the company not liable for any vehicle damages. He said that he requests the
revocation of the license and that he also has video of a wheel skate that wasn't even
under the wheel despite being a "special tow" and if excess equipment was used just
to charge more.
Atty. Obviagele objected to the testimony of Mr. Tarantino.
Atty. Maistelman was sworn in and provided testimony that Mr. Tarantino had
requested additional money after paying out a settlement offered to him after working

with Always Towing & Recovering.
Mr. Pehowski said the car is released once payment is made and it's not "held
hostage", although Mr. Bikomeye and Mr. Tarantino disagree. Added that It is a
standard practice to have individuals sign a waiver, but they don't hold a vehicle until it
is signed.
Mr. Bikomeye said he was told he had to sign a piece of paper before he would get his
car.
The invoice has the legal language reference holding harmless All Towing and, if not,
signed, they are solely given a receipt for payment. The customer has to look at
his/her car prior to signing the invoice. Mr. Pehowski said individuals can cross off the
legal language if they do not agree with and sign or not sign the invoice and their car is
released.
Ald. Coggs moved to make the picture part of the permanent record. There were no
objections.
Mr. Keith Grady gave his testimony who stated he used his personal phone to take this
picture.
Ald. Kovac believes that the company's use of flat bed trucks has resulted in the
company's always having to do "special tows" and charge double.
Peter Knox - city tow lot - he can't say a simple "yes" or "no" for the use of a flat-bed
truck and the state statute has a great deal of subjectivity.
Ald. Coggs asked the City Attorney for a formal legal opinion on tow companies having
primarily flat bed trucks and using that as the reason to charge for "special towing".
Ald. Borkowski moved renewal with a warning letter. (Prevailed 4-0)
Ald. Kovac that he wanted to make sure that next year he won't take an empty flat bed
and charging special tow fees.

Judiciary and Legislation, Licenses, Public Safety and Health, Public Works, Zoning, Neighborhoods
& Development, and/or Steering and Rules. Whether a simultaneous meeting is occurring depends
on whether the presence of one or more of the Common Council member results in a quorum of the
Common Council or any of the above committees, and, if there is a quorum of another committee,
whether any agenda items listed above involve matters within that committee’s realm of authority.
In the event that a simultaneous meeting is occurring, no action other than information gathering will
be taken at the simultaneous meeting.

Milwaukee Center on the southwest corner of Kilbourn Avenue and Water Street. Parking tickets
must be validated in the first floor Information Booth in City Hall.
Persons engaged in lobbying as defined in s. 305-43-4 of the Milwaukee Code are required to
register with the City Clerk's License Division. Lobbyists appearing before a Common Council
