220343 Motion relating to the recommendations of the Licenses Committee
relating to licenses.

FRAMING, INC.", Class B Tavern and Public Entertainment Premises License
Applications Requesting Instrumental Musicians, Disc Jockey and Poetry Readings for
"GREENWOOD PARK GALLERY AND FRAMING" at 4233 W FOND DU LAC Av.
The applicant was present who said that it is an art gallery and that he wants to offer
an affordable framing service to the neighborhood and for the artists to offer his
customers wine and beer on private events.
Individuals in opposition:
Cheryl Wanzo - 3428 N Sherman Blvd – said that she has questions about the hours
of operation, if it is going to be an art gallery or a nightclub because they have had
issues there, and that there is a conflict with the information provided on the
application.
Ald. Coggs asked Mr. Cooney to provide the details of the application.
Mr. Cooney said that it is a Class B Tavern license application with hours of operation
from 10:30 am to 2:00 am, seven days a week.
The applicant said that he only wants to serve beer and wine.
Mr. Cooney said that the application can be amended to serve beer and wine only.
Ald. Borkowski moved to amend the application to serve beer and wine only. There
were no objections.
The applicant said that the late hours (after 4:30 pm) is for private events only (if any).
Ald. Coggs asked if the application can reflect that.
Mr. Cooney said that the application can be amended to say that it is only for private
events.
Ald. Spiker moved to amend the application that the hours after 4:30 pm is for private
events only.
Joseph Mosley – 3416 N Sherman Blvd – said that it is delicate to operate seven days
a week until 2 am because of the persisting traffic and, the issues with the late hours
of operations will bring to the neighbors and, that neighbors want some relief from the
late hours.
Ald. Rainey asked the applicant if he is open to close earlier.
The applicant said that he would consider it.

Ald. Rainey asked the applicant if he intends to have a physical bar on the premises.
The applicant said that he will have a bar to offer beer and wine for art gallery
customers.

Ald. Rainey said that he had a chance to stop by and that Mr. Robinson gave him an
explanation of what he wants to do with the premises which is to maintain the business
operations that his father established and, that he did not see any intentions to turn
this into a bar or nightclub. He added that he has no objections.
The applicant said that his plan is to have groups of students to learn the framing trade
as well.
Ald. Borkowski moved approval of the application as amended. There were no

The applicant was present along with Atty. Michael Maistelman who said that it is very
tragic that a person passed away but that even the police noted that his client
cooperated with the investigation.

Ald. Murphy said that the two incidences are disturbing and asked the applicant what
it’s been done different to avoid these issues from happening again.
Atty. Maistelman said that they are requesting id and run a quick ccap check.
Ald. Murphy said that he recommends renewal with a warning letter.

The applicant was present along with Atty. Michael Maistelman
Individuals also present:
Lydia Hernandez – said that she is here to testify that her daughter died on the
premises due a drug overdose on 4/26/2021 at the hands of a drug dealer and that this
establishment is a place to harbor crimes like drug and human trafficking and that she
does not know why there is no police report about her daughter’s death.
Cathy Taylor – said that this place has been a nuisance and that it was her niece who
passed away in that hotel and that she is in objection.
Whitney Miranda – said that she stayed at the hotel after the passing of her cousin just
to observe and that she saw firsthand drug transactions and that the establishment is
not safe because people come and go and they are loitering around with no security on
the premises, that everything must be repaired.
Atty. Maistelman asked the applicant when she stayed there.
Ms. Miranda said that she stayed one or two months after her cousin’s passing.
Atty. Maistelman asked Ms. Miranda if she called the police.
Ms. Miranda said that she did not call the police and that she was there to observe
what the hotel was about and that she saw a room next to the check in area full of
ladies.

Ald. Dodd said that she wanted to give the condolences to Mrs. Hernandez and that
she is concerned about why this item is not on the police report and asked if there is a
record of the call.
Sgt. Velasquez said that there is a call for service for a drug overdose on 4/26/2021.
Mr. Cooney said that the incident is not shown on the last year report either.
Ald. Spiker asked Atty. Maistelman if his client acknowledges that the overdose
happened at the hotel.
The applicant said that yes, it happened.
Ald. Spiker asked if the staff reported the incident.
The applicant said that it was another guest who reported it.
Ald. Coggs said that human and drug trafficking are common issues for hotels in the
city and asked the applicant what has been done about it.
Atty. Maistelman said that they don’t take cash as a form of payment, that a state id is
required, licenses plates are checked and a quick ccap check are practiced.
Ald. Coggs said that a training is recommended for the staff to be aware of any
suspicious activity and how to address it.
Ald. Spiker agreed that a training is needed and to get in touch with other hotels to
check what are they are doing.
Beer Shah – the applicant’s son - said that they are trying to do a do not rent list of
people not allowed in the hotel and that they are sharing this list with other hotels in the
area in order to set up a network to address this issue.
Ald. Spiker asked if there has been any other drug overdose case.
Beer Shah said that it never happened before and that the person who died never
shown signs of being in trouble.
Ald. Dodd said that she is still concerned about the fact that the applicant did not call
the police and that the applicant knew that this family was going to show up at the
hearing without doing any outreach. She added that it is concerning that the applicant
does not know if the police showed up and that based on the information that we are
getting at this committee, that the applicant has not shown signs on even reaching out
to the family.
Atty. Maistelman said that the problem is that we do not have a police report and that
he cannot put up a plan to defend his client without it and that nothing has happened
within the last year and that the committee should discipline everyone with the same
criteria as other hotel licenses that have been under the same situations or worse.
Ald. Dodd said that she appreciates that Atty. Maistelman tried to make a case for his
client and that the difference is that we have a mother who lost a child in front of us
instead of the police report and that if this item would have shown up on last year
police report, there would have been a progressive disciplinary action instead.
Ald. Dodd moved denial based on the applicant and public testimony. (Prevailed 3-1)

security will be administered since they are going to be open late.
Jose Lozoya – Manager Onsite - said that the security aspect will be seen as soon as
they open and, that the food to go made a little bit of traffic and, that this is why they
decided to open a sitting area.

now.

Lilliam Torres - 128 W Maple St – said that she has lived there for many years and that
her house, themselves and neighbors have been hearing shots and fights at this
location and that this business is a problem for the police and neighborhood. She said
that this place has been opened for the same person but with different names.
Karen Sanchez- neighbor - said that she has owned the house since 1997 and that it
has been a quiet neighborhood but since this bar opened, there have been shootings
and that even a bullet crossed by her bedroom's window.
Ald. Perez asked Ms. Karen if the applicant has reached out to her.
Ms. Karen said that she has not.
Citlali Sanchez – neighbor - said that her property has been vandalized by the patrons,
that there are fights, people urinating on the street and that they are just tired from this
business.
Individuals also present:
Ald. Perez said that he met with the applicant and explained her the problems with the
business and asked the applicant about her connection with the previous
owner/operations.
The applicant said that it was her intention to reach out to neighbors as she gets
closer to open and that her plan is to have an event space, not a bar; for bridal
showers, baby showers, etc and that she wants to have a safe place, with morning
hours for holding meetings just to have different stream of revenue for the premises.
She added that the previous owner is the building owner and that she pays a rent and
that the landlord was clear on the issues in the past.
Ald. Perez asked why she could not reach out to the neighbors before today.
The applicant said that she did not know who they are the ones in opposition.
Ald. Perez said that considering the amount of neighbors who came in and given the
fact that the applicant did not meet with the neighbors; he said that he wants to give
the applicant a fair chance to reach out to neighbors to get their support.

communication with her office and that he has his previous alderperson’s support.
Ald. Spiker asked if the service bar only is reflected on the application.
Mr. Cooney said that the application does not reflect being a service bar only.
The applicant said that is not a bar and Araceli Arevalo appeared to help him with the
language barrier.
Ald. Coggs explained that the application must be amended to reflect the service bar
only.
Mr. Cooney said that the floor plan does not show a bar area where to sit.

The applicant was present along with Atty. Osman Mirza and Marcos Isidoro co-owner.
Atty. Mirza said that this patron was pepper sprayed because he was acting
aggressively and that the security company is no longer servicing Tu Casa in order to
institute better safety. He added that his client has admitted no fault on the injuries
that the individual suffered on the incident dated on January 29 and that it should be
noted that the patron was heavily intoxicated when the police arrived and that the
officers did not observe any lacerations or bleeding. He added that the wife requested
to put him in the vehicle rather to take him for medical treatment when it was offered to
them. He also mentioned that for the incident involving the DJ, the establishment
allowed the police to review the surveillance video to find out that the DJ punched the
patron after he was asked to leave and that the patron returned.
Individuals also present:
Ald. Zamarripa said that one neighbor sent a letter that should be part of the file and
that she got 4 contacts from neighbors who oppose to the license renewal. She said
that she is very disappointed with the applicant and the attorney because no
agreements have been made and that she has heard the attorney say that some
changes have been made but that she was not informed about those changes until
today despite the meetings and calls that they have had. She added that on her last
communication, she made the request to close earlier and that she was told that most
of the revenue comes from the late hours so that it was a straight no. She said that
this establishment is handled more like a nightclub and that at the last committee
meeting, she pulled out the facebook page which advertises tequila nights, ladies
nights, DJ nights and that she has heard from constituents that they offer VIP bottles
which is a very nightclub thing and that's the reason why they refused to close early as
they have acknowledged that most of the revenue comes from this clubby thing. Ald.
Zamarripa also mentioned that she asked the applicant to change the security
company and that Marcos said that it was hard to do it and that the DJ who punched
the patron still works there and that for all those reasons she recommends not to
renew the public entertainment premises licenses due the lack of cooperation to
negotiate and for the unapologetic attitude to the public and that she advocates for a
30 day suspension for the Class B and Food Dealer licenses.
Atty. Mirza said that the name on the letter has been redacted and wanted to confirm if
it's from the same person who appeared at the last hearing, Mr. Miranda.

Ald. Spiker asked if it’s a night club.
Atty. Mirza said that it is a restaurant bar that switches operations like a nightclub type
environment and that on Friday and Saturday nights there is DJ involved which is listed
on the application as well as karaoke, patrons dancing and mariachi. He added that
the hours of operation have been listed from 10am to 2am Mon - Thur and that on Fri &
Sat the establishment closes at 2:30am. He added that his client is attempting to
improve security and that there is a significant revenue that comes after 12:30am from
the bar scene which will be a loss of revenue for his client and that he has changed
security companies, that the pepper spray is no longer part of the policy and that his
client has engaged with an individual from the police academy who makes private
services and that he does not know how is it going to work from now on but that he is
trying. He added that they have implemented rules that no one can enter after 1:45am
and that there are security cameras all around the premises and that the hours of
operation could change at 2am like the rest week.
Ald. Spiker said that it seems to be that on Fri and Sat nights it is operating as a
nightclub and that the rest of week it is operating as a bar and restaurant but that to
dine at 2am is oddly and to objecting to close early during the week days is tied to
needing the revenue as a bar.
Atty. Mizra said that the current closing time on Mondays, Wednesdays and Thursdays
is at 11pm and that on Taco Tuesdays they are open until 2am as well as for Sundays
and he agreed that the application can be amended to reflect the reality.
Ald. Spiker noted that the three incidents on the police report happened after midnight.
Atty. Mizra said that his client knows that he must implement safety procedures and
that he has the right to operate his business with full respect to the community.
Ald. Borkowski said that he is under the impression that Ald. Zamarripa did not hear
from the applicant about the changes that he has put in place.
Ald. Zamarripa said that it is correct.
Ald. Borkowski said that it seems that there is no flexibility from the applicant and that
coming here today without reaching out to Ald. Zamarripa first does not feel good and
that there is no communication between the parts.
Ald. Zamarripa said that she feels offended by their unapologetic attitude and asked
the committee to keep asking questions because she thinks that they have been
misled.
Atty. Mizra said that he is here to represent his client and his position of not closing
earlier as Ald. Zamarripa wants to.
Atty. Borkowski said that Ald. Zamarripa is representing her neighbors as well and
asked Atty. Mizra what the vip thing is.
Atty. Mizra said that it is a group of people paying extra amounts of money to get
drunk like if they own the place.
Ald. Zamarripa said that she would like to see the denial of the public entertainment
premises license application and renewal with a 30 day suspension of the Class B
Tavern and Food Dealer license applications.
Atty. Mizra said that the security company and DJ involved on the incidences from the
police report have been terminated but that it has not been stated in a document yet.
Ald. Borkowski asked the applicants and their attorney again if they are willing to close
earlier.
The applicant said that he cannot close earlier because the patrons go to eat and stay
later for the entertainment.

having fights, drug dealing, smoking cigarettes while pumping and that she has
reported it to the police and that the police is not responding and that she opposes to
the extended hour license as well
Kate Halfwassen – said that they have lived in the area since 2008 and that she is
afraid to fill in there because it is gross. She said that there is people loitering, used
condoms and bottles filled with pee on the floor and that she does not feel safe there.
She said that she wanted to give a clear picture of how discussing the area is and that
she opposes to the extended hours license as well.
Doug English – 423 E Garfield – said that he has been a resident for almost 18 years
and that he does not want the extended hours license for the same reasons as
everybody else and that during the winter months, they do not remove the snow at all
which is not safe for older people like him.
John – said that he opposes also to the extended hours license because of the noise
coming from cars and motorcycles gathered at the gas station and that this issue was
reported to Ald. Coggs back in June and that the applicant does not show any pride for
being in the neighborhood because he did not offered any solutions to move forward.
He added that yesterday they found out that the owner has been only about 20 times at
the business that he owns since 5 years ago.

Claire – 2221 N Buffum St – she wanted to point out that there are 5 bus stops at this
intersection and that these issues are also impacting the transportation users and that
she does not feel safe while waiting for the bus and that she is in opposition of the
extended hours license.
Teresa Turner - 521 E North Av – said that the has lived there for 20 years and that
she has seen the declining on the past 2 years and that she does not feel safe there.

Ryan Champagne – said that he had a chance to speak with neighbors and business
owners and that he bought half block there and that it has been a rough neighborhood
and that is why he makes a call to the city to invest in the area. Added that safety is
his major concern and that in fact, his wife wants to open a doggy daycare and that her
clientele must feel safe dropping their dogs off and because he believes that, we can
grow together because our city is rich in culture, rich in neighbors, etc. He also
mentioned that some problems come from properties owned by the city and the police
not responding on time to the service calls but that meetings like the one held
yesterday, are a step on the right direction. He added that what Mr. Grewal is proposing
is a good compromise and that they all need to work together to make it better and
safe community.
Monica Champagne – 2764 N Buffum St – business owner across the street from the
gas station and that she wants to see a better and quicker response from the law
enforcement.
Aida Gonzalez – said that she has lived next door for the last years and that she has
seen that the people who causes problem are not customers from the gas station.

The attorney said that the neighborhood meeting lasted for 2 hours and that all of the
concerns were addressed at the meeting. She added that her client recognized that he
needs to spend more time at the location, that he has contacted the property owner for
landscaping improvements and to close at 2am during the summer months. She said
that she thinks that the plan of action and the employee handbook presented today
are a good compromise with the neighborhood and that his client wants to move

forward if the licenses are approved.
Ald. Coggs said that lack of cleaning was one of the issues and wanted to check with
the license division how many times a day they will do it because it is not reflected on
the plan of action submitted today.
Ald. Spiker moved to amend the application to approve the landscaping of the location.
There were no objections.
Ald. Borkowski moved to amend the application to increase the cleaning times from 1
to 3 times per day. There were no objections.
Ald. Spiker moved to amend the application for the applicant to maintain a log sheet
for the bathroom and that it will be cleaned more than twice a day, and that the
bathroom will be moved to the inside.
Ald. Dodd move to amend the application to have security from 9pm to 2am.
Ald. Coggs said that there are challenges with these corners and that she wants to be
fair to the gas station and that there is a deterioration from the gas station itself and
that she is willing to work to improve the area with everyone from business owners,
homeowners and the police. She also said that she is struggling with allowing the
business to be open until 2am and that she does not want to see the applicant next
year again and that she believes that is a work that must be done in the area as a
whole.
Ald. Dodd moved to change the hours of operation to close at 2am every day.
Ald. Spiker moved approval of the filling station, food dealer and weights and
measures license applications and a 30 day suspension for the extended hours
establishment license application based on neighborhood and aldermanic testimony
and police report. There were no objections. (Prevailed 4-0)

Sgt. Velasquez answered Ald. Spiker question regarding the incident on the police
report that it is page 16 on the file.
Ald. Coggs said that she had communication with Ald. Lewis and that the reason to
have the application scheduled was the issue with the applicant for not being
cooperative with the police and because she received a lot of emails because of the
items on the police report.
Ald. Spiker moved renewal with a warning letter and to hold the item 9 open (9/21/22).
