He added that he is concerned because of the extended hours license, and that he
also contacted the applicant regarding the poor landscaping situation and that he did
not receive the plan that the applicant said that he was going to submit. He moved to
hold this application until the applicant works along in order to preserve the safety and
the beauty of the park and neighborhood.

police report that there were a number of tavern checks and that his client was
cooperative always. He added that the shooting incident is unfortunate and that they
cannot control people bringing guns on the parking lot but that they do check patrons
entering the premises.
Individuals also present:
Ald. Spiker asked the applicant regarding item 29 – when the patrons left intoxicated –
if the driver was overserved at the bar.
The applicant said this person was intoxicated and that he does not know how to
control the level of alcohol.
Ald. Spiker said that a breath analyzer would help.
Ald. Spiker asked regarding the item involving the shooting, what the procedures are
when a fight breaks up.
The applicant said that all security guards were with both parties and that they took
turns escorting out the parties but that the fist party was waiting for the second party to

come out and that is when the shooting happened.
Atty. Maistelman said that eight or nine guards were there that night.
Ald. Perez asked the applicant if he was there that night.
The applicant said that he was not there but that the manager was.
Ald. Perez asked if he uses promoters and disc jockeys and if the manager is
licensed.
The applicant said that he does not uses promoters and that the disc jockey is there
on Fri and Sat. nights and that the manager is not licensed.
Mr. Cooney said that the manager license is to appoint someone while the agent is not
involved on the daily operations.
The applicant said that he is there on a daily basis and that he might leave early
sometimes.
Ald. Coggs recommended having a licensed manager as well.
Atty. Maistelman said that they would like to amend the plan of operations to have a
licensed manager.
Individuals in opposition:
Jeremy Vanderloop – 79 Pioneer Rd, Fond Du Lac, WI – said that he has submitted a
detailed objection to the license division and that he was also present at the 2018
hearing.
Atty. Maistelman – said that he objects to this testimony because it is from 2018.
Ald. Coggs asked Atty. Vanderloop to continue with his testimony based on the
first-hand experience.
A discussion started about the use of the objection and evidence presented in
previous years.
Atty. Vanderloop said that this is not a one or last year problem but a persisting
problem with garbage, loitering, drug use on his client’s property and parking lot and
asked the committee to take a look to the photos as he was doing a narrative of them.
Atty. Maistelman said that he did not heard about any calls made by Atty. Vanderloop
and his client reporting these issues.
Atty. Vanderloop said that they have also provided videos and photos to the police and
that they reported the parking situations to the police.
Atty. Maistelman asked Atty. Vanderloop if he and his client made any calls to the
police report on the past licensing period.
Atty. Vanderloop said that the police were contacted.
Ald. Perez mentioned that the objections says that they have submitted the calls for
service.
Mr. Cooney said that those calls are from previous years and that is why are not
included in this file and that this premises was licensed with the same type of license
before.
Mr. Fleisner – 10721 W Brown Deer Pl – said that he is the business owner that has
been affected by the patrons from Bar107. He added that what he sees on the
surveillance cameras on Fridays and Saturdays nights is patrons and party buses
parked blocking his business entrance and that are no security guards from Bar107
outside. He said that his company trucks come at any time to unload industrial stuff
and that they cannot get in there because of this persisting situation and that the
drivers do not feel safe when dealing with these patrons. He also mentioned that he
has posted no parking signs and that the signs are removed all the time.
Ald. Borkowski said that if drivers feel unsafe, it is a matter of public safety and that
the police must show up. He also recommended to hire armed security.
Mr. Fleisner said that he pays millions in taxes to the city and he does not see why he
needs to pay more in order to conduct business and that he hired one security guard
who left because he did not feel safe.
Ald. Spiker asked Mr. Fleisner if he has thought about hiring a towing service company
but he supported Mr. Fleisner opinion about having to pay more revenue in order to

control the patrons from other businesses.
Atty. Maistelman asked if the parking issue is the only issue with his client.
Mr. Fleisner said that it is not the only issue, that there is garbage, needles thrown at
his property, people urinating, etc.
Mr. Rick -10720 W Brown Deer Pl – manager of the affected business - said that he
called the parking enforcement and that they were told that they are too far from the
parking enforcement area and that is why they don’t come for the parking issues. He
added that said that most of the issues they are not seen until the next morning when
they review the surveillance video. He said that they have called the police for issues
that happened overnight and that as a matter of fact, the police have come to his
parking lot to give citations to vehicles parked at 6am and running with people
intoxicated inside . He also said that the no parking signs are taken down frequently.
Atty. Maistelman asked if they were advised to hire their own towing company by the
parking enforcement.
Mr. Rick said that they were not given any further advice on how to address the parking
situation except for putting the signs up.
Ald. Borkowski asked why the county has been mentioned and that he wants to make
sure that everyone understands the jurisdiction and that the county and sheriff’s
department have nothing to do with this.
Ald. Coggs asked Mr. Fleisner how long has been in the business.
Mr. Fleisner said that about 8 years.
Ald. Spiker said that this year’s incidences are supposed to be considered for this
hearing but it seems that this business has had issues on the past years and that he
wonders if this is a pattern and asked the applicant what has changed in the last year
to prevent these issues (the shooting incidences precisely).
Atty. Maistelman said that they have submitted a mitigation plan, which is attached to
the file and that they have a new scanner ID, more cameras and that are using flash
lights to search in bags/purses. He also said that they need to look up at the premises
when they are lit up to see if additional lighting around the premises.
Ald. Spiker mentioned that the signs about the allowed age and capacity were not
visible according to the police report.
The applicant said that they are visible now.
Ald. Perez asked what is different with the new ID scanners
Atty. Maistelman said it is a higher technology to ensure that they have all the
information they need to be shared with MPD.
Ald. Perez said that this applicant is here again for the same reasons that in the past
and that it does not seem that the applicant is handling the business properly. He
added that the remedies are just repackaged and that they make no difference.
Ald. Coggs asked Atty. Maistelman if they can have a security guard directing people
not to park on the neighbor’s entrance and parking lot and to redirect traffic with cones
on the street.
Ald. Spiker moved to amend the plan of operations to include a security guard
directing traffic and ensuring that patrons do not park on private property and to post
signs as well. There were no objections.
Ald. Perez asked what kind of disciplinary actions has been granted to this business.
Mr. Cooney said that a warning letter in the past 4 years.
Ald. Perez said that he just wants to put it on the record that only warning letters have
been granted to this business even with the shootings. He also said that considering
what he heard today and that the mitigation for the problems are just a patch of the
past remedies and that looking at the fact that someone was killed at the property and
that he did not hear anything substantial to stop these issues he moved for a 30 day
suspension that in his opinion, should have been recommended before.
Ald. Perez moved renewal with a 30 day suspension based upon on the police report,

Atty. Bobot said that he has spoken with Ald. Stamper and that there is a plan
regarding rehabilitating the exterior for next year.
Mr. Ellzey said that he wants to make sure that the security guard and the exterior
improvements are part of the plan of operations because they have asked for the

another resident, and that she got into a physical fight with the resident, and that is

observed many things that happened there, and that we have been sold a pile of
garbage instead. She added that there is no safety, that there are people that are
violent, unmedicated. She said that Valerie did not steal the cat, that as matter of fact,
that cat has been taken away from that lady because she has tried to kill it twice. She
also said that she moved out to take care of her own health because the place is
unsafe, dirty, with filthy kitchens, bed bugs and cockroaches.
Gene Geraci – Benedict Center Director – said that St. Catherine’s has a strong and
capable staff and that they are very open to work and resolve any issues with the
neighbors. She invited Ald. Bauman to visit the place.
Nick Tamaro – Health Department City of Milwaukee – said that he has worked with
Ms. Weckler and wanted to address how important is the housing situation in the City
of Milwaukee, and that they can help with the bed bug situation.
Shamika May – Community Advocates Woman Center – said that St. Catherine’s are
always responsive and that she gets a positive feedback from the woman they refer.
Atty. Maistelman said that he has a list of people supporting the application and that
he would like to call them just to acknowledge their presence because their testimony
is similar to the others who have testified. He added that they have pulled out an e-mail
and a telephone number for complaints, and that an advocate for residents will be
pointed out, and that they will hold neighborhood meetings quarterly and monthly
resident meetings.
Elizabeth – said the she lived there for a long time and that she likes diversity and
people of all ages and asked not to close this place down.
Ald. Bauman said that we are here because St. Catherine’s applied for a Rooming
House license that they did not renewed more than a year ago and asked Atty.
Maistelman if the mitigation plan is part of the file.
Atty. Maistelman said that it is part of the plan.
Mr. Cooney confirmed that it is part of the plan.
Ald. Bauman said that there are issues that must be addressed, and that we have
heard publicly and privately allegations, threats, operational issues that have occurred
within the last year. He added that this mitigation plan satisfies the issues now. He
added that rooming houses licenses are renewed yearly, and that he does not want to
hear these issues again next year..

Ald. Bauman said that we have a problem because the majority of the condo
association supports the application but that there are other residents from other
buildings that do not support this application. He added that he understands that it is
easier to address the association with representation than working with other
buildings/neighbors with no association. He said that he wants to deny this license
because there is no agreement reached with the rest of the neighbors. He also said
that this business is operating without a license.
Atty. Kersey explained that there are situations that should not have happened but that
there are others initiated by the neighbors like putting cameras on the guests face.
Individuals in opposition:
Janet Arnold – 1111 N Marshall St 301 – said that they took a walk when they saw the
food truck on Saturday night, and that when they took photos, they were approached
by the security guards in a nicely way but the guests were not nice. She added that
one guest told them that they were disturbing the party when they did not interact or
engaged with them. She added that it is uncomfortable to walk in her own
neighborhood with crowds like that, and that they were the ones that were stalked by
the guests.
Mary Slough – 1129 N Marshall St 25 – said that she has live there for 30 years and
that she has been around every year that this license has been renewed. She added
that this is a residential area not an entertainment area, and that her property has a
driveway adjacent to the premises, and that it is used by the guests all the time. She
said that besides the parking and noise issues; the drinking and yelling have gotten
worse and that she thinks that with ticketing events will get even worst.
Doug Downing – said that he has been at the previous hearings because he has
documented what is going on outside of the premises. He clarified that he does not
care about what happens in the inside. He added that he was invited secondhand to
the neighborhood meeting but that the plan of operations is not transparent.
Ald. Bauman said that he advised The Pabst Group about the issues with this property
before they even buy it, and that neighbors are correct because it is about a
residential area and not an entertainment district.
Ald. Perez moved denial based on neighborhood and aldermanic testimony. There
were no objections. (Prevailed 3-0)
