The applicant was present who said that the police report is inaccurate because the
incident happened outside of the building and that they were closed at the moment of
the fight. She added that the person asked not to be taken to the hospital.

Ald. Spiker said that the long version of the police report says that Cha Xiong took her
brother to Froedtert, and that the police did a follow up talking to Sia Xiong later on
May 20th; and that she said that she did not call to the police because the incident
happened outside. He also asked the applicant if she was inside the building when the

incident happened.
The applicant said that she was in the building.
Anoushk - 2637 N 34th St – said that the police did not put his name on the report but
he was the one that talked to the police and that they closed at 12am. He added that
they found out that something was going on because of the commotion happening
outside.
The applicant said that the fight was over when they approached the people, and that
they were not involved at all. She added that the police advised them to call the police
even if the incidents happen outside of the premises.

The applicant was present who said that she was not in the premises regarding the
incident on the police report but, that she addressed the issue with the neighbors at
the regular meeting. She added that the police said that the shots were fired on the
road.
Individuals also present:
Mr. Perrin – Manager – said that the security guard heard the shots outside, and that
they reached out to the police. He added that the police came and looked at the
cameras. He also said that one of the cameras could not be used due password
issues, and that the other one, did not pick up the activity on Mill Rd. He continued
saying that they were able to retrieve the footage from the other camera at the next
day, and that they could not see the vehicle shooting down the road. He also said that
they have held meetings in order to keep the area safe and cooperating with police and

neighbors as they committed when they received the license. Mr. Perrin said that they
have officers coming on a regular basis to make sure that the establishment and
surroundings are safe.

Both applicants were present. Ms. Perkins said that they have grown and that they are
expanding to the left of the current building.
Individuals also present:
Mr. Cooney said that this application was denied on 2020 for concentration and that
they filed for a change of circumstance because another liquor license in the area has
closed.
Ms. Perkins explained that they hold the food license and that they are trying to expand
the food and to add the alcohol.
The meeting paused at 10:16 am due technical difficulties.
The meeting convened at 10:23 am.
Ald. Spiker said that he is concern about this application due the past reasons.
Ald. Coggs said that she shares the same concerns.
Ms. Perkins said that they are a restaurant and that they want to have some more
revenue since things keep costing more and more, and that they don’t have another
plan to back them up. She added that they have been one of the few restaurants that
remained open during the pandemic. She also said that they have been involved with
the Grandville Bid and that they supported the application. Mr. Blain seconded her.
Ald. Borkowski asked if the Grandville Bid has spoken in favor.
Ms. Perkins said that they have.
Ald. Perez asked what are the hours of operation.
Ms. Perkins said that they are open until 9pm and that they want to open until
midnight.
Ald. Perez said that he is willing to entertain a motion if they are willing to offer shorter
hours and to revisit this matter when the representation comes to the office.
The applicant agreed.
Ald. Spiker said that he is fine granting the food license but that he prefers to wait for
the representation to come to the office to discuss the alcohol application.
Ms. Perkins said that they have done everything that they have been asked for and
even waited 3 years to apply for this license.
Mr. Cooney read the minutes from the Grandville Committee Meeting from April 6, 2022
to the committee after Atty. Farris approval.
Ald. Perez moved to amend the plan of operation to close at 11PM. There were no
objections.

The applicant said that he has been in the sport events/entertainment industry for
years.

The applicant said that he will have boxing events.
Ald. Coggs asked when he will open if this license gets granted, and who will be
managing the place.
The applicant said that as soon as possible and that he will manage the place.
Ald. Coggs said that she is familiar with Mr. Lockett and his work and that he is well
known in the community.

The applicant was present who said that the regarding the first item on the police
report, the patron was annoying a lot of people in the bar and that he was pushed out
of the bar and fell. He added that they do not know if the patron passed out because
of the fall or for being intoxicated. He also said that he was not there and that the staff
called the non-emergency number. Mr. Baade said that the he agrees with the second
item from the police report.

Individuals also present:
Ald. Spiker said that he is concerned about calling the nonemergency number after
person went unconscious.
Mr. Baade said that he can see Ald. Spiker’s point.
Andrea Shafton – Wife and Partner – said that Ald. Spiker is right, that the security
must have called 911 instead and that the security guard made a bad judgement in
that case.
Ald. Perez said that he is concerned about the discrepancy.
Mrs. Shafton said that they were not there, and that the security guard did a follow up
to the incident and that no citations were issued.
Ald. Perez said that they should have followed up.
Mrs. Shafton said that this security guard is her son and, that she trust her son.
Ald. Perez suggested to take things more serious as it is a busy corner/intersection
and, that there are police officers that do not file PA-33s.
Ald. Coggs said that the discrepancy could have started with who and how the report
was filed and what the police found when they made the investigation.
Ald. Spiker said that Mrs. Shafton’s son is not here to testify and that Mrs. Shafton is
saying what she was told and, that is not necessary what happened.
Mr. Baade said that they have been in the business for 40 years and, that they have
cooperated with the police the best they can.
Mrs. Shafton said that now it is a difficult environment on Water St and that they had
only one incident this year.
Ald. Borkowski asked what was done different this year vs last year to make a
difference.
Mrs. Shafton said that her son did a lot of training.
Ms. Cervantes said that she did not receive any objections but recommended to call
911 for any medical emergencies.
Ald. Borkowski said that this business is going on the right direction and asked Ms.
Cervantes if she feels comfortable with how this business is doing.
Ms. Cervantes said that she has not received calls from neighbors but that they are
going on the right path and, that she would like to see a warning letter on the file
reflecting that they are correcting issues.
Mrs. Shafton said that they recognize the problem and that they also recognize their
staff and that they have a long way to improve still.

run his own business.

Ald. Coggs said that a new alderperson will come next month and that she prefers that
the new alderperson gets involved with this application because Brady St. is a
challenge. She explained the applicant that it has nothing to do with his business and
asked the applicant if he held the bid meeting yet.
The applicant said that they met only once and that there were some agreements and
disagreements.
Ms. Cervantes asked to hold the application as well.

The applicant was present along with Atty. Vincent Bobot who said that he talked to
Ald. Perez about the situation that was going on at the area. He said that they
concluded that the car wash was the issue and to avoid the nuisance, the car wash
closes earlier and that it has an attendant now. He also said that they have added
security cameras and that the applicant is there, the entire day, seven days at week
and that his client has been very proactive with the situation.

Ald. Spiker said that the call log stated on the police report is not included on the file.
Ald. Perez said that the issue is a gap happening between renewals every year. He
also said that he appreciates the fact that the applicant addresses the issues.
Individuals in opposition:
Comstock Ave Residents: Ms. Jose - said that the car wash allows the people that are
loitering to detail the cars that come out from the car wash. She added that they block
the entrance and you cannot pump gas anyways. She also said that they allow these
people to sleep on the lot and that she recognizes the people because they even tell
her that they need to work.
Mr. Cooney said that the License Division does not license car washes but that it can
be included on the plan of the operation.
Ms. Jose said that something was supposed to be done at the last hearing to limit the
area for the car wash like to put cones on the floor.
Atty. Bobot said that it is a very busy and challenged intersection area and that he has
filed for restraining orders to avoid more problems.
Ald. Perez said that he understands that it is a busy and challenged intersection but
that the store has a store front with a great view and a back door where everything can
be seen and handled.
Ald. Perez moved renewal with a 10 day suspension based on the police report,
neighborhood and aldermanic testimony. There were no objections. (Prevailed 4-0)

The applicant was present along with Atty. Emil Obviagele who said that the item on
the police report was about that the applicant did not know that he needed a Public
Entertainment Premises license to operate the amusement machine.
Individuals also present:
Ald. Perez asked if the applicant was in violation after the letter was sent out about not
allowing gambling machines at the gas stations.
Mr. Cooney said that he does not have a timeline.
Atty. Obviagele said that his client admitted that he made a mistake and paid the
citation.
Ald. Spiker said that even if the court ruled that they were not gambling machines, a
PEP license is required to operate amusement machines.
Individuals in opposition:
Araceli Arevalo – Interpreter
Raquel Coronado - 1319 S 20th St - said that every time that she goes to Pete’s
Supermarket, she sees people using drugs, soliciting to the cars that come into the
gas station, garbage, prostitution, people loitering, sleeping and that all of them seem
very comfortable like if they were at their homes because nothing happens while the
people that live around, they are all concerned about their safety. She added that she
drops and pick up her son at the bus stop because she is concerned about her son’s
safety.
Maria Herrera – 32nd and Burnham – said that there is a lot of drug dealing and
prostitution, garbage and needles on the floor.
Ald. Perez asked if she has seen this activity at the gas station.
Ms. Herrera said that these people even have lawn chairs by the front door and that
they take the woman to the back to the store to unload stuff and that they return after
2-3 minutes. She said that when she pumps gas, she is approached by 2 or 3 people
to get some change.
Maria Lezama – 1419 S Comstock Av – said that she is very concerned because she
cannot even walk to the store, sit by the porch or to pick up her children because
these people are out there all the time asking for stuff. She added that she has been
followed all the way to home asking for money. She also said that she can see from
her window all the activity at the gas station and that she sees the prostitution
happening, the women getting naked and men lining up.
Travis Walt – 2701 S. 10th St. – he said that he testified at the last hearing and that
the gas station never shut down as ordered and that it even got worse. He said that he
has witnessed people parked at the pumps for 40 minutes and prostitutes are getting
into the cars at the pumps all the time. He also said that the neighbors don’t need a
gas station there and definitely not open 24 hours. He added that the owner does
nothing and it’s detrimental to the neighborhood. He said that the shooting started at
the gas station due to a drug deal at the gas station. He said that he would not stop
there; that he would push his car past the gas station and that he has two pop-ups
weekly in that area.
Ald. Perez asked what his set up distance from the gas station is.
Mr. Walt said that it is 25 – 30 feet and that they see the pumps, store, everything.
Ald. Perez asked Mr. Walt if the applicant has talked to him.
The applicant said that the applicant has never approached him.
Ald. Spiker asked if he remembered the dates when the gas station was supposed to
be closed.
Mr. Cooney said that September 23rd was the date that the nonrenewal took effect.
The applicant admitted that he was open after September 23rd because he received
the letter after the 27th.

Ald. Perez said that he and Mr. Cooney talked to the applicant at the gallery at the
common council date and that the applicant was aware of the dates and that he was
advised to contact an attorney.
Ald. Spiker said that it was clear that he needed to shut down his business.
Atty. Obviagele said that the father is terminally ill and that the family under a lot of
stress and he asked for some humanity to the family.
Ald. Coggs said that we are all doing our work and that humanity must be applied for
the neighbors as well who are dealing with the drug activity, prostitution, panhandling,
noise, etc.
Ald. Coggs asked why we are hearing this application when the other licenses were
denied already.
Mr. Cooney said that it is because the other licenses are operating under a TRO
(Temporary Restraining Order).
The applicant said that he made an honest mistake and that he was open past the
23rd.
Diana Perez – 1238 S 18th St - said that she shares the same concerns as the others
and that her neighborhood has declined progressively with this gas station. She added
that she sees the activity all over the place especially by the dumpster near the
building, and that people also congregate at the end of the alley.
Ald. Perez asked the applicant what he has to say about people congregating,
approaching cars, parking long time, etc.
The applicant said that they call the police if the cars are parked for more than 5
minutes and that it is not true that cars park for 30 minutes or more. He said that he or
his staff come out to ask the cars to move and if they don’t move, they call the police.
Atty. Obviagele said that they have submitted a plan of action and that his client has
agreed to put up cameras on the street adjacent to the business as well. He added
that his client recognizes that he must be present and that everyone needs to pitch in
to try to get things rectified.
Ald. Perez said that he received today the plan of action that Atty. Obviagele is talking
about and that the village that he is referring to, lives across the street and that they
have not been taken into consideration at all. He added that the applicant knew about
these same issues for years because he has received disciplinary actions in the past
and that he showed up at the common council meeting knowing the dates but without
knowing what to do. Atty. Obviagele said that his client is going through hard times but
that he is willing to work with the alderperson and community to move forward and
asked that the license be renewed.

happened on Thursday nights and that these incidences have caused ordinance
violations, numerous fights, calls for service, etc. He added that calls for intoxicated
patrons are answered by the police and fire department and passing the cost to the

event on September 30th and he asked the committee to see the video.

Mr. Downing said that this conflict is bleeding and poisoning the guests against the
neighbors, and that he was told that they could held the event anyways because the
caterer was licensed. He added that he does not understand why we have held these
hearings if they can operate anyways. He added that it seems a sort of
misrepresentation or conflict of interest, and that he sees this agreement as
something that happened between attorneys, and that he would like to see more
restrictions with the use of the terrace and greater restrictions on the access.
Mary Slough – 1129 N Marshall – she said that the ticketed events are not fitted for
this residential area, and that she has not been included on these communications.
She said that she contacted Ald. Bauman’s office to get a copy of it. She added that
as today, her driveway has been used and that even the trolleys park blocking her
driveway. She also asked who is going to enforce this plan and she thinks that no
music should be played outside. She said that she does not want bullies yelling at her
own house.
Atty. Maistelman said that there are about 20 persons here to support the license and
named the organizations that they represent.

Lee Johnson – said that he was originally in opposition and that the Pabst response
has been effective. He added that the terrace will be closing at 6pm and putting the
food trucks on their own premises.

Mr. De Torre – Executive Director, Turner Hall – said that they have done business for
years and that they are excellent neighbors and tenants.
Ald. Bauman said that it is true that this application is an issue, and that he is
concerned about the building because the Pabst will not sit around with an empty
building. He added that the Pabst Group could mark the building for development even
if the property has been designated as historic and explained the process. He said that
the consequences for denial could be worse for the long run, and that is why he agreed
to send it back to committee. Ald. Bauman said that we are here with a reasonable
plan that in fact is not enforceable like one of the neighbors pointed out, but that the
worst that can happen is just for one year because they will be back for renewal.
Ald. Spiker asked if Mr. Downing and Ms. Slough are part of the City Green
Condominium and if they received the notice.
Ald. Bauman said they are not part of that condominium but that they are neighbors
and that they received the notice for this hearing.
Ald. Spiker asked if there is something on the plan that addresses the problem of

The applicant was present along with Atty. Jason Luczak and the business owner.
Atty. Luczak said that they have developed a plan of action with the police and that the
noise issues were addressed at a meeting where the neighbor who complained showed
up. He added that the owner provided her telephone number to this neighbor to
address the issues in a timely manner.

Ald. Perez asked when the plan of action was adopted.
Atty. Luczak said that after the battery incident.
Captain Pfeiffer said that regarding the incident from March, both the management and
owner were cooperative. He said that he received the plan of action and that he thinks
that this business will do well.
Ald. Dimitrijevic asked Atty. Luczak if he received communication from her office.
The attorney said that he did receive it.
Ald. Dimitrijevic asked Mr. Cooney how many objections were received.
Mr. Cooney said 5 objections from 2 individuals.
Ald. Dimitrijevic said that there seems to be a pattern and that there is more to do.
She
asked if there is a plan for a double door to avoid the noise issue.
Atty.Luczak said that it is something that is being looked at.
Ald. Dimitrijevic said that the transfer to the new owner has represented some
challenges and that she wants to see the noise issue to be addressed with the double
door and suggested a 10 day suspension.
Atty. Luczak said that the suspension is not appropriate because they have limited
their
hours which has cost them revenue and with the changes that they have made.
Ald. Perez moved renewal with a 10 day suspension based on the police report and
aldermanic testimony and added that what has been done is not enough because there
are 2 issues on the police report. There were no objections. (Prevailed 4-0)

later that day with her girlfriend, and made some damages to the store.

Atty. Arena said that after the 10th item. a meeting was held at district 7, they said
that they were going to put additional lighting which they did and it seems to be working
because of the lack of incidents. He added that the rest of the incidents indicated to
him that there are a lot people with guns around and that they are ready to use them.
He said that after the shooting incidents, they fired one of the clerks and the others do
not speak enough English to understand how to operate the cameras so they are not
allowed to go in that room. He also said that there are 48 cameras at this location, that
the lighting has been a huge help and that the loitering has dropped next to nothing
because of the lighting.
Ald. Spiker said that he is confused about what needs to be done here because we
have the renewal in front of us and the building owner saying that a new application will
be filed soon.
Mr. Mandeep Kler (building owner) said that this agent has not met the requirements to
keep the lease and that a new applicant will be applying soon.
Ald. Spiker said that we do not have control of what Mr. Kler wants to do but to take
care of the renewal applications.
Ald. Rainey asked what is the current situation with the security company.
Mr. Kler said that the security company has staffing issues but that they will be
sending someone out as soon as is hired.
Ald. Rainey asked Mr. Kler if he can guarantee that the security guard will be in place
before the common council meeting.
The applicant said that they can.
Ald. Rainey asked Atty. Arena to provide some sort of documentation to support that
this has been done.

Ms. Lydia Melton said that she is requesting the revocation of the licenses and that
she has provided videos of everything and that even after the bar closes, there is
people fighting, yelling and even shooting before and after the licenses were granted.
Ald. Borkowski asked if she has the name of the officer who treated her bad.
She said that she spoke to the captain of district 7 and that she has her card.
Ald. Borkowski said that the captain should be here as well.
Ald. Perez said that he has seen the videos that Ms. Melton has submitted, and that
he sees what she is talking about, and asked Ms. Melton if the police have the videos
as well.
Ms. Melton said that she has provided the videos to the police as well, that no report
has been filed when she has called for every single item.
Ald. Spiker asked if Ms. Melton can direct the committee on which videos to watch.
The committee watched one video.
Ald. Spiker asked if this file can be held so the police can set up the videos in a way
that can be presented to the committee.
Atty. Farris said that is what the ordinance says.
Atty. Maistelman said that this is not the City of Milwaukee case but this woman’s
case. He added that he requested the police records since his client opened his
business and that there is nothing on it.
Ald. Spiker moved to hold the file to the call of the chair. There were no objections.
