The applicant was present who said that a lot of customers are asking to extend the
hours and also because the business is kind of slow. He also said that he talked to

Individuals also present:
Ald. Spiker asked Atty. Farris if approving this license will be a property right.
Atty. Farris said that it will be a property right.
Ald. Spiker said that he is not comfortable about this item because we do not have
the proper information and because of the vacancy.
Ald. Borkowski said to the applicant that the he is looking to extend the hours for 5
hours, seven days a week and; that it is difficult for the committee to take a decision
on a matter that they do not know the location and where is no representation.
Ald. Borkowski asked Mr. Cooney if something could be done in the meantime.
Mr. Cooney said that we can hold this application and that the applicant can amend the
hours of operation to close 12pm.
Ald. Spiker asked if it would be at the discretion of the president’s office to approve it.
Mr. Cooney said that we could make a note that the committee must approve the
change of hours.
Ald. Spiker said that he wants to send the message out that is not that easy to change
hours when there is no representation.
The applicant said that he used to operate until midnight before Covid.
Ald. Spiker suggested to make a note on the application.
Individuals in opposition:
Roger Rush – 5619 N 36th St – said that one of the benefits of this business is that it
does not go until 3 am; that he has invested in the neighborhood and, that there is a
lot of garbage on the street and people loitering around his house.
Ald. Borkowski said that the applicant and the neighbors can hold a neighborhood
meeting to address these issues.
Mr. Rush and the applicant agreed.
Ald. Brostoff said that the meeting can be held when the new alderperson comes.
Ald. Brostoff moved to hold the application to the call of the chair. There were no

The applicant was present along with Atty. Maistelman.
Atty. Maistelman said that this application was held so they could held a neighborhood
meeting which they did but that they did not submit any information except for a list of
supporters. He also said that no neighbors came to the BOZA meeting to object and,
that they are not requesting extended hours. He said that they will be running a regular
gas station.
Individuals also present:
Ald. Perez asked for the original application hours of operation.
The applicant said that no later than 10 pm.
Individuals in opposition:
Dina Chapple - 5553 N 36th St – she said that she has been at this location for 30
years and that it was fine when this location was a garage. She said that she never got
a letter in the mail regarding the renovation of this location. She said that there are two
gas stations: one on 35th St and the other one on 42nd St and Silver Spring. She said

that they have multiple car incidents on 36th St and Silver Spring and that a third gas
station does not make sense. She said that there is loitering, shootings and violence
around the other gas stations. She also said that she has invested in the neighborhood
and that she has the right to decide what goes and does not go in her neighborhood.
Ald. Chambers asked Mr. Cooney why the witness address is not on the notice list.
Mr. Cooney said that we use GIS with a 250 feet radius.
Ald. Brostoff asked the witness if something can be done or if she has suggestions for
the applicant.
The witness said that she sees coming nothing but trouble and that she cannot
understands how this application made it too far.
Ald. Perez asked for the frame time between BOZA and the construction.
The applicant said that he did not have the BOZA approval before he started the
construction.
Ald. Perez said that it is better not to start with any construction if there is no license
in hand and, that the applicant must see the position that he has put the committee
on.
Mr. Rush – 5619 N 36th St – said that he has invested in this community and on his
own home, that they pick up garbage all the time, that cars park on his driveway, etc.
He also said that he went around the neighborhood and collected signatures from
homeowners who do not want this gas station because there is nothing else that this
gas station can offer to them. He said that he has talked to the applicant twice about
the neighbors not being in support of this business.
Ald. Spiker just wanted to clarify that BOZA and the license division are separated
entities and that he has requested the mailing list to BOZA.
Ald. Perez asked the witness if he has received notices from the license division for
this hearing and the previous one.
Mr. Rush said that he did received the notices.
Carnice Dixon – 5640 N 37th St – She said that they were not informed about the use
of this location and that there are other two gas stations. She added that accidents
have happened at this intersection every day.
Ald. Spiker asked the witness if she is objecting to the gas station or the issues
around the neighborhood.
The witness said that another gas station is not needed because of the reckless
driving and the violence.
Ald. Perez asked the applicant if she has contacted the police regarding these issues
and regarding the activity associated with the gas station at 35th St.
The witness said that she has not because the police is there every day.
Atty. Maistelman asked if the gas station at 35th St has an extended hours.
Mr. Cooney said that they do have the extended hours license.
Kathy Boyd – 5644 N 35th St – said that she never received the notice about that the
gas station was going to be built in. She added that if they had known, they would have
fought for it because the gas stations are destroying her neighborhood.
Atty. Maistelman asked the committee if he can organize the supporters just be
acknowledged.
The supporters registered and the sign in sheet will be added to the file.
Individuals in support:
Betty Carter – 5836 N 36th St – said that this business brings a better appearance to
neighborhood and that it is convenient for her.
Sherry Brown - 5762 N 36th St – said that this gas station looks better than the other
two and that speed humps can be requested to address the speeding issues. She
says that she believes that the applicant will run this business just as well as he does
with his other businesses.
Antonio - 3631 N 36th St – said that he is a homeowner as well, that this is a new
environment, and that it is the only gas station on their side.

Elizabeth Pinkston - 5626 N 37th St – she said that she takes care of her mother and
that this business is safer and convenient for her mom and the elderly who live around.
Juanita Brown - 5748 N 36th St – said that it is more convenient for the kids rather
than to cross the busy street.
Ald. Spiker said that he received the response from BOZA regarding the notices and
that they use a 200 feet radius instead of the 250 feet range that the license division
do and that he sees some LLCs on the list, which is also an issue because the
communication is not passed to the occupants.
Mr. Mirza Frahim – stockholder – said that the business is not open yet and that all
the issues happening around have nothing to do with this business. He also said that
they do not have control of what is happening right now. He added that all the
neighbors have been seeing every step of the construction, that the gas station is
ready to operate. He mentioned that he does not know how people say that they did not
know that a gas station was being built.
Ald. Chambers asked the applicant if he intends to apply for extended hours license in
the future.
The applicant said that he won’t apply for extended hours in the future at all.
Ald. Chambers asked what kind of measures he is going to offer to neighbors.
Atty. Maistelman said that they will do the following:
-participate in the neighborhood meetings
-will clean around the property few times a day
-will participate in the pivot program
-will monitor for any illegal activity around the premises
-will meet with the liaison police officer
-will file for restrictions orders for individuals who do not obey the rules or orders
-will post signs of not loitering and no trespassing, among other things.
Ald. Brostoff said that Atty. Maistelman just acknowledged that things must have been
done the way that Ald. Perez said but given all the facts that made this a weird
application, moved to wait for the new alderperson to come because we want to make
sure that all neighbors must be heard and taken care of.
Ald. Spiker said that it is an awkward situation and asked the applicant if he can wait
or not.
The applicant said that it is costing hardship to make the payments to the bank and
employees.
Ald. Spiker said that the committee should consider the matter as it is and not how it
was talked with the previous alderperson. He added that this lot was not a gas station
before.
Ald. Brostoff said that he withdrawn his motion.
Ald. Chambers said that what is guiding him is that he has spoken to the previous
alderperson and that more people showed up in support than in opposition but that the
applicant must work with both groups of neighbors and that the applicant does not
have intentions to change the plan of operations.

currently in business and that he wanted to expand his business applying for this
license because he fixes telephones.

Ald. Chambers asked what is he going to do to avoid buying stolen phones to protect
the information and identity of the people.
The applicant said that he does not buy stolen phones because he cannot put them in
back in operation specially with the i-phones because there is no way to break the
i-cloud. He said that he also has a record and takes a photo of the picture id of all of
the phones that he buys.

Genera Jones - 2346 N 15th St – said that she has pictures of the cars, the garbage
and everything that happens outside from the store because it affects everyone around
the neighborhood. She added that the police report does not reflect everything what
happens there and that they are ongoing problems. She added that they dump trash
that blows up all over. She also said that the applicant should open at 8 am instead of
5 am.
Individuals also present:
Mr. Ellzey said that this business gets a lot of business at early hours because they
serve breakfast. He added that the applicant works along with the alderperson’s office
and that he has been taking care of the issues brought up by the neighbors.
Ald. Borkowski asked Ms. Jones to get in touch with Ald. Stamper’s office to address
the questions that she might have because this is not a neighborhood meeting.
Mr. Ellzey encouraged the neighbors to call the police to report any issues because
the record is clean.
Ald. Perez asked the witness to forward every photo to Ald. Stamper’s and/or the
license division so they can be part of the file.
The applicant said that Ms. Jones can come any time to the store to talk about any
issues and that he meets with the district captain to talk and work around any issues
and, that he cleans 2-3 times a day.
Ramona Currie – 2233 N 17th St – she said that she opposes to the hours of operation

which bring a lot of issues to the neighborhood. She said that she knows that the
applicant does not have control of what people do outside but that the early hours are
an issue because brings the type of behaviors that they do not want.
Ald. Chambers Jr. is concerned about the renewal of the license vs discussing hours
of operations. He said that we should stay on course. We’ve heard all opposing
testimony, encouraged all constituents to reach out Ald. Stamper’s office to address
these.
Trasus Wright – 1103 W Garfield Av - said that neighborhood is very engaged and that
he is concerned about things not taken care of like the applicant dumping grease on
the street and that he has reported it to Ald. Stamper.
Maria Beltran - 2219 N 17th St – said that this store is a nuisance in the neighborhood
and that she does not want to see this license be renewed. She added that the
neighborhood have cleaned up the park and that the applicant has never joined any of
the efforts. She added that they have brought this issues to the alderperson as well.

Shaquila Smith - 3075 N 40th – said that she loves the breakfast there.
Nicole Love - 4808 W Medford Av – said that she has breakfast there every morning
and that the liquor is chained up early in the morning.
Ms. Barnett - 2335 N 17th – said that the applicant was involved with the neighborhood
prior stating his business operations and, that she patronize the store for breakfast
and sometimes for lunch. She added that she is not happy with the people loitering
outside or washing cars but that she observes that he cares about the rules and
regulations of his licenses.
Chris Smith - 2123 N 33rd St – said that she is the chef and that the applicant makes
sure that everything is good before the day starts and that he is good a person.
Kristina - 8029 W Crawford Av – said that she works at the store and that they do a
good job over there.
Virginia – said that the applicant has put a lot of money in that building despite the fact
that he does not own the building and, that he has increased the lighting and
surveillance system. She added that the sunshine park is a mess and that she has
reported it to Ald. Stamper as well.
Ms. Wallford – 1620 N 20th St - said that the applicant has always supported the
community.
Juanita Williams – 2541 N 14th St - said that the applicant has been very consistent
with the community because he has not left the area or raised the prices.

Mr. Ellzey thanked everyone who came here to testify and said that they are trying as
much as they can, to let everyone know that they have been heard. He added that the
applicant works with the community, with the police department, with the alderman’s
office and that he does a lot behind the scenes.

Ald. Brostoff said that they needed to look at this matter seriously and appreciated the
fact that the applicant has taken the necessary measures.

applicant. She wanted to point out that the applicant has a great history running
business in the area and around the city. She added that she knows that is not the
applicant’s intention to sell drinks to go and, that she will offer alcohol only during her
private events. She also said that the applicant won’t be open as a bar at all.
Mr. Cooney said that the plan operations says that 98% of the sales will come from
selling plants and that any amendments can be done at the table.
The applicant said that she agrees on making the necessary amendments.
Ald. Dimitrijevic said that the applicant has a bright reputation doing business with the
support the neighbors and that the plan of operations reflects the nature of the
business.

nothing against the businesses but that they want to control the situations that happen
at night. She added that they will be requesting to end with this type of licenses for all
the businesses when the time comes up.

road on Sherman Blvd and Capitol Dr.
Individuals also present:
Ald. Rainey said that he agrees with the neighbors’ testimony and that the extended
hours establishments have been an issue everywhere and recommended nonrenewal
of the extended hours based on the neighborhood testimony and renewal of the other
licenses.
Ald. Spiker asked Sgt. Velasquez why the times were not included on the bigger
narrative because they are very helpful when discussing extended hours licenses.
Sgt. Velasquez said that she will address this issue.
Ald. Spiker said that all the incidents from the police report happened outside the
extended hours license but that he is concerned that the applicant did not report the
incidents to the police.
Atty. Maistelman read the abatement plan submitted to the police and provided a copy
to the committee requesting to make it part of the plan of operations.
Ald. Spiker made the motion to include the abatement plan as part of the plan of
operations. There were no objections.

Zhane Brooks - 4750 N 35th St – said that she missed the court date and that she did
not have any saying at the court date because she did not receive the notice but that
the assault never happened.
Mr. Ray said that he wants to keep running his business.
Individuals in opposition:
Roshounda Cleveland - 4750 N 37th St – said that she is the only one that has the
guts to appear every year here for seven years. She said that she has been here
testifying for the same reasons over the years (garbage, loitering, people drinking and
smoking in front of her house, even people having sex in front of her house after
leaving the bar) and no changes have happened. She said that even when the bar is
open, there are people urinating outside. She said that she has submitted the videos
of everything that she testifies about. She mentioned that they had a neighborhood
meeting at the Villard library where she talked about her concerns and that the
applicant has not done anything to fix them and that in fact, the problems have gotten
worse. She also said that this situation is getting ridiculous at the point that some
things are done in purpose like shots being fired in front of her house and or people
blasting music at 3-4 am. She also said that you can see the difference when the bar
is closed because only regular stuff happens on the street.
Individuals also present:
Ald. Spiker asked Ms. Cleveland if the police answer her calls.
Ms. Cleveland said that they do and that they come to her house to retrieve videos as
well and that she has been in touch with the community liaison officer.
Ald. Spiker asked the applicant if she gets in touch with the applicant when there is a
problem.
Ms. Cleveland said that she does not because when she used to do it, they just
laughed at her.
Atty. Maistelman said that the witness gives identical testimony every year so he
asked for a date/time of any specific event.
Ms. Cleveland said that she gives identical testimony because the same things still
happening. She added that a couple of months ago, she had to call the police three
times in one month because of people defecating outside when the bar is open.
Atty. Maistelman asked what the police did.
Ms. Cleveland said that the police did nothing because they did not catch them but
they saw the videos.
Atty. Maistelman asked Ms. Cleveland what has not been done in reference to the
meeting that she had with the applicant and Ald. Rainey.
Ms. Cleveland said that the security guard just sits in the car in front on the bar and
that he does not patrol or control the area at all, people loitering outside the bar,
people urinating outside, people blasting music.
Ald. Rainey said that this is a very difficult situation and that Ms. Cleveland concerns
from last year have made it to the local news and that they are well documented. He
added that the issue is that there is no police report associated with the calls from the
neighbor and that it is hard to take a route to satisfy both parties but after everything
that he has heard and seen supports a motion of renewal with a 30 day suspension due
the issues that neighbor has been reporting.
Ald. Spiker asked Sgt. Velasquez why the events that Ms. Cleveland are not in report.
Sgt. Velasquez said that she is looking at the file and that there a lot of service calls
for this location that did not make it to the police report and that mostly are noise
complaints that are not substantiated.
Ald. Chambers said that after reading the e-mails, he noticed that the bar is open past

2 am and asked the applicant if the neighbors come to him to complaint prior doing it
with the alderperson and what he has done in order to be a better neighbor.
Atty. Maistelman said that no one is here to support those e-mails so those should not

Mr. Ray said that the police have the passwords for the surveillance system and that
there are no customers after 2 am but his employees who leave after.
Atty. Maistelman said that only one neighbor has brought all of the issues up and, that
the neighbor never calls them and, that Sgt. Velasquez said that none of the service
calls were substantiated.
Mr. Ray said that Ms. Cleveland never calls him, that she has his number, and that it
is posted on the back door of his business.
Ald. Chambers moved renewal with a 30 day suspension based on the police report,

in Room 301-B, City Hall, 200 E. Wells St., Milwaukee, Wisconsin, pursuant to s. 19.85(1)
(g), Wis. Stats., for the purpose of conferring with the City Attorney who will render oral or
written advice with respect to litigation in which the city is or is likely to become involved
and then may go into open session for the regular agenda.

In the event that Common Council members who are not members of this committee attend this
meeting, this meeting may also simultaneously constitute a meeting of the Common Council or any
of the following committees: Community and Economic Development, Finance and Personnel,
Judiciary and Legislation, Licenses, Public Safety and Health, Public Works, Zoning, Neighborhoods
& Development, and/or Steering and Rules. Whether a simultaneous meeting is occurring depends
on whether the presence of one or more of the Common Council member results in a quorum of the
Common Council or any of the above committees, and, if there is a quorum of another committee,
whether any agenda items listed above involve matters within that committee’s realm of authority.
In the event that a simultaneous meeting is occurring, no action other than information gathering will
be taken at the simultaneous meeting.
Times for specific agenda items are estimations. If items cannot be heard at their specified times,
they will be heard as soon as practicable thereafter.

station is located on the northeast corner of Kilbourn Avenue and Water Street.
Limited parking for persons attending meetings is available at reduced rates (5 hour limit) at the
Milwaukee Center on the southwest corner of Kilbourn Avenue and Water Street. Parking tickets
must be validated in the first floor Information Booth in City Hall.
Persons engaged in lobbying as defined in s. 305-43-4 of the Milwaukee Code are required to
register with the City Clerk's License Division. Lobbyists appearing before a Common Council
