1. 220413 A substitute ordinance relating to regulations for the parking and
operation of food peddler vehicles.

Ald. Zamarripa and Ald. Brostoff talked about the highlights of the ordinance.
Ald. Perez stated that each district can or not use or apply this ORD, based on the
needs of each district.
Ald. Chambers seconded President's words. He said that this is not in any way, a
reprimand, it is just another tool to make sure that business are making the best use
of their resources and thrive in their business.
Ald. Dimitrijevic addressed concerns relative to operational fees - no change on the
fees.
Pres. Perez asked sponsors how today's testimonies will be taking into consideration,
moving forward.
Ald. Zamarripa stated that through this process they have been able to hear the
constituents concern for their neighborhoods safety and density of food trucks that
may create a traffic safety hazard. She also said that she had the best conversations
with food truck operators.
Ald. Borkowski asked to all food trucks to be considerate of their surroundings.

He said that in relation to the Seniority of the food trucks, just to give more
opportunities to the food truck operators. He is in support of including seniority when
considering new applicants.

She said that the Mayor supports this ORD, thanked the sponsors and also said that it
has been an unprecedented level of collaborations among council members and city

He stated that if this ORD requires to move every two hours, it will create an
inconvenience for their operations. He said that shortening the hours of operations will
reduce his earnings. He added that they do not have control of patrons littering in the
vicinity of where the food truck is parked.

Mr. Wagner said that he supports the food trucks and that regulations must be
implemented. He added that he has submitted photos and video of problems created
by customers and operators like oil on the street, urination in front of his building,
creating unsafe environment for neighbors and businesses. He added that food trucks'
lighted signs block the brick and mortar businesses' signs. He also said that it can't
be at the expense of residents and other business and not get in the way of quiet and
enjoyment.

Resident of the Burnham Park Area.
She said that too many food trucks in the area are creating traffic safety issues for the
area. She also said that food trucks must show concern and consideration of the
people that live in the area. She added that this ORD would help alleviate of the
congestion in the area.
Ald. Coggs asked sponsors regarding the lighting/signage nuisance that food trucks
are using. Ald. Zamarripa is aware and will continue to work with DNS, in future
updates.

all need to be considerate of each other.

She said that she is concerned for the safety of the children playing in the baseball
field. She said that she supports this ORD and she is thankful for the implementation
that this ORD brings.

He said that when the ban was issued, none of the food truck owners were aware. He
added that a meeting took place between sponsors that according to him, it did not go
well. He added that he wants to work together with all food trucks owners and the City
to make this ORD work. He said that downtown is not people friendly and that he is
pushing for a Food Truck Park. He does not agree of the 50-feet restriction.
Ald. Coggs stated that formal complaints are submitted to the License Division and
available to anyone upon request.

printed out the receipt for the fines and that it should take 24 hours to clear. Atty.
Gimbel provided a copy to Mr. Cooney.

Mr. Barnett said that the employee involved is no longer with the company and that
they provide a standard package on tobacco training within 2 weeks of being hired.
Ald. Perez asked what about to clean up and secure the dumpsters.
Mr. Barnett said that he would need to follow up in order to provide a proper answer and
that he is happy to have that conversation with him.
Ald. Perez recommended approval with a warning letter.

today, he won’t be supporting the renewal because there are two incidences with
firearms involved and that something must be done. He added that the applicant has
the power to make changes and no to blame it on the “crazy street”.

Mr. Cooney said that a provisional license must be issued to avoid the lapse of the

next to this business and that they are concerned about the noise because some of
the units are within 100 feet of this bar. She added that it is going to be a problem for
the families who live there and that she asked the applicant to review her hours of
operation.
The applicant said that she has been working very well with the neighbors.

Tori S – said that she lives down the street and that this business has been great and
that the outdoor dining is a good idea.
Zorris – 222 S 3rd #412 – he said that this application will take this business to the
next level and that this is the only business in the block. He added that they have work
hard.
Alahna Parker – 222 S 3rd St #106 - said that she is a regular since the opening and
that she is very excited about the outdoor dining part.

The applicant was present over the phone. She said that they have increased training
measures for ID verification purposes and that the employees, in order to continue
employment, they need to have a training every three months among other things.

Ald. Borkowski said that robberies are an issue for this business and that he
assumes that the proper measures have been actively taken care of.
Mr. Greg Evans – Franchise Owner – said that he owns 7 stores in the greater
Milwaukee area.
Mr. Frank Schultz – District Operations Manager – he said that he is here to support
the applicant and that measures and steps have been taken care of and that they will
continue working on it.
Ald. Brostoff asked if they have been targeted.
Mr. Evans said that they have and that they reorganized the store.
Mr. Schultz said that they have a back room with a cage where cigarettes/tobacco
products are kept and a beer cave that is locked. He added that only food and
non-alcohol beverages are displayed at the front. He also said that these changes were
made over the last months and that they expect them work.
Ald. Brostoff asked the applicant to keep in touch to talk about the changes he sees
in the neighborhood and moved approval. There were no objections. (Prevailed 3-0)

came out to pull his pants down and urinated in the middle street in broad day light.
She added that incidences keep on happening and that they are concerned.
Mr. Lucas said that he believes that all the neighbors have his phone number.
Ms. Fitzgerald said that her husband has reached out to him on his Facebook page
but that they do not have his telephone number.
Mr. Lucas shared his telephone number and said that he can be reached out at any
time and talked about a persistent situation with a person who used to be a regular at
his bar. He added that he has to be very careful about the words that he uses to
accuse or to report because he has been threaten by attorneys.
Ms. Fitzgerald said that she is concerned about all those calls for service not being
recorded.
Sgt. Velasquez said that she has checked the calls for service for the address and
that nothing comes out and that it is probably because the people do not know the
business’ address.
Ald. Brostoff said that is not a big thing to look for the address of the bar if the callers
do not know it.

Ald. Dimitrijevic said that it seems that these large corporations are more difficult to
deal with than the small businesses in the area and those special accommodations
should have been requested prior this meeting. She added that they had this same
conversation last year. She also said that she is fine with holding the application for
now but that she is looking for a real security company to take care of the location.
Ald. Chambers said that he understands Ald. Dimitrijevic’s frustration because it
seems that she is repeating herself from last year and that he does not understands
the reluctance of hiring security guards.

victim got hit with the hand gun, that management did not call the police based on the
fact that the victim said that he was calling himself.
The applicant said that he has been in the business for 20 years with no issues and
that the shooting did not happened inside the store. He added that he has security
cameras in place and that the victim asked not to call the police because he said that
he was calling instead while he was holding the phone.
Ald. Coggs asked if the video matches with what the applicant has said.

The applicant was present and said that the employee had a gun and that what
happened on that day by watching the video, is that they had a customer by the window
that got into with an employee and that they were in the queue for 25 minutes. He
continued saying that the customer got out of the car and went to his trunk to get
something trying to hit the window. He said that at the same time, somebody must
have called somebody, because there is one white car coming up on the side by the
drive thru and pulled up half way cross, got out of the car and shot five or six bullets in
the building.
He added that no one was hurt but that the employee at some point exited the building,
went to the side of the building and fired one gunshot. He said that the employee was

terminated. He added that he has been running these stores for over 35 years and that
they take all the police report items very seriously by putting a plan together
addressing security and how the employees must react because 90% of the
incidences could be deescalated. He also said that they do the same thing with every
store nationwide. He also mentioned that they have had 15 incidents at 11 stores since
last May, with three incidences involving a gun and that this the only incident involving
an employee. Mr. Thompson mentioned that they closed down their offices in
Milwaukee, that somehow the paperwork got lost and that they found themselves
applying for provisional licenses. He said that he understands that the alderman denied
the provisional license because of the shooting. (The applicant provided a copy of the
employee handbook and the rundown of the steps that are being taken right now).
Individuals also present:
Ald. Coggs asked the applicant if he has shared this framework with the alderman’s
office (referring to the documents that were shared at the table).
The applicant said that he had a conversation with him and that he apologized for that
mistake that should not have happened.
Ald. Borkowski asked if the employee returned fire.
Mr. Thompson said that they do not know if he started or returned the fire but that the
employee fired a shot.
Scott Thompson – oversees the operations – said that it seemed that the employee
had the firearm on his person according to the video. He added that they always make
sure to hire the right people for the restaurant with the procedures in place for hiring
and that they will continue brushing them up for hiring and retaining purposes.
Ald. Coggs asked what is the policy for firearms.
Mr. Thompson said that the policy is that no firearms are allowed in the
workplace/store.
Ald. Coggs asked if the employee had the firearm on.
Scott Thompson said that it looks that he had it on and concealed somewhere in his
body.
Ald. Coggs asked if the staff or management knew that he had it on.
Scott Thompson said that not that he is aware of.
Ald. Coggs said that sometimes we need to look not only at the bad actors but at the
work environment as well.
Scott Thompson said that they agreed and that they have changed staff and managers
for the store.
Ald. Borkowski said that he had enough and that he won’t be supporting this renewal
because of the firearm involved with the employee.
Mr. Ellzey said that this situation was disturbing to him and that when he spoke to the
agent, he was told that they could not tell from the video if the employee went to his
car to get the firearm or if he had it on. He continued saying that what the applicant is
saying today, is that it seemed that the employee had the gun on. He also said that he
has not seen the video because he would need to make a special request to MPD and
that he does not know why if the matter is related to the license. He added that the
different versions are the key point to him speaking on terms of ownership and that the
employee was not arrested, he did not answer questions and that he has not been
charged. He added that he agrees with Ald. Borkowski about that we all have to do a
little better and accept our responsibilities. He also said that by the time that the
license is issued (if approved) it is going to be exactly a month (May 31st) which is
enough for a disciplinary action into his opinion.
Ald. Coggs asked if there is anything on the police report about the employee going to
the car.
Sgt. Velasquez said that it does not say that the employee went to his car.
Ald. Coggs asked how could the record reflect the de facto suspension caused by the
lapse.

Mr. Patrick Tanhauser - 7139 N 43rd St – he said that he strongly opposes to have
another liquor store and that there are about 12 liquor stores in a 3 mile radius and that
another store will do nothing for the community. He said that he believes that we can
do better by having other types of businesses rather than liquor stores.
Atty. Maistelman said that the letter from the pastor from the Loving Shepherd
Lutheran Church should have been included in the notice/file.

In the event that Common Council members who are not members of this committee attend this
meeting, this meeting may also simultaneously constitute a meeting of the Common Council or
any of the following committees: Community and Economic Development, Finance and
Personnel, Judiciary and Legislation, Licenses, Public Safety and Health, Public Works, Zoning,
Neighborhoods & Development, and/or Steering and Rules. Whether a simultaneous meeting is
occurring depends on whether the presence of one or more of the Common Council member
results in a quorum of the Common Council or any of the above committees, and, if there is a
quorum of another committee, whether any agenda items listed above involve matters within that
committee’s realm of authority. In the event that a simultaneous meeting is occurring, no action
other than information gathering will be taken at the simultaneous meeting.
Times for specific agenda items are estimations. If items cannot be heard at their specified times,
they will be heard as soon as practicable thereafter.

Avenue and Water Street. You must present a copy of the meeting notice to the parking cashier.
